1976-0171 4. . . 4 ORDINANCE NO. 76 - AN ORDINANCE ADOPTING THE ILLINOIS VEHICLE CODE AND A BUFFALO GROVE SUPPLEMENT THERETO AS THE TRAFFIC CODE OF THE VILLAGE OF BUFFALO GROVE WHEREAS, Public Law 78-738 providing for the adoption of the Illinois Vehicle Code, by a municipality, by reference was passed by the Illinois State Legislature and signed into law by Governor Daniel Walker on September 11, 1973, and became effective on January 1, 1974; and WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove, Counties of Cook and Lake, State of Illinois desire to adopt the Illinois Vehicle Ccde with amendments as the Vehicle Code for the Village of Buffalo Grove; NOW, THEREFORE, BE IT ORDAINED, by the President and Board of Trustees of the Village of Buffalo Grove, Counties of Cook and Lake, State of Illinois as follows: SECTION 1: Ordinances Numbers 0- 62 -18, 0 -62 -3, 0 -65 -1, 0- 68 -12, 0 -70 -211, and 0 -74 -7, as amended a.re hereby repealed in their entirety and the following is enacted in lieu thereof: SECTION 2: That the Illinois Vehicle Code, 1975 Edition (Chapter 951, I.R.S., 1975) be and the same is hereby adopted by reference as the Traffic Code for the Village of Buffalo Grove. That the Illinois Vehicle Code, 1975 Edition, is hereby amended by the following Buffalo Grove Supplement to the Illinois Vehicle Code: -2- BG -1 -1( BG -1 -1( BG -1 -1( Chapter BG•= MENT TO THE ILLINOIS VEHICLE CODE Definitions: Loading Zone: The space adjacent to the curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. Property Line: The line marking the boundary between any street and the lots of property abutting thereon. Public Building: A building used by the- municipality, the County, Park District, School District, The.State of Illinois, the United States Government, or Fire District. Villager The Village of Buffalo Grove acting directly or through its duly authorized officers or agents. Blank BG 4 -101 Any motor vehicle or other vehicle in a state of disrepair rendering the vehicle _ incapable of.being driven in its condi -. tion; or any motor vehicle or other vehicle that has not been moved or used for seven (7) consecutive days or more and is apparently deserted. BG 11 -101 Blank Chapter BG - 11 -201 Bicycle Ordinance: A. Definitions: As used herein, the following words shall have meanings set opposite them. 1. Driver: When an individual is using a bicycle on the roadway, he is identified as the driver of the bicycle. 2. Rider: When an individual is using a bicycle on the sidewalk,or path used for the exclusive use of bicycles, he is identified as the rider. 3. Operator: When a regulation is intended to apply to the user of a bicycle on either the roadway or sidewalk or path, he is referred to as the operator. B. License required: No person who resides within the Village shall ride or propel a bicycle on any street or upon any public path for the use of bicycles, unless such bicycle has been licensed and a license is attached thereto as provided herein. C. Licensing of bicycles: 1. The parent or guardian of any child below the age of fourteen (14) owning or operating a bicycle shall obtain a permanent license for each bicycle. Any person fourteen (14) years of age, or over, owning or operating a bicycle shall himself obtain a permanent license for each bicycle. Such licenses are not transferable. -4- 2. Licenses shall be obtained from the Police Department and provided free of charge. 3. Loss of a license or bicycle with license attached shall be reported immediately to the Police Department. D. Issuance of license: The Chief of Police or someone designated by him shall issue a license to the owner of the bicycle, if the bicycle meets the requirements of this Chapter and the issuance of such license shall be the license to operate the bicycle on the streets of the Village. E. Registration file: The Police Department shall keep on file a.list of registrations for official use. The license application shall include name of owner, address, telephone number, make of bicycle, type, size, color, and manufacture's serial number if any. F. Attachment of license: 1. The person designated to issue licenses shall issue a bicycle license upon presentation of a properly executed application as stated above. The license shall contain the number assigned to the bicycle and the name of the village. 2. The Chief of Police shall cause the license to be firmly attached to the frame tube under the saddle with the license clearly visible. 3. No person shall remove a valid license from a bicycle except upon a transfer of ownership or in the event the bicycle is dismantled or no longer oper rated upon any street in the Village, or when removed by police order. -5- 0 G. Transfer of ownership: Upon the sale or other:- transfer of a licensed bicycle, the licensee shall remove the license. H. Rental agencies: A rental agency shall not rent or offer any bicycle for rent within the Village unless the bicycle is licensed and a license is attached thereto as pro- vided herein, and such bicycle is equipped yaith lamps and other equipment required in this.Chapter. 