AN ORDINANCE AUTHORIZING THE PRESIDENT OF THE BOARD OF TRUSTEES OF
THE VILLAGE OF BUFFALO GROVE, COOK COUNTY, ILLINOIS, TO ENTER INTO
A CONTRACT WITH EVERT KINCAID AND ASSOCIATES, INC., FOR CONSULTING
SERVICES RENDERED AND TO BE RENDERED TO THE PLANNING COMMISSION
AND THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO
GROVE IN THE PREPARATION OF A COMPREHENSIVE STUDY AND REPORT FOR
THE CORPORATE AREA OF THE VILLAGE AND ITS ENVIRONS.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VIL-
LAGE OF BUFFALO GROVE, COOK.COUNTY, ILLINOIS THAT:
SECTION I. The President of the Board of Trustees of the Village
o of To Grove, Cook County, Illinois, is hereby authorized to
enter into a contract with Evert Kincaid and Associates, Inc., city
planning consultants, for services rendered and to be rendered to
the Village Planning Commission and the President and Board of
Trustees of the Village of Buffalo Grove in the preparation'of a
comprehensive study and report for the corporate area of the Vil-
lage and its environs; and to retain said Consultants for the pur-
pose of assisting the Planning Commission, the Zoning Board of Ap-
peals, the Building Commissioner, and other village officials in
the proper administration of subdivision regulations, planning and
zoning of the Village of Buffalo Grove, said Contract to be sub-
stantially in the following form, to wit:

THIS AGREEMENT, made and entered into this 1st day of October ,
1959, between the Village of Buffalo Grove, Illinois, Partyoftie
First Part, hereinafter referred to as the "Village," and the city
planning firm of Evert Kincaid and Associates, Inc., Party of the
Second Part, hereinafter referred to as the "Consultants."
WHEREAS, the Village desires to engage the Consultants to provide
certain technical and professional services herein described:

I. EMPLOYMENT OF CONSULTANTS. The Village hereby

II. AREA COVERED. The Consultants shall perform all of the neces-
sary services provided under this Contract in connection with the
area within the corporate limits of the Village of Buffalo Grove,
as it is constituted on the effective date of this Contract, and
including those unincorporated parts of Cook and Lake Counties
lying within the one and one -half mile area of jurisdiction of the
Village.
The services will include the platting of base map material and
the study of ordinances and plans of other villages where said in-
formation is relevant to the comprehensive planning studies for
the Village of Buffalo Grove, provided, however, that said studies
and posting of maps of other municipalities shall not include any
services covering the area of neighboring.villages.
III. SCOPE OF SERVICES. The Consultants shall do, perform, and
carry out in a sat s actory and proper manner, as determined by
the Village, the following:
A. BASE MAPS
1. Preparation of a base map of the Village of Buffalo Grove,
including contiguous territory within the one and one -half
mile peripheral area, will be prepared at an appropriate
scale showing streets, alleys, schools, parks, public
areas, water courses, railroads, and other existing public
features, for the purpose of providing a base map for all
Village planning studies. Parcel lines will be added to
the base map for those parts of the study pertaining to
land use and zoning.
2. An appropriate environmental map will be prepared for use
in delineating the Area Development Plan for the one and
one -half mile unincorporated area beyond the limits of
the Village as a part of the Official Plan.
B. STUDY OF EXISTING CODES AND ORDINANCES
A summary will be made of all maps, data, ordinances, and
other material now existing to bring about proper regulation
and control of land use and development within the Village and
its environs in order that proper recommendations may be made
to the Village Plan Commission and the Board of Trustees to
alleviate any deficiencies in the present Official Plan,
adopted by the Plan Commission of the Village October 10, 1958

