1967-031ORD INANCE NO. © - (a - 3 1 BE IT ORDAINED r BY THE PRESIDENT A-M BOA D OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS THAT THE VILLAGE PRESIDENT AND VILLAGE CLERK be and they are hereby authorized and directed to execute a lease for ,;A, 6.3> the period from August 31st 1967 to -1 1965 with the WHEELING RURAL FIRE PROTECTION DISTRICT, a duly constituted fire protection servicing a part of the Village of Buffalo Grove. Said lease shall be for the use of a portion of the building at 150 Raupp Blvd. in the Village. Said lease shall be in the form and upon the terms set forth in the copy attached hereto and made a part hereof as EXHIBIT A. P s ' dent ATTEST: .CMG �� ��•-� E ��RK T 71 A o T THIS INDENTURE made this day of , 1967, by and between the Village of Buffalo Grove, Illinois, herein- after called Lessor and Wheeling Rural Fire Protection District, a Municipal corporation, hereinafter called Lessee, W ITNESSNTH: Lessor for and in consideration of the covenants and agreements hereinafter contained, does hereby demise and lease to Lessee for use by Lessee, the premises known and described as follows, to -wit: The Northeast 700 square feet of garage together with portion of office space adjoining same in park building in Emmerich Park, Buffalo Grove, Illinois. To be occupied for housing and storage of vehicles and equipment used in fire fighting; the office space to be used for conduct of business in connection with fire fighting; and for no other purpose whatever. To have and to hold same for and during the term commencing on the 31st day of august 1967 and expiring on the 31st day of August 1968. In consideration of the said demise, it is agreed that Lessee shall pay Lessor at the Office of the Clerk of the Village of Buffalo Grove, the suns of One Dollar per month during said period, payable in advance on the first day of each month of the term hereof. Said premises shall not be sublet in whole or in part and Lessee shall not assign this lease. Lessee has examined the premises and is satisfied with the physical condition thereof. No agreement has been made to decorate, alter, repair or improve said premises. Lessee shall keep said premises in a clean, sightly and healthy condition and in good repair at all times. Lessee shall make no structural changes in the premises without the written consent of the Lessor. Lessee shall pay in addition to the rent above specified all light and water rates charged or levied on demised premises and in case no water and /or light rates are charged specifically against the demised premises, Lessee shall pay a pro rata share which said sum or sums shall be::due and payable with each monthly rent. Lessor shall not be liable for any damage or injury to any property or person or persons or the death of any person or persons by reason of the occupancy by the Lessee of the demised premises end Lessee will keep and hold the Lessor harmless for same at all times. Lessee shall be liable for and repair all damage to the demised premises occasioned by its use of same whether such damage is, caused by Lessee, its agents, employees, invitees or permittees. Lessee shall pay end discharge all costs, expenses and attorneys' fees which may be incurred by Lessor in connection with Lessee's occupancy or defense of any claim that may be IWAI brought against Lessor by reason of such occupancy. Lessor shall not be liable to Lessee for any damage or injury to him or his property occasioned by the failure of Lessor to keep said premises in repair, nor for any damage or injury arising from any act, omission or negligence of co- tenants or of other persons, occupants of the same building, or of adjoining or contiguous buildings or of owners of adjacent or contiguous property, or of Lessor's agents or employees, all claims for any such damage or injury being hereby expressly waived by Lessee. In the event premises are rendered untenable in whole or in part by fire or other casualty, Lessor may, at its option_,. terminate this lease. At the termination of this lease, by lapse of time or otherwise, Lessee shall yield immediate possession to Lessor.
