1977-021v. ORDINANCE NO. 77",V COIN OPERATED AMUSEMENT DEVICES BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE t VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1. Definition. The term "coin operated amusement devices" includes any and all instruments, games, machines, equip- ment, and other devices, the operation of which is /are governed or controlled by the insertion of or deposit of a coin or token, but excluding all vending machines dispensing merchandise. SECTION II. Place of Operation No coin operated amusement device /s shall be placed, installed, kept, permitted or operated outside of any building. SECTION III`.: License Required. No person, firm or corporation shall keep, install, maintain, operate or permit any of the afore- said devices in any building or place within the Village for use by the public and /or for gain without first having obtained a license for each such device. All licenses shall be annual licenses with effective dates of January 1st to December 31st of the respective year. SECTION IV. Application for License. Any person, firm or corporation desiring a license /s shall make application therefor to the Village Clerk. The application shall set forth the names and addresses of the applicant, the owners of the machine /s and the address of the building where such device /s will be located, main- tained and operated, and the charge to be made to the customer for such operation. SECTION V. Number of Devices Permitted. No more than one (1) juke box or musical box and no more than three (3) other coin operated amusement devices shall be permitted in any business establishment to which a Village business license has been issued. SECTION VI. Fee. The applicant shall pay an annual fee of $20.00 for each such device. Said fee shall be payable on issuance of license /s and annually thereafter. On any license issued between July 1st and December 31st the fee shall be $10.00 for each such device. 7 � r SECTION VII. License Emblems. Upon payment of license fee /s the Village Clerk shall deliver a sticker license emblem bearing appropriate words and date of issuance. It shall be the duty of the licensee to affix the emblem on the device in a conspicuous place. It shall be unlawful to mutilate or remove such emblem from the device during the year for which the device is licensed. SECTION VIII. Maintenance of Amusement Devices. Amusement devices shall be kept and maintained in good repair and operating condition at all times. In the event of a malfunction of a device the operator of the premises, his agents, servants, or employees on the premises, shall return to the user the moneys inserted' therein. SECTION IX. Repeal. Ordinance numbers 74 -40, 76 -3 and 76 -49 are hereby repealed in their entirety. SECTION X. Penalty. Any person, firm or corporation violating any provision of this ordinance shall be fined not less than Ten ($10.00) Dollars nor more than Five Hundred ($500.00) Dollars for each offense. A separate offense shall be deemed committed on each day during or on which a violation continues. SECTION XI. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. The Clerk may publish this ordinance in pamphlet form.