1. operating bicycle: A person operating a bicycle shall not ride other than upon or Iastride the permanent and regular seat attached thereto. -A seat designed for w, carriage of an infant, properly manufactured _and installed may be used provided they have a- safety belt around said infant while riding the bicycle. J. operating in a group: Persons operating .bicycles upon a roadway shall drive in " single file except on paths or parts of roadway set aside for the exclusive use of bicycles. K. Prudent operation :. No person operating a bicycle shall carry any package, bundle or artidle which prevents the operator from safe - normal operation of the bicycle. Driving or riding a bicycle on a public roadway _or path with no hands on the -handle bars 'is - specifically prohibited. L. Riding on- sidewalks: _.. <. 1. _The Chief of Police is authorized to -erect signs on any sidewalks or roadway prohibiting the operation of bicycles, _thereon by any persons, and when such signs are in place, no person shall `disobey same. -6- 2. Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right -of -way to any pedestrian and - shall give audible signal before over- taking and passing such pedestrian. M. Equipment: 1. Lights: It shall be unlawful to operate a bicycle on any street or sidewalk during the period from one -half (2) - - hour after sunset to sunrise, which bicycle is not equipped with at least one lighted lamp firmly secured to the front mudguard or handle bars of = -the bicycle showing a white light visible at least five hundred feet (500') -in the direction .toward which the - bicycle is proceeding and at least one lighted lamp showing a red light, - reflector or reflectorized tape in the opposite direction. 2. Brakes: Every bicycle shall be equipped -- with a brake adequate to control the movement of and to stop such bicycle --whenever necessary. The brake shall be maintained in good working order at all times. N. General bicycle condition: No bicycle shall be'-operated where its mechanical condition shall impair the safe operation of the bicycle. O. Parent's responsibility: -The parents of any child and the guardian of any ward shall not authorize or knowingly permit any child or ward to violate any of the provisions of this Chapter. Any parent or guardian authorizing or knowingly permitting such violation shall, upon conviction thereof, be guilty of an offense. P. Enforcement: The Buffalo Grove Police Department is specifically designated to enforce all pro - visions of this Chapter. -7- -8- Chapter BG - 11- 301 -. Chapter BG - 11 -506 Exhibition.driving: It shall be - - unlawful for any person to operate any vehicle in such a manner so _ as to bring attention to his operation -of the vehicle, except when using -the horn of the vehicle when reasonably necessary.to insure safe operation of the vehicle as provided in section 12 -601. -8- `3_ Chapter BG = 11 -507 Clinging to Vehicles: It shall be unlawful for any person afoot or riding ski's, skates, a bicycle, motorcycle, sled or any toy vehicle to cling or attach himself or his z, - -- vehicle to any moving motor vehicle or wagon, upon any highway within the Village. Chapter BG - 11 -508 Riding Toy Vehicles: It shall be- unlawful for any person upon skates, a coaster, sled or other toy vehicle, to -go upon any roadway within this Village other than at a crosswalk. Chapter BG - 11 -509 Riding Upon Vehicles: It shall be kalawful for any person to ride upon the fenders, running board or =- `other -part of any vehicle not.designed = for the carrying of persons or goods, or for any person to have any portion =of= =-his body protrude beyond the side or rear edges of any vehicle. Chapter-BG -.11- 510 Drag Racing: It is unlawful to be _ _ ...___.. -a 'participant in drag racing. "Drag Racing" means the act of two (2) or -more individuals competing or racing on any street or highway in the - Village of -- Buffalo Grove in a situation -in- -which one of the individuals is 'beside or to the rear of a motor- _ = vehicle operated by a competing driver =arid the one driver attempts to prevent the- competing driver from passing or overtaking him, either by acceleration or manpower, or one or more individuals = competing in a race against time on any street or highway within the Village =of Buffalo Grove. - - `3_ Chapter BG - 11 -511 Unlawful Noise Emission: No standing or moving vehicle of any kind shall: .4. -.Play amplified music while on the streets of the Village, at 'any time during the day or night.. b. Chapter BG - 11 - 1309 Nothing in this section or section 11 -1303 shall prohibit the stopping, standing or parking of any attended school bus or bus used for a school related activity for the purpose of discharging or loading passenger: for a- period not to exceed thirty (30) minutes. Chapter BG - 11 - 1310 Blank Chapter BG - 11 - 1311 Vehicles-for Sale: It shall be unlawful to park any vehicle upon any street for the purpose of displaying it for sale, or to park any