1976-057s � ORDINANCE NO. 76 -57 DISPOSAL OF WASTE AN ORDINANCE REPEALING ORDINANCE 60 -11, AS AMENDED AND PROVIDING FOR REMOVAL AND DISPOSAL OF WASTE. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Ordinances 60 -11, 69 -8, and 76 -16 of the Village of Buffalo Grove, Illinois, are hereby repealed and this Ordinance is enacted in lieu thereof. SECTION 1. Definitions - The following definitions shall apply in the interpretation and enforcement of this Ordinance. (a) PERSON: The word "person" shall include owner, occupant or lessee of any premises, and firm, corporation, or organization of any kind. (b) SINGLE - FAMILY UNIT: The term "single- family unit" as used herein shall mean one or more persons occupying a premises and living as a single ho.isekeeping unit, whether or not related to each other by birth, adoption or marriage, but no unrelated group shall consist of more than five persons, as distinguished from a group occupying a duly licensed rooming house or hotel. (c) WASTE AND RECYCLABLE MATERIALS: The word "waste and recyclable materials" as used herein, shall mean any or all of the following: ashes, tin cans, bottles, cartons, books, newspapers, boxes and other household trash, discarded household furniture, furnishings, fixtures and applicances of all kinds, trees, tree branches, tree roots, tree trunks, brush, shrubs, grass clippings, plant stalks, leaves, and all other rubbish of any kind. (d) PREMISES: The word "premises" as used herein shall mean any house, residence building, flat, apartment dwelling place or place of abode, commercial or industrial establishment, hotel, motel, church, school, hospital, club building or meeting hall. (e) GARBAGE: The word "Garbage" as used herein shall mean any rejected waste or food, offal, swill or carrion, manure, and every accumulation of animal, fruit or vegetable matter that the preparation, ! W use, cooking and dealing in, or storage of meats, fish, fowl, fruits or vegetables, and any other matter of any nature, which are subject to decay, petrefaction and the generation of noxious or offensive gasses or odor, or which during or after decay, may serve as a breeding or / feeding materials for rodents, flies or other germ carrying insects or animals. (f) REFUSE: As used herein includes waste, recyclable materials and garbage. (g) GARBAGE CONTAINER: The term "Garbage Container" as used herein shall mean a container with close fitting cover of galvanized iron or non - corrodible metal or material, rodent and fly proof, non - absorbent, durable and leak- proof, of the type commonly sold as a garbage can, of a suitable gauge and construction to insure durability, with suitable handles on can and lid or a uniform sealed container of plastic, metal, or paper of sufficient strength to hold the weight of refuse placed in them, commonly referred to and sold as the sack system, and of a . capacity of not less than ten (10) gallons and not more than thirty (30) gallons. (h) DISPOSAL FIRM: The term "disposal firm" as used herein shall mean any person, firm or corporation engaged in the business of removal and disposal of refuse as defined herein. (i) DISPOSAL CONTRACTOR: The term "disposal contractor" as used herein shall mean any contractor with whom the Village of Buffalo Grove has licensed and contracted for the removal of refuse from within the Village. (j) CUSTOMER: Any single - family unit or other premises receiving service from a disposal contractor,or firm. (k) DUMPSTER: Shall mean any container approved by the health inspector and used for institutional, apartment, commercial or industrial refuse. SECTION 2. Production of Waste or Garbage - The occupancy of any "premises" for residential purposes shall be prima facie evidence that refuse is being produced and accumulated on such premises and pickups must be made. If the owner fails to remove the refuse 24 hours after notice is visibly tacked on -2- W W the premises by the Village Health Department, setting forth that the condition of the premises which creates a health hazard as determined by the Health Inspector, the Village may cause removal of refuse from the property and the cost of removal shall become a lien on the real estate involved and the Village may recover the costs thereof by appropriate court action. SECTION 3. Waste- Garbage - Storage or Accumulation Accumulation of Waste or Garbage Prohibited: Waste and garbage accumulated on any premises within the Village shall be enclosed in covered garbage or waste containers or sack systems. The same shall be removed from the premises, and every owner and /or occupant shall keep his premises, at all times free and clean of same. Except as herein set forth, it shall be unlawful to dispose of or place any refuse in any public place in the Village. SECTION 4. Garbage Containers Required - Placing and Maintenance. (a) Every customer in possession of any premises in the Village shall provide for, and at all times maintain in good order and repair, a sufficient number of garbage containers for a weekly accumulation of normal garbage. Every customer in possession of any premises shall cause to be deposited in such garbage containers all garbage produced in or on such premises as soon as practicable after same is produced, except as otherwise herein provided. (b) All garbage containers shall be as previously defined and no other type of container or containers shall be acceptable. Filthy, leaking or defective receptacles shall be cleaned, repaired or replaced by the