AN ORDINANCE_AUTHORIZING THE EXECUTION.
OF AN AMENDMENT OF ANNEXATION AGREEMENT
WHEREAS, it is in the best interests of the Village
of Buffalo Grove that a certain Amendment of Annexation Agreement,
a copy of which is attached hereto and made part hereof, be
entered into; and
WHEREAS, all necessary legal conditions precedent
to the execution of said Annexation Agreement have been fully
performed and complied with,
NOW, THEREFORE, be it'Ordaired by the President and
Board of Trustees of the Village of Buffalo Grove, Cook and Lake
Counties, Illinois, as follows:
SECTION 1: The President is authorized and directed
to execute, and the Clerk is directed to attest the Annexation
Agreement, of which a copy is attached hereto and made part hereof.
SECTION 2: This Ordinance shall be in full force and
effect from and after its passage and approval as provided by
law.

AMENDMENT OF ANNEXATION AGREEMENT
This Agreement, made and entered into this 06�
day of Ail 1966, between the Village of
Buffalo Grove�(hereinafter referred to as "Village "), by
the President and Board of Trustees, as the Corporate
Authorities thereof (hereinafter referred to as "Corporate
Authorities "), and LaSalle National Bank, as Trustee under
Trust No. 33229 (hereinafter referred to as "Owner "),
W I T N E S S E T H:
WHEREAS, the Village, Owner, and other owners,
entered into an Annexation Agreement on October 7, 1965,
which Agreement provides for the zoning and other regula-
tions of the Village relating to the.development of certain
real estate described therein; and
WHEREAS, the Owner is the owner of record of all
the territory described in section 2. of this Agreement;
and
WHEREAS, the Owner desires to develop within a
portion of such territory Zoned R -9, pursuant to said
Agreement, a recreational center which is a Special Use
within the R -9 zoning classification of the Village,
NOW, THEREFORE, in consideration of the premises
and the mutual covenants herein contained, it is hereby
agreed as follows:
1. Immediately upon the execution of this Agreement,
Owner will pay to the Village the sum of $1.00.

This instrument is executed y La SaUe National Bank, not personally but solely
as trustee, as aforesaid, in the exercise of the power and authority conferred
upon and vested in it as such Trustee. All the terms, provisions., stipulations
covenants and conditions to be, performed by La Salle National Bank are undertaken
by it solely as Trustee, as aforesaid, and not individually, and all statements
herein made are made on information and belief and are to be construed accord-
', ingly, and no personal liability shall be asserted or be enforceable against`
La Salle National Bank by reason of any of the terms, provisions, stipulations
covenants and /or statements contained in t is instrument.

vided in Section 1, the Corporate Authorities will enact
an ordinance granting a Special Use, pursuant to Article VI
of the Buffalo Grove Zoning Ordinance, to permit a privately -
owned, limited membership recreation building and community
center with accessory uses including swimming pool, tennis
courts, bathhouse, restaurant and bar facilities, on the
following described territory;
The South 350 feet of the North 400
feet of the West 170'feet of the East
776.01 feet of the West half of the
Northeast quarter, Section 9, Township
42 North, Range 11, East of the 3d P.M.
Cook County, Illinois,
and for the use of such property consistent with such
Special Use; provided that such Special Use shall commence
by October 7, 1970.
3. The Corporate Authorities agree to establish
by ordinance a sufficient number of liquor licenses of an
appropriate class, as may be necessary to permit the local
liquor commissioner of the Village to issue a liquor license
for the operation of bar facilities in accordance with the
Special Use referred to in Section 2 hereof.
4. The Annexation Agreement entered into on
October 7, 1965, referred to above, is hereby amended by
incorporating the provisions of this Amendment of Annexation
Agreement therein, any provision of said Agreement of October 7,
1965 to the contrary notwithstanding. All provisions of said
Agreement of October 7, 1965, not in conflict with the pro-
visions of this Amendment of Annexation Agreement are expressly
ratified and confirmed.

5. This Agreement shall be binding upon the parties
hereto, their respective successors and assigns.

6. This Agreement shall be effective until
October 7, 1970.
IN WITNESS WHEREOF, the Owner and the Corporate
Authorities have caused this instrument to be executed
by their respective duly authorized appropriate officers,
and have caused their respective corporate seals to be
affixed thereto, all on the day and year first above
written.
