1961-003BUFFALO (COVE POLICE,DEPARTMENT TRAINING BULLETIN CURFEW When questions arise regarding the hours of curfew violation, please read and become familiar with Act 555, paragraph 555/1 of the Illinois Compiled State Statutes as printed below. Sec. 1. (A) It is unlawful for a person less than 17 years of age to be present at or upon any public assembly, building, place, street or highway at the following times unless accompanied and supervised by a parent, legal guardian or other responsible companion at least-L8 years of age approved by a parent or legal guardian or unless engaged in a business or occupation. which the laws of this State authorize a person less than 17 years of age to perform: 1. Between 12:01 A.M. and 6:00 A.M. Saturday, 2. Between 12:01 A.M. and 6:00 A.M. Sunday; and 3. Between 11:00 P.M. on Sunday to Thursday, inclusive, and 6:00 A.M. on the following day. (b) It is unlawful for a parent, legal guardian or other person to knowingly permit a person in his custody or control to violate subparagraph (1) of this Section. (c) A person convicted of a violation of this section shall be guilty of a petty offense and shall be fined not less than $10 nor more than $100. It shall be unlawful for any person to commit, cause, or knowingly permit any of the following offenses against children: (a) Abandon any child (b) Unnecessarily fail to provide any child in his or her custody or charge with proper food, drinko shelter, or raiment. (c) Cruelly beat, torture, overwork or mutilate any child. (d) Wilfully expose to any inclement -weather or in any manner injure a child in health or limb. SECTION 2.. It shall be unlawful for any parent, guardian or other person having the legal custody of a minor child under the age of fourteen (l4) to knowingly permit such child to be upon any public way in the Village alone and without an adult attendant of the age of twenty- one years or more after 9:30 P.M. and before 6*000 A.M, or unless engaged in some occupation or business in which such child may lawfully engage under the statutes of this State. SECTION 3. It shall be unlawful for any female person under the age of seventeen (17) or any male person under the age of seventeen (17) to be upon any public way in the Village between the hours of 12:00 Midnight Friday and 6:00 A.M. Saturday, or between the hours of 12.*00 Midnight Saturday and 6:00 A.K. Sunday., or between the hours of 10:30 P.M. and 6:00 A.M. on any other day of the week, unless accompanied by, and in charge of., a parent, guardian or other proper companion of the 5 4 • age of twenty -one (21) years or more,, or unless engaged in some occupation or business in which such child may lawfully engage under the Statutes of this State. Any police officer finding a child violating the provisions of Sections 1 and 2 hereof shall warn the child to desist immdiately from such violation and shall promptly report the violation to his superior officer, who shall cause awritten notice to be served upon the parent, guardian or person in charge of such child setting forth the manner in which this Section has been violated. Any parent,, guardian or person in charge of such child who shall knowingly permit such child again to violate the provisions of Sections 1 or 2,shall be fined in an amount not less than five (5) nor more than two hundred (200) dollars. THIS ORDINANCE shall be in full force and effect from and after its passage, approval and publication according to law. The Police Department enforces the state statute in regards to curfew, which allows youth an addi- tional 1/2 hour over the provisions of Ordinance #61 -3. Sections 9, 10, and 12 of Ordinance #63 -5 are also ade- quately covered by Illinois State Statutes which cover the sale of tobacco. The State Statutes are enforced by the Police De- partment.