person in possession of the premises served, and at his expense, as directed by the Village Manager, or other qualified person. All containers shall be kept clean and disinfected with an effective antiseptic solution as often as is necessary to maintain them in a sanitary condition. Evidence of neglect of these requirements or unsafe containers shall be determined by the Village Health.I!ns!pector. Containers that are in violation of the Village Ordinance will be identified by a violation tag from the Health Department and must be replaced or repaired within 48 hours. (c) Institutional, apartment, commercial and industrial waste and /or garbage containers not mounted on wheels shall be stored on durable racks, placed on an easily cleanable impervious surface. The racks shall raise the waste and /or garbage containers at least six (6) inches off the storage surface. Containers mounted on wheels shall be specifically designed for use with collection vehicles. -3- Container's wheels must elevate base of container a distance of at least 'six (6) inches off the storage surface. Storage floor must have an impervious easily cleanable surface. Compactor box and refuse containers which are mechanically raised or dumped are also permitted for institutional, apartment, commercial and industrial use. All dumpsters which contain garbage shall be covered and be maintained as in Section 4 (b). (d) Contents of Containers: It shall be the duty of every customer in possession of any premises to cause all garbage produced on the premises to be thoroughly drained of all surplus liquid, securely wrapped or bagged in pager or packed in a covered box or carton of such dimensions as will permit of its free passage into and out of the garbage container, and finally deposited, after such wrapping or bagging, in such garbage container as soon as practicable after the same is produced thereon. Materials of every character shall be securely wrapped or bound in such manner as may be necessary to prevent the scattering of same, and shall be deposited in a garbage container or otherwise deposited as prescribed herein. (e) Except as herein set forth, all waste shall be placed in suitable containers to prevent the same from being scattered, spilled or blown away. All waste and recyclable materials, except garbage, of a size or nature which renders it unsuitable for deposit in waste containers shall be placed on the ground adjacent to the containers in neat and orderly bundles or stacks not to exceed seventy (70) pounds in weight and four feet in length except as otherwise provided herein. (f) Location of waste and garbage containers: It shall be the duty of every person in possession of any premises in the Village of Buffalo Grove, for which a waste or garbage container or containers shall be provided, to place the same at ground level in sight at a location that may be-conveniently and economically serviced; provided, however, it shall be the duty of every person in possession of any single - family unit in the Village of Buffalo Grove for which waste or garbage container or containers shall be provided, to place the same in the parkway at the curbline in front of said unit where it can be seen from the road on scheduled pick -up days. Containers, or any other material as set forth herein, shall be set out not earlier than 5:00 P.M. the night before -4- collection. Containers shall be removed from the parkway within twenty -four (24) hours after collection. All scavenger routes shall start at 7:00 A.M. and if garbage is not out when the truck arrives, then the garbage will be picked up at the next regular pick -up. Garbage set out too late for collection shall be removed from the parkway by no later than 6:00 P.M. of the pick -up day missed. (g) Inspection: All garbage containers shall be subject to inspection by the Health Inspector or other Village personnel selected by the Village Manager. SECTION 5. Collection and Disposal of Refuse. (a) All refuse, waste and garbage shall be called for and disposed of by a disposal firm duly licensed by the Village of Buffalo Grove or a duly licensed Village disposal contractor, except that building and other construction contractors may remove construction, remodeling, and demolition debris, tree trunks, brush and shrubs. (b) No refuse shall be burned, dumped, scattered or buried within the Village limits of the Village of Buffalo Grove. (c) Garbage and other combustible wastes may be disposed of..within the building where it is accumulated or within a closed building accessory thereto situated on the same premises by means of closed compaction type equipment approved by the National Solid Waste Management Association or by complete incineration of such garbage or waste in such manner as to create no noxious orders, smoke or other nuisance, or by grinding or by shredding such waste finely and disposing of it through pipes leading to a public sanitary sewer, provided that all garbage or combustible matter so disposed of in such pipes shall have been ground or shredded to such a degree that all particles are carried freely under the flow conditions normally prevailing in the sewers into which same is deposited. Any closed compaction type equipment, incinerator, grinder or shredder shall be in compliance with the State of Illinois Enviromental Protection Agency standards and regulations. (d) No incinerator will be allowed within 250 feet of a residential district, said distance being measured from property line to