AN ORDINANCE CONCERNING ANIMALS AND FOWL
BE IT ORDAINED BY THE PPESIDENT AND BOARD OF TRUSTEES OF THE
VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS.
ARTICLE I — General Provisions
SECTION 1. Cruelty. No person shall cruelly treat any
animal in the Village in any way. Any person who inhumanely
beats, underfeeds, overloads., or abandons any animal shall be
deemed guilty of a violation of this Section.
SECTION 2. Dangerous animals. It shall be unlawful to
permit any dangerous, vicious or unruly animal of any kind to
run at large within the Village.
SECTION 3. Noise-Offensive Odors. It shall be unlawful
to harbor or keep any animal or fowl which may in any manner
continuously give off offensive odors or continuously disturb the
quiet of any person or neighborhood, or which
in any manner injure any animal, plant, shrub

SECTION 4. Keeping Animals. Except in those areas zoned as
farms, it shall be unlawful to keep any animal or fowl (except
domesticated cats, dogs or caged birds) in the Village or to allow
or permit such animal or fowl at large in the Village.

SECTION 5. Killing dangerous animals. Any member of the
police department is hereby authorized to---kill any dangerous
animal or fowl of any kind when it is necessary for the protection
of any person or property.
SECTION 6. Dead animal or fowl. No person shall place or
deposit or cause to be placed or deposited at any place in the
Village the remains of any dead animal or fowl.
SECTION 7. Diseased animals. No animal afflicted with a
contagious disease or zoonotic disease shall be allowed to run at
large, or to be exposed in any public area whereby the health of
any person or other animal may be affected; nor shall such
diseased animal be shipped or removed from thepremises of the
owner or keeper thereof, except under supervision of the Village
Health Officer.
It is hereby made the duty of the Village Health Officer and
the Chief of Police to secure such disposition of any diseased
animal and such treatment of affected premises as to prevent the
communication and spread of contagion or infection.
SECTION 8. Housing. No person shall cause or allow any
place where any animal or fowl is or may be kept to become unclean
or unwholesome.
ARTICLE II - Dogs
SECTION 1. Register and License Required. Any person who
keeps, harbors or otherwise maintains a dog in the Village more

than four months of age shall register and procure a dog license
for the same. Any dog over four months of age purchased or otherwise
acquired shall also be registered and licensed as provided herein
not later than fifteen days after the same becomes four months
of age.
SECTION'2. Application for License. The application for
registration and license shall be made to the Village Clerk and shall
state the name, address and telephone number of the owner, the
breed, color, sex, name and date of inoculation against rabies of
the dog to be registered. The Village Clerk shall cause this
information to be entered in a dog register book at the time of
registration.
SECTION 3. License Tag Upon payment of the license fee
required herein and upon presentation of certificate of licensed
veterinarian that the dog to be registered and licensed has been
inoculated against rabies the Village Clerk shall issue a license
certificate and metal license tag for each dog registered.
Each tag shall have stamped thereon a number corresponding
with the number of the license certificate. In case a license
tag is lost or destroyed, a duplicate will be issued by the
Village Clerk upon payment of $1.00.
SECTION 4. License Fee. The license shall be three dollars
for each dog, for each year or fraction thereof as herein provided.
Licenses shall expire one year from date of issuance of last rabies
shot.

SECTION 5. Inoculation Against Rabies.
(a) It shall be the duty of every owner or any person
who keeps, harbors or otherwise maintains a dog more than four
months of age in the Village to have the same inoculated against
rabies by a licenses veterinarian during each twelve month period
preceding the da%e such dog is required to be registered. The
type and brand of the anti -rabie vaccine used and the method of
inoculation shall be approved by the Department of Agriculture of
the State and the United States Department of Agriculture. Any
dog which is not inoculated against rabies as required herein is
hereby declared to be a public nuisance and such dog may be
apprehended and impounded upon the order of the Chief of Police
or Public Health Officer.
(b) It shall be the duty of the owner of any cat kept
in the Village or of any person who harbors a cat on premises
owned or occupied by him in the Village to have the cat inoculated
against rabies at lease once each year. Every such owner of a
cat or person harboring a cat shall display evidence of inoculation
of the cat upon demand made by any duly authorized officer of
the Village.
SECTION 6.
Collar and Tag. Every owner shall provide
each dog, more than four months of age kept, harbored or otherwise
maintained by him in the Village, with a sturdy collar to which
the aforesaid license tag shall be securely fastened and it shall