vehicle upon any business street from which vehicle, merchandise is peddled. Chapter BG - 15 Size,: Weight, and Permits: Chapter BG - 15 - 101 Local Street Weight Limits: It shall be unlawful to operate any vehicle on any street in the city when the gross weight on the surface of the road through any axle of such vehicle exceeds sixteen thousand (16,000) pounds. Where lower limits are imposed by ordinance and signs indicating such limitations are posted, it shall be unlawful to operate a vehicle in excess of such weight on such street, except for the purpose of making delivery or picking up a load, in which case such vehicle may be driven on such street for not more than he minimum distance necessary for the purpose. A Chapter BG - 16 Enforcement, Penalty and Disposal of Fine and Forfeiture. Chapter BG = 16 - 101 Applicability: The penalty provisions of this chapter are applicable to the Illinois Vehicle Code, 1975 Edition, as adopted by reference as the Traffic Code of the Villagf and to the Buffalo Grove Supplement thereto Chapter BG - 16 - 102 Arrests - Prosecution. The Buffalo Grove Police shall patrol the public highways and make arrests for the violation of the provisions of this Ordinance. The Village Attorney or his desginated alternate shall prosecute all violations which occur within the corporate limits of Buffalo Grove and .which are written under this Ordinance. Chapter BG - 16 - 103 Citations: Whenever a Police Officer is authorized to arrest a person without a warrant because of a violation of an Ordinance in respect of any of the followin< subjects: a. prohibiting the parking of a vehicle in a designated area, b. restricting the length of time a vehicle may be there parked, C. prohibiting the manner of parking a vehicle, d. requiring the purchase and display of a vehicle sticker, e.. regulating and licensing dogs, f. regulating and licensing businesses. said Police Officer may, in lieu of the filing of a Complaint in Court, in the firsi instance issue to such alleged violator, a CITATION, a. advising said person that he has violated a specified Ordinance. -22- n wry: b. requesting him to make payment in an amount applicable to said alleged violation as set forth in Section 16 -104A of this Ordinance as settlement of said violation claim, and C. informing him that upon failure to so settle, a Complaint will be filed in the Circuit Court of Cook County, charging him with such violation. Pursuant to said CITATION, the person so accused of said violation may settle and compromise the violation claim in respect of such Ordinance violation by paying to the municipality the applicable amount as shown in the schedule set forth in Section '16-104A & B of this Ordinance, within a period to be specified in said CITATION. Such payment shall be made in accordance with the instructions contained in the aforesaid CITATION, at the office of the Village Clerk, who shall issue a receipt for the money so received and promptly remit said amount to the village Treasurer to be credited to the proper municipal fund. In the_ event that the person to whom said CITATION is issued fails to settle and pay said violation claim within the prescribed time, or within a period of time specified in a Final. Notice (if one is served upon him) then the Peace Officer is authorized to cause a- Notice to Appear to be served upon said alleged violator and is authorized to file a Complaint and to prosecute the same in the Circuit Court of Cook County. The fact that an automobile or motor vehicle which is illegally operated or parked is registered with the Secretary of State in the name of said alleged violator; or, in the alternative, in the event that a -23 Vehicle sticker issued by a municipality has been issued in the name of and to said alleged violator, shall be considered prima facie proof that said alleged violator..was in control of or was the operator of the automobile or motor vehicle at the time of such alleged violation. Chapter BG 16 - 104 Penalties: The violation claim described in said CITATION so to be issued pursuant to the terms of this Ordinance, may be settled, compromised and paid in the res- pective amount set forth in the following schedule: A. In the event that said payment is .made prior to the mailing by the munici- pality or by the Peace Officer of a Final Notice, the following amounts v shall be accepted as a settlement: =- Improper Parking $5.00 B. In the event that payment has not been - paid prior to the mailing of such -- - -- Final Notice, and in fact, Final Notice has been mailed, the following amounts = shall be accepted as settlement: -- Improper Parking - $8.00 C. In the -event that payment is not made y= within the time prescribed in the Final Notice, and a Notice to Appear - has been served and a Complaint filed in the Circuit Court of Cook County, payment of any fine and costs shall be in such amounts as may be determined and established by the Circuit Court of Cook County. -24- # . ` r! That all Ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed.
