1974-007ORDINANCE NO. 74 -.7 AN ORDINANCE RELATING TO THE REGISTRATION AND REGULA- TION ON THE USE OF BICYCLES IN THE VILLAGE OF BUFFALO GROVE. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, that Ordinance 68 -12 is hereby amended to read as follows: SECTION: BICYCLES 1: Definitions 2: License Required 3: Licensing of Bicycles 4: Issuance of License 5: Registration File 6: Attachment of License 7: Transfer of Ownership 8:_ Rental Agencies 9: Traffic Laws Apply 10: Obedience to Traffic Control Devices 11: Operating Bicycles 12: Speed 13: Driving on Right 14: Emerging from Alley or Driveway 15: Clinging to Vehicles 16: Operating in Groups 17: Prudent Operation 18: Parking 19: Riding on Sidewalks .20: Lights 21: Signaling Devices 22: Brakes 23: General Bicycle Condition 24: Parent's Responsibility 25: Enforcement 26: Penalties 27: Saving Clause 28: Effective Date 1: . DEFINITIONS: As used herein, the following words shall have the meanings set opposite them: BICYCLE: Every device propelled by human power upon which any person may ride, having two tandem wheels either of which is more than 16 inches in diameter. DRIVER: When an individual is using a bicycle on the roadway, he is identified as the driver of the bicycle. RIDER: When an individual is using a bicycle on the side- walk or path used for the exclusive use of bicycles, he is identified as the rider. OPERATOR: When a regulation is intended to apply to the user of a bicycle on either the roadway or sidewalk or path, he is referred to as the operator. 2: LICENSE REQUIRED: No person who resides within the Village shall ride or propel a bicycle on any street or upon any public path for the use of bicycles, unless such bicycle has been licensed and a license is attached thereto as provided herein. 3: LICENSING OF BICYCLES: (A) The parent or guardian of any child below the age of fourteen (14) owning or operating a bicycle shall obtain a permanent license for each bicycle. Any person fourteen (14) years of age, or over, owning or operating a bicycle shall himself obtain a perma- nent license for each bicycle. Such licenses are not transferable. (B) Licenses shall be obtained from the Police Department. Licenses shall be provided free of charge. (C) Loss of a license or bicycle with license attached shall be reported immediately to the Police Department. 4: ISSUANCE OF LICENSE: The Chief of Police or someone desig- nated by him shall issue a license to the owner of the bicycle, if the bicycle meets the requirements of this Chapter and the issuance of'-such license shall be the license to operate the bicycle on the streets of the Village. 5: REGISTRATION FILE: The Police Department shall keep on file a list of registrations for official use. The license application shall include name of owner, address, telephone number, make of bicycle, type, size, color, and manufacture's serial number, if any. 6: ATTACHMENT OF LICENSE: (A) The person designated to issue licenses shall issue a bicycle license upon presentation of a properly executed application as stated above. The license shall contain the number assigned to the bicycle and the name of the Village. - 2 - (B) The Chief of Police shall cause the license to be firmly attached to the frame tube under the saddle with the license clearly visible. (C) No person shall remove a valid license from a bicycle except upon a transfer of ownership or in the event the bicycle is dismantled or no longer operated upon any street in the Village, or when removed by police order. 7: TRANSFER OF OWNERSHIP: Upon the sale or other transfer of a licensed bicycle, the licensee shall remove the license. 8: RENTAL AGENCIES: A rental agency shall not rent or offer any bicycle for rent within the Village unless the bicycle is licensed and a license is attached thereto as provided herein, and such bicycle is equipped with lamps and other equipment required in this Chapter. 9: TRAFFIC LAWS APPLY: Every person driving or riding a bicycle upon a roadway or public path shall be subject to the provisions of the traffic laws of the State of Illinois and the Village of Buffalo Grove applicable to the operator of a vehicle, and except as to special regulations in this Chapter and except to those provisions of the traffic laws which by their nature can have no application. 