ORDINANCE NO. 0 62 - 2 ELECTRICAL CODE OF THE VILLAGE OF BUFFAIA GROVE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFAW GROVE, THAT, SECTION 1. Except as hereinafter modified, "The National Electrical Code, 1959 Edition ", -recommexided by the National Board of Fire Underwriters, is hereby adopted by reference; provided, that in the event any of the provisions of the National Electrical Code are in conflict with the State law or with any other ordinance of the Village, the State law and such other village ordinance shall prevail. At least one copy of the National Electrical Code shall be kept on file in.the office of the Village Clerk for public use, inspection and examination. Whoever violates any of the provisions of the National Electrical Code, 1959 Edition,,-adopted by this section shall, upon conviction thereof, be punished by a fine not exceeding two hundred dollars. Each day any violation of any provision of the National Electrical Code, 1959 Edition, adopted by this section, shall continue shall constitute a separate offense. SECTION 2. It shall be unlawful for any person to engage in the business of electrical contractor within the Village without being registered in the manner hereinafter set forth. SECTION 3. Any person desiring to engage in the business of electrical contractor within the Village shall apply for registration to the Village Clerk„ Upon the filing of such application and the payment of the registra- tion fee set out in Section 4 of this Code, the Village Clerk shall register the applicant as an electrical contractor, and shall issue to the applicant a certificate of registration which will authorize the applicant to engage in such business for the year in which it is issued. A copy of the registration shall be forwarded to the Building Commissioner. SECTION 4, The fee for registration as an electrical contractor shall be fifteen dollars annually, payable to the Village Clerk, provided that if said applicant is registered in another municipality in the State of Illinois, he shall not be required to register or pay a fee in this Village,-and proof of such registration in other municipalities shall be filed with the Village Clerk. SECTION S. Every person desiring to engage in the business of making any electrical installation in the Village shall execute and file with the Village Clerk a surety bond payable to the Village, in the penal sum of one thousand dollars, conditioned that the applicant shall well and faithfully observe all of the provisions of this Code, and other ordinances and other regulations of the Village relating to electrical instal- lations. This bond must remain in full force and effect while any electrical work is being performed in the Village of Buffalo Grove. SECTION 6. The Building Commissioner and such other employees as may from time to time be appointed by the Presi- dent.and Board shall be charged with the duty of enforcing the provisions of this Code, the rules and regulations thereof, and the.standards and specifications for the installation, alteration and use of.electrical equipment as herein provided for. SECTION 7. No electrical equipment shall be installed or altered except upon a permit first issued by the Building Commissioner; provided, however,'that no permit shall be issued for installing or altering by contract electrical equipment unless the person applying -for such permit is registered as an electrical contractor as required by ordinance and except that no permit shall be required for minor repairs which do not require changes in the existing electrical circuitry. SECTION 8. The Building Commissioner shall inspect all electrical equipment installed or altered, and shall require that it conform to the standards and specifications applicable thereto and adopted as foresaid. The Building Commissioner is hereby empowered to reinspect any electrical equipment, and when such equipment is found to be unsafe to life or property, shall.noti£y the person owning, using or operating the same to place the same in a safe and secure condition and in compliance with the standards and specifications described herein, within such time as the Building Commissioner shall consider just and reasonable* Upon refusal or wilful failure to comply with the requirements-of such notification, in addition to the penalties otherwise provided herein, the Building Commissioner may recommend the cutting off and stopping of such current until such electrical equipment has been placed in a safe and secure condition and in compliance with the standards and specifications referred to herein. No inspection fee shall be charged for such reinspection, but in case it becomes -2- • necessary to replace such electrical equipment on account of defects disclosed by such reinspection, a permit therefor shall be obtained and an inspection fee paid as provided by the President and Board of Trustees. SECTION 9. The Building Commissioner shall have the power to enter buildings or premises at any reasonable hour in the discharge of his duties. It shall be unlawful for any person to interfere with the Building Commissioner in the performance of his duties. Whenever, in the opinion of the Building Commissioner, it shall be necessary to call upon the police department for aid and assistance in