Gentlemen:
Subject: Revision of the Manual of Procedures Relative to the
Promulgation of Local Ordinances Prior to the
Issuance of Sewer Permits. (MSD -LSS 71 -01)
At its meeting of March 25, 1971, and in response to recommendations by
the Blue Ribbon Committee, the Board of Trustees of the Metropolitan
Sanitary District amended Articles 4 -1, 6 -2d and 6 -3b of the Manual of
Procedures for the Administration of the Sewer Permit Ordinance, relative
to the promulgation of local ordinances covering overhead plumbing and the
manner of discharge of footing drains prior to the issuance of sewer permits.
A separate sheet containing the revised language of "r*icles 4 -1, 6 -2d and
6 -3b is attached herewith.
Your attention is invited to the last phrase of the revised articles which reads,
"... or that the permittee and /or co- permittee shall agree to comply with the
requirements of this Article. " Prior to this revision, no permits were to be
issued "after December 31, 1970 to any municipality or local government
unless said municipality or local government shall have adopted an ordinance ",
reflecting the requirements of the articles in question, and "a copy of said
ordinance shall have been filed with the Metropolitan Sanitary District ". The
intent of the Board in making the revision is to facilitate the issuance of
permits and make such issuance possible prior to the adoption of the required
ordinances by the local governments.
The method of implementing the revision was discussed and approved by the
Blue Ribbon Committee at its meeting of April 7, 1971 and the method of
implementation is now operative. If the local government has not yet adopted
the required ordinance, permits may be issued provided one of the following
documentations is furnished:

a. A sworn affidavit by the co- permittee, or
b. A certification by the permittee and co- permittee.
The gist of the affidavit or the certification is that the project itself will be
in compliance with the applicable requirements of the Manual and that any
future buildings to be served by the sewer will also be in compliance with
these requirements. If you have a permit application now pending, it is
requested that you contact the Local Sewer Systems (Telephone No. 751 -5789)
directly.
Although under the revised procedures, permits may be issued prior to the
adoption of local ordinances, it is our sincere belief that the interests of the
public are better served by the promulgation of local ordinances and it is
therefore our sincere hope that in the interest of the public, local ordinances
be adopted relative to the mandatory requirement of overhead plumbing and
the manner of discharge of footing drains as outlined in Articles 4 -1, 6 -2d
and 6 -3b of the Manual of Procedures.

Manual of Procedures - Revised Language
Adopted by the Board of Trustees of the Metropolitan Sanitary District
on March 25, 1971
Article 4 -1 Overhead Plumbing For all sewer permits issued after Decem-
ber 31, 1970, new buildings with basements, floors, rooms or occupancy areas
below ground level at the building site and served by a public or private sewer
system, shall have overhead plumbing. No permit application will be accepted,
nor any permits issued after December 31, 1970, to any municipality or local
government unless said municipality or local government shall have adopted an
ordinance requiring overhead plumbing, and a copy of said ordinance shall have
been filed with the Metropolitan Sanitary District, or that the permittee and /or
co- permittee shall agree to comply with the requirements of this Article.
Article 6 -2 Combined Sewer Areas
d. Footing Drains No footing drains or drainage tile shall be connected
to the sanitary sewer. For sewer permits issued after December 31, 1970,
footing drains shall be connected to sump pumps, and discharge shall be made
into storm sewers, combined sewers or drainage ditches. After December 31,
1970, all new construction shall conform to the requirements of this paragraph.
No permit application will be accepted, nor any permits issued after December 31,
1970 to any municipality or local government unless said municipality or local
government shall have adopted an ordinance reflecting the requirements of this
paragraph and a copy of said ordinance shall have been filed with the Metropolitan
Sanitary District, or that the permittee and /or co- permittee shall agree to
comply with the requirements of this Article.
Article 6 -3 Separate Sewer Areas
b. _Footing Drains No footing drains or drainage tile shall be connected
to the sanitary sewer. For sewer permits issued after December 31, 1970,
footing drains shall be connected to sump pumps, and discharge shall be made
into storm sewers or drainage ditches. After December 31, 1970, all new
construction shall conform to the requirements of this paragraph. No permit

to any municipality or local government unless said municipality or local

tive To Plumbing) -
WHEREAS, the Wheeling Plan
Commission, pursuant to the direc-
tion of the Corporate Authorities,
held public hearings, after due no-
tice by publication, in accordance
with the .applicable provisions of the
Illinois Municipal Code and the
Wheeling Municipal Code to consid-