10: OBEDIENCE TO TRAFFIC CONTROL DEVICES: (A) Any person driving or riding a bicycle shall obey the instructions of official traffic signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. (B) Whenever authorL that no right or person driving a of any such sign from the bicycle the person shall pedestrians. zed signs are erected indicating left or "U" turn is permitted, no bicycle shall disobey the direction except where such person dismounts to make such turn, in which event obey the regulations applicable to 11: OPERATING BICYCLES: A person operating a bicycle shall not ride other than upon or astride the permanent and regular seat attached thereto. A seat designed for carriage of an infant, properly manufactured and installed may be used provided they have a safety belt around said'infant while riding the bicycle. -3- qW ` •t ,4 't . 12: SPEED: No person shall operate a bicycle at a speed greater than is reasonable and prudent under the conditions then existing. 13: DRIVING ON RIGHT: Every person driving a bicycle upon a roadway shall ride as near to the right hand side of the road- way as practicable, exercising due care when passing a standing vehicle or one proceeding in the same direction. 14: EMERGING FROM ALLEY OR DRIVEWAY: The operator of a bicycle emerging from an alley, driveway, or building shall, upon approaching a sidewalk or the sidewalk area extending across, any alleyway, yield the right -of -way to all pedestrians approaching on said sidewalk or sidewalk area, and upon entering the roadway shall yield the right -of -way to all vehicles approaching on the roadway close enough to constitute a hazard. 15: CLINGING TO VEHICLES: No person operating a bicycle shall attach the same or himself to any vehicle upon a public roadway or public path. 16: OPERATING IN A GROUP: Persons operating bicycles upon a roadway shall drive in single file except on paths or parts or roadway set aside for the exclusive use of bicycles. 17: PRUDENT OPERATION: No person operating a bicycle shall carry any package, bundle or article which prevents the operator from safe normal operation of the bicycle. Driving or riding a bicycle on a public roadway or path with no hands on the handle bars is specifically prohibited. 18: PARKING: No person shall park a bicycle so it will inter- fere with normal flow of pedestrian traffic, vehicular parking or vehicular flow of traffic. 19: RIDING ON SIDEWALKS: (A) The Chief of Police is authorized to erect signs on any sidewalks or roadway prohibiting the operation_ of bicycles thereon by any persons, and when such signs are in place, no person shall disobey same. (B) Whenever any person is riding a bicycle upon a side- walk, such person shall yield the right -of -way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.. Im"M 20: LIGHTS: It shall be unlawful to operate a bicycle on any street or sidewalk during the period from one -half (1/2) hour after sunset to sunrise, which bicycle is not equipped with at least one lighted lamp firmly secured to the front mudguard or handle bars of the bicycle showing a white light visible at lease five hundred feet (500') in the direction toward which the bicycle is proceeding and at least one lighted lamp showing a red light reflector or reflectorized tape in the opposite direction. 21: BRAKES: Every bicycle shall be equipped with a brake adequate to control the movement of and to stop such bicycle whenever necessary. The brake shall be maintained in good working order at all times. 22: GENERAL BICYCLE CONDITION: No bicycle shall be operated where its mechanical condition shall impair the safe operation of the bicycle. 23: PARENT'S RESPONSIBILITY: The parents of any child and the guardian of any ward shall not authorize or knowingly permit any child or ward to violate any of the provisions of this Chapter. Any parent or guardian authorizing or knowingly per- mitting such violation shall, upon conviction thereof, be guilty of an offense. 24: ENFORCEMENT: The Buffalo Grove Police Department is specifically designated to enforce all provisions of this Chapter. 25: PENALTIES: Every person charged with and convicted of a violation of this bicycle ordinance or any part thereof shall be subject to a fine of not less than Five Dollars ($5.00) nor not more than Five Hundred Dollars ($500.00) and the suspension of the registration of such bicycle and the confiscation of such license previously issued for a period not to exceed thirty (30) days. 26: SAVING CLAUSE: If any clause, sentence or part of this Chapter shall be adjudged invalid by any court, it shall not effect the remainder of this Chapter. -5- 2.7. EFFECTIVE DATE: This ordinance shall be in full force and effect from and after its passage, approval, recording and publication, as provided by law.
