1972-006K ORDINANCE NO. Q BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove, Illinois, Counties of Cook and Lake. SECTION 1. The President and Clerk are hereby author- ized to execute a certain agreement dated %4 1970 by and between the Village of Buffalo Grove, Illinois and the State of Illinois for the improvement of Dundee Road all as described in Exhibit "A" attach- ed hereto and made a part hereof. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval according to law. ATTEST: Clerk PUBLISHED f AGREEMENT' This agreement, entered into this "_ day of A.D. 19i�, by and between the STATE OF ILLINOIS, acting -by and through its DEPARTMENT OF PUBLIC WORKS AND BUILDINGS, hereinafter called the'STATE, and the Village of Buffalo Grove, of the State r of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety to the motoring public, is desirous of improving.approximately 16,622 lineal feet of Dundee Road, (FAS. Route 115, Illinois Route 68, State Section,3041- 15D -Z -R, Village, Section 3cs) from Illinois Route 53 to Elmhurst Road, by widening the roadbed from its present typical pavement width of 20 feet, to a width of 64 feet and variable edge to edge of pavement (providing for 4 twelve -foot traffic lanes, a 16 foot wide median and combina- tion concrete curb and gutter), channelizing the intersection of Arlington Heights and Buffalo Grove Roads with Dundee Road, constructing storm sewers and appurtenances for highway drainage, installing traffic control signals at the intersections of Arlington Heights and"Buffalo Grove Roads and Dundee Road, and by performing all other work necessary to complete the improvement in accordance with the approved plans arxd specifications; and, WHEREAS, the VILLAGE is desirous of said improvement in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, THEREFORE, in consideration of the mutual covenants con - tained herein, the parties hereto agree as follows 1. The STATE agrees to make the surveys, obtain all necessary.. rights -of -way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with.the plans, specifications and contract. 2. The STATE agrees to pay all rights -of -way, construction and engineering costs, subject,to reimbursement'by the VILLAGE as hereinafter stipulated. 3 . 3. Upon completion of the improvement and so long as the route is used as a State Highway, the STATE agrees to maintain or cause to be maintained the median, the 4 through traffic lanes lying 2 on either side of the median, and the left -turn and right -turn lanes, each lane being 12 feet and variable in width,,and the curb and gutter adjacent to those traff ic.lanes to be main - tained by the STATE. 4. The STATE represents that the estimated cost'of the improvement is as follows: ROAD ;MY Construction Costs ------------ -- - - -- $5,000,000. Preliminary and Construction Engineering Cost (15 %) ------- - - - - -- 750,000. Rights -of -way Costs --------- - - - - -- - 250,000. TOTAL ------ - - - - -- $6,000,000. TEAFFIC SIGNALS Construction Costs ------------- - - - - -- $100,000. Preliminary and Construction Engineering Cost (15 %) ---- - - - - -- 15,000. TOTAL ------- - - - - -- $115,000. 5. The VILLAGE agrees.to reimburse the STATE for 50% of all engineering, and construction costs for installing traffic signals at Buffalo Grove Road, provided, however, the maximum cost to the VILLAGE shall not exceed 523,600.0 �: Further provided, that the STATE shall furnish the VILLAGE with evidence of cost of and payment for such costs. 6. The VILLAGE has passed a resolution appropriating sufficient Motor Fuel Tax Funds to pay its share of the cost of this improvement, a copy of which is attached hereto as "Exhibit A." 7. The VILLAGE has.adopted and will put into effect, prior to the STATE'S advertising for the work to be performed 'here under, an ordinance requiring that parking be prohibited within the VILLAGE limits, a copy of which is attached hereto as "Exhibit B," and will in the future prohibit parking at such locations on or immediately adjacent to this improvement as may be determined to,be necessary by the STATE from traffic capacity studies. 8. The VILLAGE has.adopted and will put into effect, prior to the STATE'S advertising for the work to be performed here- under, an appropriate ordinance prohibiting the discharge of.storm, sanitary and industrial waste water into any storm sewers constructed as a part of this improvement, a copy of which is'attached hereto as "Exhibit C." 9. The VILLAGE agrees to adopt, prior to the STATE'S advertising for the work to be performed hereunder, a resolution approving the plans and specifications as prepared. 10. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb, as constructed, without the consent of the STATE. 11. The STATE shall cause private utilities to be relocated at no expense to the VILLAGE. 12. Upon completion of the improvement, the VILLAGE agrees to maintain or cause to be maintained sidewalks and municipally owned utilities and appurtenances. The VILLAGE will furnish the energy for the operation of all traffic signals at Buffalo Grove Road and the lighting within the VILLAGE. The STATE retains the right to control the sequence and timing of the traffic signals. 13. Prior to the STATE advertising for work to be performed hereunder, the disposition of encroachments will be cooperatively determined with representatives from the VILLAGE, the STATE, and the United States Bureau of Public Roads. The VILLAGE has adopted and will put into effect, prior to the STLTE"S advertising for the work to be perfor -med hereunder, an appropriate ordinance relative to the disposition of encroachments and prohibiting, in the future, any new encroachments within the limits of the improvement, a copy of which is attached as "Exhibit D." 14. This Agreement and the covenants contained therein shall be null and void in the event of the happening or failure of one or more of the following: (a) The awarding of the contract covering the construction work contemplated herein on or before January 1, 1973. [ �' AN ORDINANCE RESTRICTING SANITARY SEWER AND STORM WATER CONNECTIONS ON ROUTE 6$ (DUNDEE ROAD) BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois. WHEREAS, the Village of Buffalo Grove and the State of Illinois, acting by and through its Department of Public Works and Buildings, Division of Highways, have entered into an agreement relative to the improvement of FAS Route 115 (Dundee Road) State Section 3041 -15 D °Z -R, Village Section 3cs, and WHEREAS, in order to facilitate said improvement it is necessary for the Village to adopt an ordinance regulating sanitary sewer connections, discharge of sanitary and industrial waste into storm sewers, and discharge of any storm water into sanitary sewers, constructed as a part of this improvement. