1963-005A M ORDINANCE NO. �-•`3 -� TOBACCO BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE.OF BUFFALO GROVE, ILLINOIS; Section 1. Definition The term. "retail tobacco dealer" is hereby defined to mean any person selling, offering for sale or keeping with the intention of selling or exchanging at retail, cigars, cigarettes or cigarette papers or wrappers, or any tobacco or tobacco products. Section 2. License - Required. No person shall engage in the business of a retail tobacco dealer without first having obtained a license therefor. Section 3. Same - Application; Chief of police to investigate applicant and premises. An application for a retail tobacco dealer's license shall be made to the Village Clerk on form provided. The chief of police shall cause an investigation to be made of the character and the reputation of the applicant, and of whether the applicant is a proper person to be entrusted with the sale of tobacco or tobacco products. Section 4. Same r- Fee The license fee for a retail tobacco dealer's license shall be $25.00 for the whole or any portion of the license period for which application is made; except that for the period from the effective date of this Ordinance through December 312 1963, the fee shall be $15.00. =1= Section 5. Same - Tenn. Every retail tobacco dealer's license shall be issued for a year, ending on the last day of December. Section 6. Same - Transfer. The transfer of any license issued under this Ordinance is hereby expressly prohibited. Section 7. Mechanical devices for sale of cigarettes. No person without a retail tobacco dealer's license shall locate, install, keep, maintain or use, or permit the location, installation, keeping, maintenance or use upon his premises of any vending machine, automatic vending machine, coin- controlled or coin - operated machine or other mechanical device used or intended to be used for the sale or distribution of cigarettes ; -:or other tobacco products Section 8. Fee for mechanical devices. Every retail dealer having such a mechanical device on his premises shall be entitled to have one machine thereon without any fee being charged, except as set forth in Section 4 hereof. For each machine after the first machine on the premises, he shall pay a fee of $5,00 per machine per license year or portion thereof. Section 9. Sales near schools. Section 1. Section 12. Section 15. Smokin;; restrictions (a) No person shall light, smoke or carry a lighted cigarette, cigar, pipe or lighted tobacco in any form (1) In any hazardous use room, building or premises. (2) In any church, ;DQ or /'garage, except in rooms designated as smoking rooms. =3= (3) In any theatre or playhouse, except in rooms designated as smoking rooms. (b) No owner, operator, agent, tenant, person or corporation in possession or control of a premises shall knowingly permit the lighting, smoking or carrying of a lighted cigarette in any of the premises listed in paragraphs (a) - (1), (2) or (3) hereof, except in rooms designated as smoking rooms. Section 14. No Smoking signs. Standard "No Smoking "signs shall be conspicuously posted in every room, building or premises where smoking is prohibited. A standard "No Smoking" sign shall have a white field with the words "No Smoking" printed in letters not less than four (4) inches high with one -half (1/2) inch face. Section 15. Penalty - Except as otherwise set forth herein, any person vio- lating any of the provisions of'this Ordinance shall be fined not less than $5.00 or more than $100,00 for each offense. Each day any violation continues shall constitute a separate offense. Section 16. Publication. This Ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
