AN ORDINANCE APPROVING A PLANNED DEVELOPMENT
WHEREAS, pursuant to notice published as required by
law, the Plan Commission of the Village of Buffalo Grove,
Illinois, conducted a public hearing on February 25, 1970, to
consider the application of Richard J. Brown, Inc., a corporation,.;_
for approval of a planned development on the following described
property, which property is owned and is to be developedcby the
said corporation:
Lots 1, 2 and 3 in Cambridge Countryside, Unit
8, being a subdivision in the North half (1/2)
of Section 9, Township 42 North, Range 11, East
of the Third Principal Meridian, in Cook County,
Illinois,
which property is hereinafter described as the "subject property";
and thereafter the Plan Commission recommended approval of the
planned development as contained in such application; and
WHEREAS, pursuant to Ordinance No. 0- 65 -19, passed and
approved by the President and Board of Trustees of the Village of
Buffalo Grove on October 7, 1965, and pursuant to Ordinance No.
68 -42, passed and approved by the President and Board of Trustees
of the Village of Buffalo Grove on October 14, 1968, the subject
property was zoned in the R -9 District in accordance�with the
provisions of the Zoning Ordinance of the Village of Buffalo Grove;
and
WHEREAS, the President and Board of Trustees of the
Village of Buffalo Grove have considered said planned development
and the recommendations of the Plan Commission, and have determined

that the approval of the said planned development for multiple-
family condominium purposes is in the best interests of they

Village of Buffalo Grove:
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS,
as follows:
SECTION ONE: The planned development proposed by
Richard J. Brown, Inc., pursuant to Exhibits AA, BB and CC "
attached hereto and made a part hereof, and as modified herein,
for the subject property, be and it is hereby approved as a
planned development within the provisions of the R -9 District
of the Zoning Ordinance of the Village of Buffalo Grove. The
said planned development shall be in substantial compliance
with Exhibits AA, BB and CC attached hereto.
SECTION TWO Richard J. Brown, Inc., will submit
plans for the construction of the said planned development to
the Building Commissioner of the Village of Buffalo Grove, and
such plans shall conform to all applicable ordinances and
regulations of the Village. The Building Commissioner is hereby
authorized and directed to issue building permits in accordance
with the intent of this ordinance upon satisfaction of the con -
ditions set forth herein.
SECTION THREE: The Village of Buffalo Grove shall have
the right to enter upon all private streets, alleys,'sidewalks
gnd. public use areas in said planned ''development for purposes '

of enforcing the ordinances of the Village and the statutes of
the State of Illinois, including '(but not limited to) traffic
regulations, vehicle tax ordinances, and the right to erect
such signs as may be necessary to enforce the same.
SECTION FOUR: All private streets, alleys, sidewalks,
curbs, gutters and areas set aside for general use shall be
maintained, repaired or replaced, when necessary, by Richard J.
Brown, Inc., its successors and assigns, in interest in the
subject property. In the event of its or their failure to do so,
the Village shall have the right (after having given 10 days'
written notice to the then owners of record of the subject
property) to enter upon the subject property and make the necessary
repairs or replacements, or perform the necessary maintenance.
The then owners of record of the subject property will reimburse
the Village for the reasonable and necessary cost of such repairs,
maintenance or replacement. Upon the failure of the then
owners of record to reimburse the Village for such cost, upon
the Village's demand therefore., the Village may institute liti-
gation against the then owners of record of the subject property
for the recovery of such cost which shall include reasonable
attorney's fees.
SECTION FIVE: The main roof line of the buildings to
be constructed on the subject property may not exceed the
following height limitations: (a) buildings containing four
stories of residential units -- 57 feet; (b) buildings containing
six stories of residential units -- 75 feet. The maximum heights
set forth herein are to be calculated exclusive of steeples,

belfries, spires, chimneys, smokestacks, cooling towers,
elevator bulkheads, parapet walls and building equipment housings.
SECTION SIX: The perimeter of the planned development
will be fenced and such fencing may contain a gate house. The
recreation area may contain an enclosed swimming pool.
SECTION SEVEN: Richard J. Brown, Inc., may vary the mix
of the units from the limitations shown on Exhibit CC, depending
upon market requirements, provided, however, that the number of
three bedroom units shall not exceed 64 and the total number of
units shall not exceed 512.
SECTION EIGHT: This Ordinance shall be in full force and
effect from and after its passage and approval in the manner pro-
vided by law.