be the owner's or keeper's duty to make certain that the collar
and tag are worn at all times by the dog when off the owner's
or keeper's premises.
SECTION 7. Unauthorized removal of Tag. It shall be
unlawful for any person other than a police officer, or other
person charged with the enforcement of this Article to remove a
license tag from any dog without the owner's or his agent's consent.
SECTION 8. Running at Large. It shall be unlawful to
permit any dog to run at large within the Village limits. Any dog
found upon any public street, sidewalk, alley, parkway, or any
enclosed place shall be deemed running at large unless such dog
is firmly held on a leash or is in an enclosed vehicle.
Dogs shall be prohibited from any church, school, public
hall or building, office, store or market, restaurant or other
place where food is served during the time said place is open for
business. If any dog shall be found upon the private premises
of any other person than the owner or keeper of such dog, the
owner or keeper of such dog shall be deemed guilty of a violation
of this section. The provisions of this section shall not apply
to dogs leading blind persons, or to dogs exhibited at dog or
pet shows, or dog training schools.
SECTION 9. Nuisances. Any dog which runs at large is
hereby declared to be a public nuisance and such dog shall be

apprehended and impounded if found running at large by any police
officer, animal warden or other person charged with the enforcement
of this Article.
SECTION 10. Dangerous Dogs. Any dog of fierce,chngerous
or vicious propensities shall be confined by the owner on the
owner's premises at all times in such a manner that it cannot reach
persons who may have occasion to lawfully enter upon said premises.
SECTION 11. Dog bites. It shall be the duty of the owner
of any dog to prevent such dog from biting or attacking any person
in the Village, and if a person is bitten by a dog, the owner
or keeper and the person bitten shall report the incident to
the police department immediately.
Any dog which unprovokedly bites or attacks any person
in the Village is hereby declared to be a public nuisance and
such dog may be apprehended and impounded by a police officer
or other person charged with the enforcement of this Article.
If an owner or keeper has notice that his dog has bitten
any person, it shall be unlawful for such owner or keeper to kill
such dog, or sell or give such dog away, or to permit or allow
such dog to be taken beyond the limits of the Village except
to a licensed veterinarian or veterinary hospital. It shall be the
duty of such owner or keeper to immediately report the incident
to the police department and to immediately place such dog in a

licensed veterinary hospital where such dog shall be quarantined
for a period of at least ten days, or upon the request of any
police officer, or other person charged with the enforcement of
this Article, to deliver such dog to them for such placement.
The owner or keeper shall immediately furnish the police department
with the name and location of said hospital and a certificate of
a licensed veterinarian stating whether or not such dog shows
symptoms of rabies. At the expiration of the quarantine period,
and prior to the release of such dog, the owner ok keeper shall
furnish the police department with another certificate of a
licensed veterinarian stating that such dog does not have rabies.
All costs of maintaining such dog in a veterinary hospital shall
be the obligation and responsibility of the owner or keeper and
shall be paid by said owner or keeper.
In all cases where any dog has bitten a person and is slain
or dies within ten days from the time of the bite, it shall be
the duty of the person slaying such dog and the owner or keeper
of such dog to notify the police department and to immediately
deliver the head of such dog intact to said department, or cause
the same to be done.
SECTION 12. Sanitation. It shall be unlawful for the owner
or person in control of any dog to permit such animal to urinate
or deposit dung on any public street, alley, parkway or other
public place or on any premises other than those of the owner or

