1976-042ORDINANCE NO. 76 - AN ORDINANCE LICENSING PASSENGER VEHICLES BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: SECTION 1. License Required: No person, firm or corporation shall conduct the business of hackman, cabman or of operating a public passenger vehicle for hire without having first obtained a license therefor as is herein provided; and every party conducting such business shall conform to the provisions herein con- tained. A license shall be required for every public passenger vehicle for hire that provides a service wholly within the confines of the Village or for any service that is initiated within the Village. SECTION 2. Definition: A person, firm or corporation is hereinafter referred to as a person. SECTION 3. Licenses: Upon compliance with the provisions of this Ordinance the Clerk shall issue a license to be issued in the manner as generally prescribed for the issuance of licenses, except as otherwise set forth in this Ordinance provided no license shall be granted to any person under the age of eighteen (18) years. The Clerk may grant renewals of licenses hereunder and may issue licenses for the replacement of one vehicle by another by same owner or licensee. SECTION 4. Public Convenience: No license shall be issued to any person for the operation of a taxicab or taxicabs, unless and until the corporate authorities first declare that public convenience and necessity require such operation. In arriving at their decision as to public convenience and necessity the corporate authorities shall take into consideration: (A) The public demands and traffic conditions; (B) The number, kind, type of equipment, rates and color schemes proposed; (C) Increased traffic congestion and available parking space; (D) The safe use of the streets and such other relevant facts as the corporate authorities may deem advisable or necessary. SECTION 5. Condition of Vehicle: Before a vehicle may be licensed said vehicle must be found by an inspector appointed by the Village Manager to be: (A) Less than years old. (B) In a safe, clean condition. 1 MW (+ SECTION 6. Three Month Inspections: Every licensed taxicab must pass an inspection by an auto mechanic approved by the Village Manager once in every three month period. No vehicle shall continue to be licensed which does not pass the inspection. A fee of $_16, 0 0 shall be paid the Village Clerk for each inspection. SECTION 7. Insurance: No person shall conduct the business of hackman, cabman, or of operating a public passenger vehicle for hire unless the person shall insure each vehicle to be operated as a public passenger vehicle with the following public liability insurance coverage. (A) One hundred thousand dollars ($100,000.00) per person for bodily injuries; (B) Three hundred thousand dollars ($300,000.00) per accident for bodily injuries; (C) Ten thousand dollars ($10,000.00) for property damage. Each person conducting the business of hackman, cabman, or of operating a public passenger vehicle for hire within the Village shall, on or before the fifth day of each month hereafter, present to the Clerk his certificate showing insurance carried thereon in compliance with the foregoing provisions of this Ordinance, and the Clerk shall acknowledge presentation of the certificate by writing the date and his initials upon the certificate. Failure to present the proper insurance certificate shall constitute a violation of this Ordinance and shall be grounds for immediate revocation of licenses issued for the operation of public passenger vehicles within the Village. SECTION 8. Cab Stands: No vehicle of any kind shall stand upon, be parked upon, or make use of any public taxi or hack stand in the Village unless the owner thereof has obtained a license as provided herein. SECTION g. Clerk's Register: It shall be the duty of the Clerk to keep a register of the names of persons to whom licenses are granted or transferred, the dates when issued or transferred, the numbers of the licenses, and the descriptions of the vehicles licensed. SECTION 10. Name and Number of Vehicle: Each vehicle licensed as aforesaid shall bear, on the outside thereof, in a conspicuous place, the name of the owner thereof in letters not less than two inches (2 ") in height, -2- W properly proportioned and legible. Every vehicle shall, in addition to the name, bear a number on the outside thereof in a conspicuous place. SECTION 11. Rates of Fares: The rate of fares to be charged by the operator of an-,,r such vehicle shall not exceed the following: For the first one -sixth (1/6) of a mile or fraction thereof $ .60 For each additional one -sixth (1/6) mile or fraction thereof .10 For each additional passenger over the age of twelve (12) years carried in such vehicle .20 For each one minute of waiting time .10 For a trip to a destination outside the corporate limits of Buffalo Grove the amount showing on the meter plus an additional twenty percent (20 %). No meter or other measuring device shall be pulled or the mechanism thereof started until all patrons shall have entered the vehicle. All rates of fare shall be posted in letters at least three - fourths inch (3/4 ") in size in legible form in such manner as to be visible from the rear seat of the vehicle. Such sign shall also state that the customer shall pay only that amount which appears on the meter. A schedule shall also be posted showing the rates of fare for out of town destinations where the additional twenty