ILLINOIS. SECTION 1. Section 6 of Ordinance 71-4 is hereby amended to read as J---ollows: SECTION 6. (a) The Zoning Board of appeals may vary and make e.-.ceptions to this ordinance where there is sufficient evidence that the presence or absence of a pa--ticular type of fence will be detrimental to the public health, safety or wel- fare. 1-p-olication for such variations shall first be submitted in T.%Tritin- 0 to the Zoning Board of Appeals. A, service charge of $25.00 shall be paid with each application. (b) The Zoning Board of Appeals shall Z�� hold a oublic hearing on such application upon publication of notice in a newspaper of general circulation. Such notice to be published not less than 15 days nor more than 30 days prior to the hearing. In addition to said publication, a written notice shall be given to each contiguous property owner within the same time limitation. The applicant shall furnish the Board x-iith necessary names and addresses. (c) The ruling of the Board of Appeals shall be final; provided however, in the event the same is ad- verse to the applicant, he may appeal to the President and Board of Trustees. Said appeal shall be in writing and filed 0 with the Village Clerk within 15 days from the applicant's receipt of notice of the ruling. The Board of Appeals shall send a copy of its findings and ruling to the Village Clerk within 10 days after the ruling is made. The President and Board of Trustees shall then place the matter on the agenda at any regular meeting held within 60 days after receipt of notice of appeal. The :Board may hear evidence or decide the matter on the findings of the Board of Appeals. The President and Board of Trustees may affirm ruling of the Board of Appeals, in whole or in part, - or may reverse same and grant the relief as preyed in the ap- plication. Any contiguous property owner may also appeal from the ruling of the Zoning Board of Appeals. The steps to be taken shall be the se-me as those set forth herein with respect to where an appeal is made by the applicant. SECTION 2. The penalty provisions of Ordinance 71-4 shall be applicable to this amendment. SECTI02,11 3.
