1961-018ORDINANCE NO. 0--61-18 AN ORDINANCE CREATING AND ESTABLISHING A VOLUNTEER FIRE DEPARTMENT IN THE VILLAGE I OF BUFFALO GROVE, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS. SECTION 1. That there shall be and is hereby created and established a Volunteer Fire Department consisting of a Fire Chief, Captain, First, Second and Third Lieutenants, a Secretary, a Treasurer, and such members of said Fire Department as may from time to time be determined and appointed by the President and Board of Trustees. SECTION 2. The Chief shall be appointed by the President and Board for an indefinite period and until his successor is appointed. The appointment of a Chief need not be from the rank next below the Chief, provided,if at the time of his appointment, the Chief was an officer or member of the Department, he shall retain his status while serving as Chief and revert to such status when his term as Chief is terminated. SECTION 3. In case of death, removal, resignation, incapacity or inability to serve, vacancy in the office of the Chief shall be filled by members and officers of the Department voting jointly until the office is filled by the President and Board of Trustees. SECTION 4. The Chief shall nominate officers and members of the Volunteer Fire Department , which nominatinns shall be submitted to and be subject to the approval of 'the President and Board of Trustees. SECTION 5. Said Volunteer Fire Department shall hold monthly meetings on the first Monday of each month, and shall, at the first meeting, elect a Secretary and a Treasurer for the ensuing year, which said officers shall qualify and take office immediately after their election. SECTION 6. The Fire Chief shall, upon taking office, appoint such engine men, ladder men, hosemen, nozzle men, hydrant men, rescue squad men and make such other appointments and prescribq such duties as may be necessary and proper in the organization and effective operation of said Volunteer Fire Department. The F:-.re Chief shall have the control and supervision, subject to the order and direction of the President and Board of Trustees of the Fire Department and all fire apparatus and equipments. including rescue apparatus belonging to the Village. In case of fire or rescue work, the Fire Chief and his Assistants in their order of rank, shall take command and the officer highest in rank shall take command of the Fire Department and direct the management thereof for the suppression of the fire or in the rescue work in the best manner possible; and when it may be necessary for the protection of other property to prevent the spread of the conflagration, and the officer in command may cause buildings to be removed, torn down, or destroyed in the best manner possible. SECTION 7. The Secretary shall keep a record of all meetings of the Department and the attendance of the members, a record -2- 0 • of all fires and the attendance of the members at such fires., and during the last week of Apri'l of each year, file w.th the Village Clerk a full report of such record of attendance and fires,which said I report shall be made under oath. He shall also keep such other records., make such reports,, and keep and furnish such statistics as'may be requ-.'L'red of him by law. SECTION 8. The Chief and his officers shall have the power to establish and enforce rules and regulatJ'Lons not inconsistent or in conflict wl-".th the ordinances of the Village and subject to approval by the President and Board of Trustees. SECTION 9. The Ch--,'.ef may for proper cause suspend or d-J.-scharge any officer or member of the Fire Department:, provided that officers or members so suspended or discharged may,,, within 10 days from such suspension or discharge, make a written demand upon the President and Board of Trustees to have such changes reduced to writing and filed with the President and Board of Trustees. (a) The President shall fix the time and place for hearings on such charges and shall cause notice of the time and place of such hearings, together with a copy of the charges to be served on the accused,., either by delivery of said notice and charges personally to the accused, or by mailing the notice and copy of the charges to him at his address as shown in the records of the Department, at least 20 days before the time of the hearing. Date for hearing shall be not less than 20 nor more than 60 days after receipt of written demand as set forth in Section a hereof. At the hearing, the Village President shall preside and, together with the members of the Board of Trustees, shall hear the evidence against the accused. The accused may be represented by counsel and shall be given an opportunity to present evidence in his own behalf and to cross-examine the witnesses against him. -3- (b) After having heard the evidence and completed its investigation, the President and Board voting jointly shall enter its findings of record and if it finds the charges, or any of them, to be sustained, may, by voting jointly impose a penalty of suspension of the accused, reduce his rank., or remove him from the service. SECTION 10. It shall be the function and duties of the Fire Department and every member thereof to extinguish accidental or destructive fires, to prevent the occurrence or spread of fires, to enforce all ordinances relating to the occurrence or spread of such fires. SECTION 11. Every male person above the age of twenty- one years who shall be present at a fire shall be subject to the orders of the officer in command at such fire and shall render all the assistance in his power, and in such manner as he may be directed, in the extinguishment of the fire, and in the removal of and protection of property. SECTION 12. It shall be the duty of all officers of the Fire Department and all police officers of the municipality to see that the provisions of this Ordinance are enforced and to arrest on view any person who shall be found violating any of the provisions of this ordinance or who shall.hinder, resist or refuse to obey any such officer in the discharge of his duty, and to that end,all such officers are hereby vested with the usual power and authority of police officers. SECTION 13.