property line, this restriction shall not apply to schools. -5- W SECTION 6. Building /Construction Debris Any du.mpster, drop box, dump truck or other container for the collection and /or removal of building debris from new construction or remodeling project or demolition debris shall have the name and phone number of the disposal firm or builder /contractor /owner plainly displayed on said container. SECTION 7. Sanitation Requirements. Unless hauling recyclable materials to .a recycling center, no person, firm, company or corporation shall transport refuse over the streets or other public ways in the Village unless such waste being transported over or along the streets of the Village or other public property thereof is contained in a leak -proof compaction type body commonly referred to as a "packer type" refuse body, or a vehicle approved and licensed by the Village. Such equipment shall be cleaned at sufficient frequency to prevent nuisance and insect breeding, shall be maintained in good condition and repair and may be stored or kept when not in use in a tightly constructed and closed building or shed within the Village, provided such building or structure shall conform with the requirements of the Zoning Ordinance of the Village. The disposal contractor or disposal firm shall immediately clean up any refuse that he may have caused to spill on private premises, parkways, streets, alleys or other public places, in a neat and workmanlike manner and shall replace at his expense, containers which may be damaged by carelessness of his employees. SECTION 8. Village Contractors for Disposal Only one license shall be issued for the collection of refuse, waste, or garbage located at single family units and the Village shall enter into a contract with such licensee. The Village reserves the right to bill to and collect from each of said single - family units. It shall be the purpose of any such contract to provide for the highest quality and quantity of service at the lowest economic cost to each class of customers. Among other things, any contract entered into by the Village with a contractor for the collection of refuse within the Village shall not exceed ten (10) years in duration, and (a) Shall provide that the Village reserves the right to direct the contractor as to where he must or cannot dump or dispose of the waste or garbage he collects under contract with the Village. MIC W (b) Shall reserve to the Village the right to receive and /or have prepared, annual audits of the contractor's books of account covering all unit pickups within the Village at his expense for the purpose of establishing and maintaining fair rates for each class of customer and to provide for adequate and sanitary collection. (c) Shall reserve to the Village the right to establish rates and service standards. (d) Shall require the posting of a performance bond with adequate surety to carry out the purposes of the contract. (e) Shall require that premises serviced by a Village disposal contractor shall be served no less often than once a week even when a scheduled pickup is eliminated because it occurs on a holiday. (f) Shall require that a Village disposal contractor have at least one truck operating within the Village five (5) days per week, except on legal holidays and Sundays. Legal holidays are Christmas, New Year, Easter, Thanks- giving, Fourth of July, Memorial Day, and Labor Day. No make -up day is required after a legal holiday unless necessary to fulfill the once per week minimum pickup. SECTION 9. License for Private Disposal (a) Except as otherwise set forth in this Ordinance, no person shall remove refuse, waste, or garbage from any premises in the Village or transport same through the streets, alleys or public ways in the Village, or in any other manner dispose of same originating in the limits of the Village, or contract for or permit himself or itself to be employed or engaged for any such removal, transportation or disposal without first having secured a license for performing such disposal service from the Village. No more than two licenses shall be in force at any one time. (b) Application for license shall be made to the Village Clerk. The annual license fee shall be Five Hundred Dollars ($500) payable annually and the license shall expire on the 30th day of April following its issuance. Evidence of such license shall be provided by the Village and displayed on each motor vehicle of licensee used in the Village. (c) All license holders are subject to the restrictions as contained in Section 8, Paragraph a through d inclusive. Every applicant must submit complete financial statement and references as to his financial responsibility. -7- (d) Every applicant must demonstrate that he has adequate and sufficient equipment, personal and financial responsibility to render service to any customer requesting it and in accordance with the provisions of this Ordinance. (e) Every applicant receiving a waste and recyclable material and garbage license must agree to service not less than once each week any resident requesting such service and paying the established fee. All institutional, commercial and industrial garbage shall also be collected not less than once each week. (f) Every licensee shall carry public liability insurance in an amount not less than $250,000/$500,000 plus $30,000 of property damage insurance and workman's compensation for his employees. (9) No licensee shall dump or otherwise place or dispose of waste or garbage in