1979-029,. 1 ORDINANCE NO. 79� AN ORDINANCE AMENDING TITLE 10 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE WEIGHT RESTRICTION AND PERMIT PROCEDURE FOR BUSCH ROAD BETWEEN ILLINOIS ROUTE 83 AND WEILAND ROAD WHEREAS, for the purpose of promoting and safeguarding the public health, safety, comfort and welfare relating to the maintenance and use of Village Roads and Highways and regulating the movement of vehicles exceeding the size and weight limitations as delineated by the Village, and; WHEREAS, the Village deems it appropriate that the Village Engineer shall investigate each request of any owner, operator, lessee or driver of any over- sized or overweight vehicle to transport said vehicle over, upon, or across any Village Road or Highway, and shall have the power to regulate the date, time, route, and conditions, safety equipment and measures to be employed in making such movements, and to issue Village permits authorizing such movement or to refuse, for proper cause, to issue such permits; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1: Chapter BG -15 -101 of the Municipal Code of the Village of Buffalo Grove, Illinois is hereby amended to read as follows: BG -15 -101 Local Street Weight Limits: It shall be unlawful to operate any vehicle on any street in the Village when the gross weight on the surface on the road through any axle of such vehicle exceeds sixteen thousand (16,000) pounds. Where lower limits are imposed by ordinance and signs indicating such limitations are posted, it shall be unlawful to operate a vehicle in excess of such weight on such street, except for the purpose of making delivery or picking up a load, in which case such vehicle may be driven on such street for not more than the minimum distance necessary for the purpose, except when a special use permit procedure has been established for a particular section of street, in which case the specific weight limit shall not be exceeded in any case, unless a special use permit is issued allowing a greater weight on the street. SECTION 2: Chapter BG-15 -102 and Chapter BG -15 -103 are hereby added to the Municipal Code of the Village of Buffalo Grove, Illinois, to read as follows: BG -151 -102 Weight Limit Busch Road Between Illinois Route 83 And Weiland Road: No vehicle or combination of vehicles shall be operated, unladen or with.load, upon Busch Road, between Illinois Route 83 and Weiland Road when the gross weight on the road surface through any axle thereof exceeds twelve thousand (12,000) pounds. BG -15 -103 Special Use Permit for Excess Weight: Upon application in writing, the Village may authorize the issuance of a "Special Use Permit' authorizing the applicant to operate, or cause to operate, a vehicle or combination of vehicles of a weight or load exceeding the maximum specified by Ordinance upon a specified Village Street. a) Application:- The application shall state: 1) The contractor(s) or supplier(s) who will operate overweight vehicles under the permit, and; 2) The extent and duration of the operation, and whether the permit is requested for a single trip or a specified continuous operation. - 2 b) Fees For Special Use Permits: The Village shall collect a fee from the applicant for issuance of a permit to operate a vehicle or vehicles or loads as authorized by this Chapter. Fees that are payable prior to issuance of a special use permit shall be in accordance with the following schedule: Residential Lot served $150.00 per Lot Other $750.00 per Acre C) Violations - Penalties: Whenever a vehicle or combination of vehicles is operated in violation of this Chapter; the owner or driver, or both shall be deemed guilty of such violation; and either the owner or driver, or both may be prosecuted for such violation. Any person, firm, or corporation convicted of any .violation of this Chapter shall be fined in an amount equal to the following: Excess Weight Rate(Per Found Over) 1000 2000 pounds .02 2001 -- 3000 pounds .04 3001 - 4000 pounds .06 4001 - 5000 pounds .08 5001 and over $500.00 d) Liability If Street or Structure Damaged: - Any person driving any vehicle or combination of vehicles upon any street is liable for any and all damages which the street or structure may sustain as a result of any illegal operation. SECTION 3: This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
