A oeddler is defined as a person engaged in business for profit, who sells or offers for sale any commodity or article, travel - in- from place to place in the village, or who sells or offers for sale and delivery from any vehicle going from place to place in the village any commodity or article, and who carries such commodity or article with him for delivery at the time of sale. Section 2. A solicitor is defined as a person engaged in business for profit, ^oinM1, from place to place in the village, selling or offerinn for sale~any commodity or article, when delivery is not made at the time such sale is made or entered into, or going from place to glace in the village offering to furnish services or inviting orders for services. Section 3. Itinerant vendor is defined as a person engaged in business for profit who conducts a temporary or transient business in the village of sellinu commodities, articles or services with the intention of continuing such business in the village for not more than 120 days and who, in such business, uses, leases or occupies all or hart of any room, structure or vacant lot in the village, for the display of such commodities or articles, or in connection with the offering of such services. erection 4 �� canvasser is defined as a person engaged in the occupa- tion of going from place to place in the village on the public ways, in commercial establishments, or in or on residence property, to contact residents of the village or other persons in the village, where there is no requests invitation or appointment for such contact. Section 5#, Every peddler, solicitor, itinerant vendor and canvasser shall, prior to the engaging in such activity, register with the department of police and furnish in writing the following information: (a) Dame and address. (b) I,ame and address of the person by whom he is employed or with whom he is associated. (c) The nature of the commodities, articles or services registrant is selling or offering for sale, or the purpose for which suchreaistrant proposes to canvass in the villa e. ZD (d) An estimate of the length of time and a statement of the part or parts of the Village in which the registrant will pursue his activities. (e) The names and addresses of two persons who have known registrant for at least one year and from whom registrant is willing that inquiry be made to verify the facts stated by him. (f) A personal description of registrant, including fingerprints and other marks of identification. (g) Every fee paying qualified applicant shall be issued a license or registration, as the case may be, which shall be carried upon his person at all times and exhibited upon request. Section 6. No peddler, solicitor, itinerant vendor or canvasser shall go on or upon any private residence, without having been requested or invited to do so by the owner or owners, occupant or occupants of same, for the purpose of pursuing his business, if there is posted at a place that can be readily seen by one approaching the front door or rear door of said residence, a sign bearing the legend "No Peddlers ", "No Solicitors" or words of similar import. Section 70 no peddler, solicitor, itinerant vendor or canvasser shall go upon any private premises in the Village for the purpose of pursuing his business, without having been invited to do so by the owner or owners, occupant or occupants, before the time of 9 :30 A.M. or after the time of 4:30 P.M. Section 8. Any person hereinabove described who shall be guilty of any fraud, cheating or misrepresentation, upon being convicted thereof, shall be fined not less than $5.00 nor more than $200.00 for each offense. Section 9. No person shall solicit', canvas or engage in or conduct the business of a peddler or itinerant vendor as herein defined without first registering or obtaining a license from the Village. Application for such license or registration shall be filed with the police department and be in writing. Said application shall conform to the general provisions of this ordinance. Said application shall state what commodities or articles applicant proposes to sell or deal in. In case of an itinerant vendor, it shall state the address at which he intends to conduct his business. In the case of a peddler, it shall state whether he proposes to peddle from a vehicle or from a pack or packs carried by him. Applicant shall have a current registration under the Retailers occupation Tax Act and the application shall bear his certificate number. Whenever a State Statute requires a person to be licensed, the applicant shall produce for inspection his State license and there shall be endorsed thereon "local license fee paid ". Section 10. Class I Peddler (a) A peddler selling from a wagon, push cart or other vehicle - the license fee for each such peddler shall be $25.00 per year or fraction thereof, for each vehicle. Class II Itinerant Vendor (b) License fee for each itinerant vendor shall be $5.00 for each thirty days or any fraction thereof. Said licenses shall not be issued for less than thirty days or more than six months and the fee shall not be pro- rated. (c) The registration fee for each solicitor and canvasser shall be five dollars per year or any fraction thereof. Except as otherwise set forth herein, the license and registration year shall be the same as the calendar year. Upon approval of application and payment of the fee, the President shall cause the appropriate license or registration to issue over his signature. The same shall be attested by the Village Clerk. Section 11. Upon each vehicle of a peddler licensed under the provisions hereof, there shall be permitted but one helper or assistant to the driver or operator of such vehicle. �Qe +. o�t , _t(-EAL[Ga' LZI Section 12. eddler, itinerant vendor, solicitor or canvasser shall carry on his trade in the Village on Sundays, nor shall such trade be carried on by means of loud outcries or other noises that disturb the peace and quiet of the residents. Section 13. No provision of this ordinance shall be construed so as to deprive any person of his right of freedom of religion or speech as guaranteed by the Constitution of the United States and that of the State of Illinois. Section 14. The provisions of this ordinance shall not apply to officers or employees of the Village, County, State or Federal Government or any subdivision thereof, when on official business, nor shall they apply to a resident of the village under 18 years of age. Section 15. Licenses and registrations may be revoked by the President because of any violation of this ordinance or of any other ordinance of the Village, or of any State or Federal law, or whenever the licensee or registrant shall cease to possess the qualifications required herein for original registration or licensing. Section 16. In the event any Section hereof shall be declared invalid, the same shall not affect the remainder of this ordinance. Section 17. Except as otherwise set forth herein, any person, firm or corporation violating any of the provisions hereof, shall be fined not less than $5.00 nor more than $200.00 for each offense; a separate offense shall be deemed committed on each day during or on which a violation /occurs or continues.