carrying out or enforcing any of the provisions of this Code governing the inspection of electrical equipment, he shall have the authority to do so, and it shall be the duty of any member of the police department, when called upon by the Building Commissioner to act according to the instructions of and to perform such duties as may be required by the Building Commissioner in order to enforce or put into effect the provisions of this Code relating to the inspection of electrical equipment. - Any person installing concealed electric wires or equipment in any building in the Village shall notify the Building Commissioner in writing of such intended installation, at least twenty -four hours before the work is to be covered, and no such work shall be covered until inspection thereof has been made as herein required. In all cases where such notice has not been given or such work has been covered without inspection thereof as herein provided, the Building Commissioner is authorized to take down or remove such portions of the building or structure as shall be necessary for the inspection of such electric wires or equipment, as herein required, and the cost of such taking down and replacing such work so removed by such official shall be borne by the person who has failed to give notice of the installation thereof, or by the person who has covered such work after such notice and before inspection thereof as herein provided, as the case may be. SECTION 10. In case the Building Commissioner finds a defect in any electrical apparatus or equipment, subject to inspection in the Village, he shall report the same to the persons for whom the test is being -made,giving a description of the character of the defect. If the defect is of a dangerous character, necessitating immediate repair, the Building Commissioner shall forthwith-condemn the apparatus or equipment for further use, or until the same is removed, repaired or renewed. If the defect is of a character such that the apparatus or equipment may be safely operated for a period of some days pending repairs, the Building Commissioner shall so report, and name the number of days during which the same may be operated. A duplicate of all such reports shall be promptly filed in the office of the Village Clerk- SECTION 12. The Building Commissioner shall have the right to condemn-wires which--are defective and dangerous to life or property, and shall require the owner of such wires to remove or replace the same with new wires. SECTION 13. The National Electrical Code 1959 is hereby amended in the following respects: (a) No point along the floor line of useable wall space in habitable rooms shall be more than tbri feet from an outlet. (b) only electrical metallic tubing or flexible conduit may be used in new construction except that no conduit or tubing smaller than one- half (1/211) inch electrical trade size shall be used. For remodeling work either of the above or armored cable known as "BX11 or "Ovalflex" shall be used. (c) only receptacles designed to accommodate grounded plugs shall be used. (d) The name of..the electrical contractor per- -forming the work shall be displayed on fuse panel boxes or circuit breakers. -4- (e) Minimum service to a single family resi- dence is 100 amperes and 220 volts. (f) All stairwells shall be adequately lighted. All enclosed stairwells shall have a light fixture rmMINS operated from the top of the stairs. (g) Any closet with a depth greater than thirty- six (36) inches or any storage or utility room with a floor area greater than twenty- five (25) square feet shall have a light fixture. (h) Underground cable shall be placed not less than sixteen (16) inches below finished grade. Underground cable may be of plastic material designed for underground installation. (i) Any addition or alteration to the electri- cal system shall require a permit. The electrical-permit fee for new building construction shall be included in the cost of building - permit for said construction until or unless said building permit fee is broken into separate categories. (j) Each kitchen shall contain at least one 20 ampere appliance circuit. (1) Waterproof fittings will be used on ser- vice drops. SECTION 14. The fee for issuance of permits shall be as follows: 1. Minimum fee $4.00 2. For wiring, light fixtures, motors of less than -5- 1/2 HP. and other units up to 600 watts, $3.00 and 0410 per outlet 3. Lighting fixtures - 0„10 per fixture 4. Motors over 1/2 HP. - $3.00 and 0.10 per Horse Power over 1/2 5. Units over 600 watts - $3,00 and 0.10 per kilowatt 6. Reinspection due to negligence of owner or contractor $4.00 SECTION 15. Any person, corporation or company violating any provision of this Code where no other penalty is provided shall be subject to a fine of not less than $2,.00 nor more than $200.00 for each violation and each day of such violation shall constitute a separate offense. SECTION 16. If any part, section, sentence or clause of this ordinance shall be adjudged void, the same shall not affect the validity of the remaining portions and this ordinance shall be deemed separable. SECTION 17. This ordinance shall be in full force and effect from and after its passage, approval and publi- cation according to law. ATTEST: PASSED this 1st day of February 1962.