percent (20 %) charge over that shown on the meter is applicable. SECTION 12. Disputes Over Fare; Receipt: All disputes as to prices or distances shall be settled by any member of the police force most convenient to the site of the dispute. Upon request of any passenger, the driver of the vehicle shall give the persons so requesting a receipt for the amount of fare demanded and paid. SECTION 13. Penalty For Overcharge: The owner of driver of any vehicle, licensed as aforesaid, who may have demanded and received any fare in excess of what is provided in this Ordinance, shall return the excess received and in addition, be liable to a penalty of twenty -five dollars ($25.00) and to the revocation of his license. SECTION 14. Advance Payment: Except where the fare is registered on a meter, every owner or driver shall have the right to demand his fare of the person so employing him on entering his vehicle, and may refuse to convey any person who shall not comply with the demand. SECTION 15. Refusal To Carry Passenger: No owner or driver of any vehicle, licensed under this Ordinance, shall refuse to convey in this Village, any person with or without baggage, when applied to for that purpose; or, having -3- MW MW F, !4 undertaken to convey the person, shall fail or neglect. to do so, under a penalty of twenty -five dollars ($25.00) for each offense. SECTION 16. Multiple Fares: No person or owner having accepted employ- ment from any person shall.while the person having employed him is in his vehicle accept or solicit any other person as a passenger except at the request and direction of the person who shall already have employed him. SECTION 17. Soliciting Trade:. It shall be unlawful for the owner or driver of any such vehicle to solicit by word, gesture or otherwise, the patronage of any person upon any public street in the Village. SECTION 18. Loitering Prohibited: It shall be unlawful for any person not the driver or operator of a public passenger vehicle to sit in the front seat of the vehicle, with or without the presence of the driver or operator while any vehicle is parked at any designated cab stand. It shall be unlawful for any person not the owner or operator of a public vehicle to ride in the front seat of the vehicle, except a passenger for hire, while in or during the course of transporting a passenger to a designated destination. It shall be unlawful for any owner or operator of any public passenger vehicle to permit any person, a passenger for hire excepted, to sit in the front seat while at a cab stand or to ride in the front seat with the driver while a passenger for hire is being transported. SECTION lg. Revocation Of License: In addition to any other penalties prescribed, any licensee having been found guilty of a second violation of any Section of this Ordinance shall be subject to having his license revoked by the President after a hearing held by the President after due notice to the licensee of the time and place of the hearing and of the charges to be considered at the hearing. SECTION 20. Sticker; License Plate: Village stickers shall be purchased from the Village for all public conveyance vehicles prior to the issuance by the Village of a license for a public passenger vehicle. SECTION 21. Driver's Identification Card; Appearance: Each public con- veyance vehicle licensed hereunder shall have a card of identification of the operator of the public conveyance vehicle displayed prominently in the vehicle, said card to contain a picture of the operator of the vehicle. Each operator of a public conveyance vehicle licensed hereunder shall be cleanly and properly attired while operating the vehicle. -4- Is- 7 _ � SECTION 22. Minimum Operating Period: All 1 i censees hereunder shall be obligated to operate the public conveyance vehicles licensed hereunder a minimum of eight (8) months in each calendar year. The failure to so operate a public passenger conveyance vehicle for a said eight (8) month period shall be grounds for immediate revocation of the license issued under this Ordinance. SECTION 23. Number of Vehicles: The number of public conveyance vehicle licenses to be issued by the Village under this Ordinance shall be limited to twenty -one (21). SECTION 24. Taximeters: Every taxicab shall be equipped with a taximeter connected with and operated from the transmission of the taxicab to which it is attached. The taximater shall be equipped with a flag at least three inches (3 ") by two inches (2 ") in size. The flag shall be plainly visible from the street and shall be kept up when the taxicab is for hire and shall be kept down when it is engaged. Taximeters shall have a dial or dials to register the tariff in accordance with the lawful rates and charges. The dial shall be in plain view of the passenger while riding and between sunset and sunrise the dial shall be lighted to enable the passenger to read it. SECTION 25. Fees: The fee for the license of each public passenger vehicle shall be $30.00 annually. SECTION 26. Penalties: Except as herein otherwise set forth, any person, firm or corporation violating any of the provisions hereof shall be fined not less than $10.00 or more than $500.00 for each offense. Every day that the violation continues shall be considered a separate offense. SECTION 27. Validity: This Ordinance may be published in pamphlet form and shall be in full force and effect from and after its passage, approval and publication according to law.
