1960-002�N ORDINANCE NUMBER 0-50 -2 FENCE ORDINANCE BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE: SECTION 1. No person, firm or corporation shall erect or cause to be erected any fence or other screening structure unless it shall be in accordance with the provisions of this ordinance. SECTION 2. No fence or structure shall be erected within twenty -five (25) feet of any street or closer to such street than the building line, whichever distance is greater. SECTION 3. It shall be unlawful to erect any fence or other screening structure more than five feet in height without first having secured a permit therefor. Application for per - mits shall be made to the Village Clerk and shall specify the intended location, character and size of such fence or structure. SECTION 4. The fee for such fence permit shall be $7.50 for 100 lineal feet and $2.50 for each additional 100 lineal feet or part thereof. SECTION 5. No person being the owner, lessee, servant or agent of any real estate in the village shall erect, main- tain or permit to be erected or maintained on or about the exterior building line of such real estate or upon any por- tion of the sidewalk adjacent to such real estate, any railing, fence guard or protection of any kind of barbed wire, or upon which railing, fence guard or other protection there shall be affixed or placed or in any manner attached, any spike, nail or pointed instrument of any kind or descrip- tion. Each and every day such person shall fail or neglect to remove from such railing, fence or other protection, any barbed wire, spike, nail or other pointed instrument, after notice in writing from the building-inspector, director of public works or the police department to do so, he shall be deemed guilty of a new, separate and distinct offence, provided, however, barbed wire shall be permitted on fences of a height of seven feet. SECTION 6. Whenever in the village, in, along or through any public street, alley or park, barbed wire is found in use in part or in whole for a fence or barrier, the same shall immediately be removed by the police department ?,or building department. 0 tC l• ♦n + SECTION 7. The President voting jointly with the Village Board may vary and make exceptions to this ordinance where there is sufficient evidence.that the presence or absence of a particular type of fence will be detrimental to public health, safety or welfare. Applications for variations shall first be submitted to the Planning Commission. SECTION 8. If any paragraph, subsection, sentence, clause, or phrase of this ordinance is adjudged to be void, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 9. ,Anyone guilty of violation of any provision of this ordinance shall be punished by a fine of not less than $2.00 and not exceedin $200.00. Each day any violation shall continue shall constitute a separate offence. SECTION 10. This ordinance shall be in full force and effect from and after its passage, approval, and publication or posting according to the laws of the State of Illinois. PASSED this day of 19 A.D.