violation of the laws of the State of Illinois or the ordinances of any municipality. (h) The President and Board of Trustees of the Village reserve the right to deny any applicant a license if any reasonable doubt exists as to the applicant's reasonable compliance with the provisions of this ordinance or any other ordinance provisions of the Village. SECTION 1'0..Penalties (a) Any person who violates, disobeys, omits, neglects or refuses to comply with, or resists the enforcement of any of the provisions of this Ordinance shall be fined not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. (b) In the event a disposal firm violates any provisions of any ordinance of this Village, the Village shall have the right, in addition to enforcing the penalties otherwise provided, to revoke the license of such waste disposal firm. SECTION 11. All ordinances, or parts thereof, in conflict with the provisions of this ordinance are hereby repealed. F f 4• tt SECTION 12. Effective Date. Among other things, any contract entered into by the Village with a contractor for the collection of refuse within the Village shall not exceed ten (10) years in duration, and (a) Shall provide that the Village reserves the right to direct the contractor as to where he must or cannot dump or dispose of the waste or garbage he collects under contract with the Village. _6- (b) Shall reserve to the Village the right to receive and /or have prepared, annual audits of the contractor's books of account covering all unit pickups within the Village at his expense for the purpose of establishing and maintaining fair rates for each class of customer and to provide for adequate and sanitary collection. (c) Shall reserve to the Village the right to establish rates and service standards. (d) Shall require the posting of a performance bond with adequpte surety to carry out the purposes of the contract. (e) Shall require that premises serviced by a Village disposal' contractor shall be served no less often than once a week even when a scheduled pickup is eliminated because it occurs on a holiday. (f) Shall require that a Village disposal contractor have at least one truck operating within the Village five (5) days per week, except on legal holidays and Sundays. Legal holidays are Christmas, New Year, Easter, Thanks- giving, Fourth of July, Memorial Day, and Labor Day. No make -up day is required after a legal holiday unless necessary to fulfill the once per week minimum pickup. SECTION 9. License for Private Disposal (a) Except as otherwise set forth in this Ordinance, no person shall remove refuse, waste, or garbage from any premises in the Village or transport same through the streets, alleys or public ways in the Village, or in any other manner dispose of same originating in the limits of the Village, or contract for or permit himself or itself to be employed or engaged for any such removal, transportation or disposal without first having secured a license for performing such disposal service from the Village. No more than two licenses shall be in force at any one time. (b) Application for license shall be made to the Village Clerk. The annual license fee shall be Five Hundred Dollars ($500) payable annually and the license shall expire on the 30th day of April following its issuance. Evidence of such license shall be provided by the Village and displayed on each motor vehicle of licensee used in the Village. (c) All license holders are subject to the restrictions as contained in Section 8, Paragraph a through d inclusive. Every applicant must submit complete financial statement and references as to his financial responsibility. -7- (d) Every applicant must demonstrate that he has adequate and sufficient equipment, personal and financial responsibility to render service to any customer requesting it and in accordance with the provisions of this Ordinance. (e) Every applicant receiving a waste and recyclable material and garbage license must agree to service not less than once each week any resident requesting such service and paying the established fee: All institutional, commercial and industrial garbage shall also be collected not less than once each week. (f) Every licensee shall carry public liability insurance in an amount not less than $250,000/$500,000 plus $30,000 of property damage insurance and workman's compensation for his employees. (g) No licensee shall dump or otherwise place or dispose of waste or garbage in violation of the laws of the State of Illinois or the ordinances of any municipality. (h) The President and Board of Trustees of the Village reserve the right to deny any applicant a license if any reasonable doubt exists as to the applicant's reasonable compliance with the provisions of this ordinance or any other ordinance provisions of the Village. SECTION 10. Penalties (a) Any person who violates, disobeys, omits, neglects or refuses to comply with, or resists the enforcement of any of the provisions of this Ordinance shall be fined not less than Ten Dollars ($10.00) nor more than Five Hundred Dollars ($500.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. (b) In the event a disposal firm violates any provisions of any ordinance of this Village, the Village shall have the right, in addition to enforcing the penalties otherwise provided, to revoke the license of such waste disposal firm. SECTION 11. All ordinances, or parts thereof, in conflict with the provisions of this ordinance are hereby repealed. -8- SECTION 12. Effective Date.
