1978-066ORDINANCE NO. 7$ -66 AN ORDINANCE AMENDING ORDINANCE NO. 74 -32 (FLOOD PLAIN ORDINANCE) BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1. Paragraph (a) of Section II of Ordinance No. 74 -32 is hereby repealed in its entirety and the following paragraph (a) of Section 11 of the Flood Plain Ordinance is hereby enacted in lieu thereof: (a) Flood based elevation is that elevation of the 100 -year flood or the flood of record as established by the most recent and most accurate available data. The data-sources which shall be used to determine the base flood elevation shall be those data sources in the following list and the order of overall accuracy shall be considered to be the same as the order of the following list: (1) Flood Insurance Studies (FIS), if certified by the Illinois Department of Transportation - Division of Water Resources (IDOT -DWR). (2) Illinois Department of Transportation - Division of Water Resources (IDOT -DWR) Flood Plain Maps and Profiles. (3) Soil Conservation Service- Metropolitan Sanitary District of Greater Chicago (SCS- MSDGC) Floodwater Management Plans, using existing condition data. (4) Other detailed 100 -year flood studies, if certified by IDOT -DWR. (5) HUD Flood Hazard Boundary Maps (FHBM) and Approximate FIS Data. (6) U.S.G.S. Maps of Flood -Prone Areas. (7) U.S.G.S.- N.I.P.C. Hydrolic Investigation Atlases (Floods of Record) SECTION 2. Paragraph (a) of Section III of the Flood Plain Ordinance is hereby repealed in its entirety and the following paragraph (a) of Section III of the Flood Plain Ordinance is hereby enacted in lieu thereof: (a) Wherever reference is made to two and one -half (2 -1/2) feet above high water elevation, that dimension shall apply to those areas covered by the SCS -MSD Floodwater Management Plans or data sources of a higher order of accuracy; for areas not covered by the SCS -MSD Floodwater Management Plans or data sources of a higher order of accurac , the app.licab a dimension above high. water elevation is increased to four feet. SECTION 3. Any person, firm or corporation found guilty of violating any of the provisions of this Ordinance shall be fined no less than $5.00 nor more than $500.00 for each offense. Each day the violation continues shall be a separate offense. SECTION 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law..
