REF: Legalized Bingo within the Village
Quite separate and apart from the question whether
the Fire Department may lawfully sponsor bingo games on
village property, I believe we ought to amend our current
(Gambling Ordinance 0- 65 -22) so as expressly to exempt from
its proscriptions bingo games which are sanctioned under the
new state law. This could take the form of a rather simple
and brief amendment to our Gambling Ordinance to the effect
that nothing in said Ordinance will be deemed to prohibit
bingo games operated in accordance with state law.
Strictly speaking, I doubt such an amendment is
necessary, since I believe the new State Statute has the
partial effect of legalizing bingo carried out under its
terms, any conflicting municipal ordinances notwithstanding.
Nonetheless, I discern no reason why we should not obviate
any such possible problem, and therefore, I recommend we
direct Mr. Raysa to prepare an amendment to the Gambling
Ordinance to exclude properly state licensed bingo games.
Respectfully,
Tom Mahoney