person in control of such dog.
SECTION 13. Rabies. Any dog suffering from rabies is
hereby declared to be a public nuisance and such dog may be
slain by any police officer, or such other person charged with
the enforcement of this Article, if the same cannot be safely
apprehended, and impounded. It shall be the duty of any owner or
person keeping, harboring or otherwise maintaining any such dog
to place it immediately in a veterinary hospital, or upon demand,
to surrender such dog to any police officer or other person charged
with the enforcement of this Article.
It shall be the duty of every person who discovers that
any dog is suffering with rabies or that any dog or other animal
has been bitten by a dog or other animal suffering with rabies
to report such fact immediately to the police or any other person
charged with the enforcement of this Article. Such report shall
give the name, if known, and the place of residence of the person
keeping, harboring, or otherwise maintaining any such dog or other
animal, the place where the same can be found, and the license
number of any dog, if known. Any such dog or other animal shall be
immediately confined in a veterinary hospital, or taken up and
impounded and securely kept until it can be determined whether
any such dog or animal is suffering with rabies.
SECTION 14. Muzzles. Whenever the Village President, by
proclamation, shall declare that danger from rabies is great,
it shall be unlawful to permit or allow any dog upon any public
street,, alley, sidewalk, parkway or other public place, unless such
dog is leashed and securely muzzled.
SECTION 15. Impounding dogs. The person in charge, upon
receiving any impounded dog, shall make a complete registry entering
the breed, color and sex of such dog, and whether licensed. If
licensed., he shall enter the name, address and telephone number
of the owner and the number of the license tag. Licensed dogs shall
be separated from unlicensed dogs. Not later than twenty-four
hours after the impounding of any dog, the owner shall be notified
by mail sent to his address listed on the dog register book, or if
the owner of the dog is unknown, notice shall be posted at the
Village pound and at the Village hall describing the dog and
the time and place of taking.
SECTION 16. Redemption from pound. The owner of any licensed
dog so impounded, or the person claiming to be the owner of any
unlicensed dog, may redeem such dog in accordance with the provisions
of this Article upon payment of the license fee, if unpaid, and an
impounding charge of $3.50 for each day or fraction thereof, that
such dog is impounded, All fees and charges shall be paid to
the Village Clerk and upon presentation of a proper -receipt from
said Village Clerk, the person in charge of the Village pound
shall release such dog in accordance with the provisions of this
Article. Any dog which has been apprehended by any police officer
or any person charged with the enforcement of this Article shall

be deemed to have been impou:iided i:'E, in" the opinion of such police
officer or person charged with the enforcement of this Article,
confinement in a temporary place of safe keeping is necessary.
SECTION 17. Disposition of unclaimed dogs. It shall be the
duty of the person in charge of the Village pound to keep all dogs
impounded in accordance with the provisions of this Article. If
any impounded dog is not redeemed at the expiration of the sixth
day afta:--the day notice was mailed or posted or provided herein,
such dog may be destroyed or otherwise disposed of, without further
notice. Any person may redeem such dog in accordance with the
provisions of this Article after the time for redemption by the
has has passed.
SECTION 18. Unlawful treatment of dogs. It shallbe unlawful
for any person to maliciously shoot, poison, kill, injure, abuse or
ill-treat any dog. Any person who kills or injures a dog while
driving a vehicle shall stop at the scene of the accident and render
such assistance as practicable and shall immediately report the
incident to the police department.
SECTION 19. Exceptions. The provisions ofthis Article
relating to licenses shall not apply to dogs receiving treatment or
temporary care in veterinary hospitals, boarding kennels or pet
shops within the Village.
SECTION 20. Enforcement. The Village Health Officer,
Chief of Police and such other persons as may be designated by
them are hereby authorized and directed to enforce this Article.

SECTION 21. Village to provide pound. The President and
Board of Trustees may contract to provide a suitable place for the
impounding of dogs.
SECTION 22. Penalty. Any person convicted of any violation
of the provisions of this Ordinance shall be fined not less than
fifteen dollars nor more than five hundred dollars for each offense
and each day that such violation continues shall be considered a
separate offense.
SECTION 23. Conflict. The provisions of any Ordinance in
conflict herewith is hereby repealed. In the event any provision
of this Ordinance is declared invalid, the same sI-n ll not
invalidate the remaining provisions hereof.
SECTION 24. This Ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
