CANNABIS CONTROL ORDINANCE
WHEREAS, the State of Illinois through the Cannabis Control Act, III.
Rev. Stat. 1975 ch. 56 -1/2, par. 701 and following, prohibits, inter alia, the
possession of Cannabis Sativa, whether growing or not, and provides penalties
therefore, but it is considered desirable and in the best interests of the
public health, safety and welfare of the Village of Buffalo Grove that there
be an ordinance prohibiting the possession of marijuana (other than in a
concentrated form) which may be used by a prosecuting officer in lieu of the
provisions of the State Statutes in any case in which an accused is charged
with possession marijuana (other than in a concentrated form) in amounts of
ten grams or less,
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees
of the Village of Buffalo Grove, Cook and Lake Counties, Illinois, as follows:
SECTION 1: Definition "Cannabis" also known as "Marijuana" includes any
part or parts of the plant Cannabis Sativa whether growing or not and the seeds
thereof.
SECTION 2: Possession of Marijuana Prohibited. It shall be unlawful for
any person to grow, possess, sell, give away, barter, deliver, exchange, distribute,
or administer any marijuana.
Any person who violates this Section with respect to not more than ten
grams of marijuana shall be fined not less than Fifty Dollars ($50.00) nor more
than Five Hundred Dollars ($500.00).
SECTION 3: That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4: That this ordinance shall be in full force and effect from and
after its passage, approval and publication as provided by statute. This ordinance
may be published in pamphlet form.
