1978-027ORDINANCE NO. AN ORDINANCE AUTHORIZING FIRE AND PAL L.CE....._COMMISSION TO UTILIZE COOPERATIVE TESTING OF RECRUITS WHEREAS, the Village of Buffalo Grove deems it to be in the best interests of the said Village of Buffalo Grove to participate in cooperative testing of recruits for the police service of said community; and WHEREAS, a cooperative testing service has been established by several municipalities in the area known as the Northwest Municipal Conference Area Police Recruitment and Testing Consortium; NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove as follows: SECTION 1. That the Board of Fire and Police Commissioners by and is hereby authorized to utilize the Northwest Municipal Conference Area Police Recruitment and Testing Consortium to administer such segments of recruit testing as the Fire and Police Commissioners shall determine to be in the best interests of the Village from time to time. SECTION 2. That the Board of Fire and Police Commissioners be and it is hereby authorized to utilize the results of such testing in establish- ing its list of elgibles for service in the police department. SECTION 3. That the Board of Fire and Police Commissioners be and it is hereby authorized to utilize eligibility lists compiled by utilization of test results reported by the Northwest Municipal Area Police Recruitment Testing Consortium in making appointments to positions in the police service. SECTION 4. That the Northwest Municipal Area Police Recruitment Testing Consortium be and is hereby authorized to act as an agency of the Fire and Police Commission for the purpose of administering tests as herein- before authorized. SECTION 5. That the Village of Buffalo Grove hereby approves the by -laws of the Northwest Municipal Area Police Recruitment Testing Consortium, a copy of which is attached hereto, expressly incorporated by reference herein and made a part hereof as though fully set forth herein. • M*1 BE IT FURTHER ORDAINED that this Ordinance be and the same is hereby enacted pursuant to the powers granted the Village of Buffalo Grove under the terms and provisions of the Constitution of the State of Illinois of 1970 Article VII Section 10 enpowering units of local government inter aiia to share services and to exercise, combine, or transfer functions or powers among themselves in order to further intergovernmental cooperation and benefits to the public resulting therefrom. The expressed purpose of this body is to provide the operating framework through its organization or such organization as may be designated by it for the conunon recruitment and testing of police candidates. In addition, the Consortium shall serve as a forum for discussion, study, development and /or implementation of ideas or plans of mutual interest and concern regarding the recruit- ment, application process, and physical agility and psychological testing of candidates for the member fire and police departments. The specific objectives of this organization will be: i I Develop a Combined Recruiting Proarari An area wide recruiting program will enable the munici- palities to pool their efforts to draw the MIOST qualified prospects. This capability may prove very cost rff(Ictive if tike present supply of available quality pros�pec:ts . should become limited. 2) Develop the Best Testing Devices The test program would necessitate professional review as to its validity and applicability to the job classification. The pooling mechanism would present a cost effective method of determining this and enable retention of consulting expertise to assist with addressing the requirements of Equal Opportunity Employment. 3) Develop a Valid and Efficient Screenind TechniRue The technique utilized in oral interviews and in the analysis of written data is a difficult one to master. It can often serve to be the determinant that can clarify one candidate's position over another. It would be the purpose to develop validity guidelines that could be employed by the local municipal fire and police commission. 4 #eduction of Cost and , ime The time required and ;he cost of duplicate testing progra ins administered to a sand date who applies to a nuri:bor of departments would be eliminated by a pooling program. Also the costs that would occur- to a number of rwjnicipaliti(--s attepipting test verification (or court defense of an unveri- fied test) would be limited. 5) Maintenance of Local Fire- Police Commission Control of the Candidate Selection Process This program would be a cooperative venture by the partici- pating municipality. It seeks to eliminate duplication and to • improve the standards of selection in relation to perforr »lice. It will NOT usurp local determination of the candidate they desire to serve in their com::runity. All testing and screening information grill be made available to the local fire - police commission of the municipality to which thc, can(i(1 0 h,zs applied. The mannerinwhich that information is utilized b� the local municipality will be determined by that local board. Article I1` Powers The Consortium shall have the following powers: A) To enter into contracts in its own name', including but not limited to service and performance contracts with private consultants and other governmental units. B) To employ agents and employees should the need be manifested. C) To acquire, lease, hold and dispose of property. D) To incur debts, liabilities, or obligations necessary for the accomplishment of its purpose and as deemed necessary by its Board of Directors. E) To exercise those powers necessary and incidental to carrying out the purposes set forth in Article I of the By-Laws, including, but not limited to: l) Establish Testing Standards 2) Selection of Testing Mechanisms 3) Authorize Recruitment Programs 4) Authorize all Forms 5) Authorize Test Dates and Procedures 6) Administer Tests 7) Grade and Compile Test Results 8) Forward Test Results to Applicant Designated Municipalities 9) Notify Candidates of Test Results 10) Make Recommendations to Local Fire - Police Commissions Relative to 'Their Rules and Regulations r f Article III Particip -tion A) Ali municipalities who adopt an ordinance of participation by their respective Boards of Trustees /City Councils shall be members in equal -standing of the Consortium. B) Continued membership shall be continnent upon the payment by each municipality of the annual and /or additional fees as may be determined by the Board of Directors. C) Upon becoming a member, any new member municipality. shall become subject to all existing debts and liabilities of.the Consortium to the same extent as all other mei;ibers. Article IV Board of Directors The Board of Directors shall be established for the Consortium whicF shall consist of the chairman of the fire - police commission or his designate. A) The Board of Directors shall determr,ine general policy of, the Consortium, adopt and amend these By- Laiws, accept net-,, men;bers , and approve the budget. B) The Board shall also designate the agency to serve as staff consultant and/or employ as may be deemed necessary, individuals to function as staff support. C) The Board of Directors shall meet at least once a year in January of that year. Special meetings of the Board of Directors may be called by the Chairman on his initiative or on the request of the representatives of two member municipalities: 1) Unless otherwise specified, a quorum for the transaction of business shall consist of a majority of member- nunicipalities. 2) Roberts Rules of Order shall govern all meetings of tha Board of Directors. Article V Officers There are hereby established by these by-laws three officers of this organization who shall be the Chairman, Vice - Chairman and Secretary - Treasurer. .. ` A) Cha iian - The Chairman shall !)c elcla by a mi j or•i t v of the representatives present ai tht: it-rnuary meeting o` etch The duties of the Chairman ar:,: 1) To preside at all meetings of the Consortium 2) To review the agenda and insure its issuance to all members within (15) fifteen days of a scheduled meeting 3) To call a special meeting of Consortium representatives when deemed necessary 4) To act as chief spokesmen for the Consortium in all matters • concerning its policy considerations B) Vice- Chairman - The Vice - Chairman shall sPr•ve as Chairman in the absence of the Chair -man and will assume all duties and responsi- bil ities of the Chairman in the eventuality that he rriy no longer be able to-serve in that capacity. 0 Secretary- Treasurer - The Secretary - Treasurer shall have charge of all the minutes and official records of the Consortium. He shall also review the financial reports prepared by the staff and present them at the regularly scheduled meetings. In addition, he shall perform all the duties incident to that office and all other duties relative to the Consortium as from time to time may be assigned to him by the Board of Directors. Article VI Support ('e►•sonnel The Board of Directors shall designate an agency or municipality to operate in the capacity of support personnel as may be deemed necessary by the nature of this project. If in the opinion of a majority of the r:.ember municipalities of the Consortium further support or coordination assistance would become necessary, full of part -time personnel may be hired according to the policy of the Board not inconsistent with the express or implied intentions of these by -laws. Article VII Sudc et The fiscal year of the Consortium shall run from May 1 to April 30. The annual budget shall be approved at the regular meeting of the Consortium. The budget will reflect the day to day operations of the Consortiu:.. Additional funds will be forthcoming within 30 days of invoice for the direct and indirect expenses incident to the administration, of each testing cycle and /or for special research or consultation approved by the Board of Directors. All expenses incurred by the Consortiurt%•.-ill to apportioned according to a ratio of the population of the individual municipality as to the total population of the member municipalities. • � � Article .-I I I Audi t The Board of Directors shall call for an annual audit of the financial affairs of the Consortium. This audit shall be performed by a Certified Public Accountant in accordance with generally accepted auditing principles and shall be presented to the member municipalities forty-five (45) days prior to the January meeting for approval at that meeting. Article IX Withdrawal,Termination, and Dissolution A) Withdrawal Any member municipality may taithdravr from this agreement effective on the first day of the new fiscal year. Upon withdrawal it is responsible for: 1) Pion- payment of prior year dues for operating, expenses 2) flon- payment of special direct and indirect expenses relati��e -to their participation in any prior testing cycle. 3) Pro -rata snare of any and all debts incurred by the Consortiu:•r tjhile they were a member. 4) Any contractual obligations it has separately signed with the Consortium. B) Termination The voting membership of any municipality shall be terminated for non- payment of annual dues or failure to render payment of a special assessment within ninety (90) days of invoice. Termination .shall require a majority vote of all member municipalities with the Muni- cipality in question not permitted to vote on the question. The terminated municipality is responsible for all financial indebtedness as outlined in ":Withdrawal Article VIII, Section A." 0 Qissolut The occurred adoption majority ion dissolution of the Consortium shall be deemed to have on the withdrawal of all but two members or upon successful of a motion of dissolution which must be approved by a of the membership. Article XI Ratification The By-Laws are considered in force and the Consortium agreement applicable to those member cor,munities ►•;hose municipal Board of Trustees/ City Councils have adopted by ordinance the intent and concorritiaent conditions of membership. A copy of such ratification resolution shall .be transmitted to the offices of the Northwest Municipal Conference upon .board approval and until such time as a. Secretary is selected pursuant Io Article V, Section C. Article XII Separability That each article, section, paragraph, sentence, clause and provision of these By-Laws is separable and if any provision is held unconstitutional or invalid for any reason, such. decision shall riot affect the romlinder of these By -Laws nor any part thereof, other than that part affected by such decision. dm