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Buffalo Grove, Cook and Lake Counties, Illinois: Section 1. Without the prior consent of the State and.the Village, it shall be unlawful for any person, firm or corporation to (a) Cause the discharge of sanitary or industrial waste water into any storm sewer; .(b) Make any additional storm sewer connections to storm sewers; not exclusively, ground water from foundation drains into the sanitary sewer. Section 2. Any person, firm or corporation violating any of the provisions of this ordinance shall be fined not less than $10.00 nor more than $500.00 for each offense and a separate offense.shall be deemed committed for each and every day during which a violation continues to exist. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed insofar as they conflict herewith. Section 4. This ordinance shall be in full force and effect from and after its passage, approval and publication pursuant to law. AN ORDINANCE REGULATING ENCROACHMENT ON PUBLIC RIGHT OF WAY IN THE VILLAGE OF BUFFALO'GROVE, COUNTIES OF COOK AND LAKE, ILLINOIS. WHEREAS, the Village of Buffalo Grove hereinafter known as the VILLAGE, and the State of Illinois, acting by and through its Department of Public Works and Buildings, Division of Highways, have entered into an agreement relative to the improvement of Dundee Road (Illinois Route 68, PAS Route 115, State Section 3041- 15D -Z -R, Village Section acs) from Illinois Route 53 to Elmhurst Road; and, WHEREAS, in order to facilitate said improvement, it is necessary for the VILLAGE to adopt an ordinance regulating encroachments on the right -of -way for said improvement in accordance with the following definition: ROADWAY RIGHT OF WAY is defined as those areas existing or acquired by dedication or by fee simple for highway purposes; also, the areas acquired by temporary easement during the time the easement is in effect; PROJECT RIGHT OF WAY is defined as those areas within the project right -of -way lines established jointly by the VILLAGE, STATE, and the United States Bureau of Public Roads which will be free of encroachments except as hereinafter defined; ENCROACHMENT is defined as any building, fence, sign, or any other structure or object of any kind (with the exception of utilities and public road signs), which is 4 placed, located or maintained in, on, under or over any portion of the project right-of-way or the roadway right - of -way where no project right -of -way line has been established PERMISSIBLE ENCROACHMENT is defined as an existing awning, marquee, advertising signor similar overhanging structure supported from a building immediately adjacent to the limits of the platted street where there is a sidewalk extending to the building line and which does not impair the free and safe flow of traffic on the highway; the permissive retention of overhanging signs is not to be construed as being applicable to those signs supported from poles constructed outside the project right -of -way line and not confined by adjacent buildings; . and, - 2 - r ^ CONSTRUCTION EASEMENT AREA is defined as that area lying between the project right of way limits'and the platted street limits within which the VILLAGE, by concurrence in the establishment of the project right of way lines, will permit the STATE to enter to perform all necessary construction operations; WHEREAS, representatives of the VILLAGE, the STATE, and the United States Bureau of Public Roads have, by visual inspection, cooperatively established project right -of -way lines and have mutually determined the disposition of the encroachments: NOW THEREFORE, BE IT ORDAINED, by the Village of Buffalo Grove, Cook and Lake County, Illinois: SECTION 1: It shall be unlawful for any person, firm, or corporation to erect or cause to be erected, to retain or cause to be retained, an ENCROACHMENT (herein above defined), except as provided in Section 3, within the limits of the project right -of -way or roadway right -of -way where no project right -of -way lines have been established. SECTION 2: Project right -of -way lines have been established at the following locations: NO ENCROACHMENTS SECTION 3: Revocable permits have been issued by the Village of Buffalo Grove for the temporary retention of the following PERMISSIBLE ENCROACHMENTS (Herein above defined): NO ENCROACHMENTS SECTION 4: This ordinance,is intended to and shall be in addition to all other ordinances, rules and regulations concerning encroachments and shall not be construed as repealing or recinding any other ordinances or parts of any ordinances unless in direct conflict therewith. i f - 3 - J SECTION 5: Any person, firm or corporation violating this ordinance shall be fined not less than TEN DOLLARS ($10.00) nor more than FIVE HUNDRED DOLLARS ($500.00) for each offense, and a separate offense shall be deemed committed for each and every day during which a violation continues or exists. PUBLISHED: 0 J� s RESOLUTION #0 -72 -9 WHEREAS, the Village, of Buffalo Grove an agreement with the State of Illinois for Dundee Road (FAS Route 115, Illinois Route 3041- 15D -X -R; Village Section 3cs. has entered into the improvement of 68) known as Section WHEREAS, in compliance with the aforementioned agreement, it is necessary for the VILLAGE to appropriate Motor Fuel Tax Funds to pay its share of the cost of said,improvement, NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of Thirteen Thousand Dollars ($13,000.00), or so much thereof as may be necessary, from any money now or hereafter allotted to the VILLAGE under the provisions of the Motor Fuel Tax Law, to pay its share of the cost of this improvement as provided in the agreement; and, BE IT FURTHER RESOLVED, that upon completion of the improvement, the VILLAGE will pay to the Department of Public Works and Buildings of the State of Illinois in a lump sum from any of said money allotted to the VILLAGE under the Motor Fuel Tax Law an amount equal to its obligation incurred under this agreement.