and approved by the President and Board of Trustees November
6, 1958, necessary for implementation of the Official Plan.
C. LAND USE MAP
Field studies of existing land use will be made and a land use
map will be prepared of all properties within both the present
corporate limits of the Village and the one and one -half mile
peripheral area. The methods used in this survey will be cor-
related with those of the Lake County Regional Planning Com-
mission and the land use studies of Cook County. (Land use
studies will be made in the field and from available aerial
photos which can be secured from the Village or county offi-
cials. The cost of new aerial photographs for these services,
if necessary, would not be included under the provisions of
this Contract, but would be available at cost to the Village,
after approval by the Village Board of Trustees, with said
aerial photos to become the property of the Village of Buffalo
Grove) .
Studies will be made of the population of the Village and its
environs to determine those characteristics essential in the
planning program, with those characteristics to include den-
sity, age groups, income data, and other data available from
the 1950 Federal census or any later special census of the
Village or the region. Available school data will also be
interpreted as a part of the population characteristics.
D. COMPREHENSIVE LAND USE (OFFICIAL) PLAN
1. A comprehensive land use plan will be prepared, including
a General Development Plan for the area within the Vil-
lage and an Area Development Plan which will include the
unincorporated one and one -half mile peripheral area of
the Village and necessary textual material in the form of
a final report will be prepared for official adoption by
the Village as an amendment to the present Official Plan,
which is in map form.
2. Development planning areas will be stipulated within the
text of the Official Plan or on the General Development
Plan in accordance with the program of the Board of Trus-
tees for the purpose of establishing the timing or staging
of future public works programming of the Village and the
establishment of conditions to be required by the Village
before effectuating changes in the zoning district map in
those instances where public hearings will be warranted, on
motion of the Board of Trustees or upon petition by prop-
erty owners of areas where private development is contem-
plated consistent with the Official Plan.

E. THOROUGHFARE PLAN (COMMUNITY FACILITIES PLAN)
A complete analysis of traffic patterns and the relationship
of the Federal, State, County, and municipal highway systems
and those phases of the planning in Lake County and Cook
County which can be adapted will be studied in detail, and
clarified into major highways, secondary highways, collector
streets, and minor streets, with specific recommendations for
the elimination of hazards and the proper development of street
widenings, extensions, and other special facilities to coordin-
ate the circulation of people, automobiles, and service ve-
hicles, to provide a circulation pattern adaptable in the en-
forcement of the provisions of the subdivision regulations and
the zoning ordinance.
F. SUBDIVISION REGULATIONS
1. Regulations will be developed consistent with changing con-
ditions and standards with said recommendations to be har-
monious with the land use plan of the Village and the two
counties affected. The subdivision regulations would in-
clude "Planned Development" procedures to bring about im-
plementation of the Official Plan and provide for any re-
districting on the Zoning District blap to be properly timed
with the installation of improvements which would have ade-
quate capacity prior to the redistricting, or the assurance
that installation would be made of the improvements neces-
sary by private developers, guaranteed by the posting of
surety bonds or other methods.
2. Standard specifications for subdivision improvements, in
written form for the review and approval of the Village
Plan Commission and adoption by the Board of Trustees,
will be prepared on a generalized basis to establish stand-
ards available for use of both the Village officials and
land developers in determining the minimum standards. Said
specifications will not include the preparation of detailed
drawings for structural elements required in subdivisions,
however, said specifications will specify the minimum re-
quirements for preparation of said drawings by the profes-
sional engineers of the developer and the requirement that
written specifications and details be filed with the Vil-
lage prior to issuance of permits to construct said im-
provements.
G. SCHOOLS AND PARKS
A review will be made of all existing school and park facili-
ties and recommendations made where practical for the exten-
sion of such areas, relocation of additional areas and facil-
ities which may be reU,�xe:d to serve the estimated ultimate pop-
ulation of the village and its environs, consistent with the
intensity of use patterns recommended for the Official Land Use
Plan.

H. HOUSING
Special study will be made of the land coverage and maximum
floor area ratios of existing development within the Village
as well as the plot plans for residential structures in order
to make recommendations regarding lot coverage and bulk stand-
ards essential for regulatory measures for the general welfare
and preservation of high standards of residential development.
Recommendations will be made for aesthetics to prevent undue
stereo -type construction as well as preventive measures for the
crowding of structures on the land to bring about high aesthet-
ic characteristics as well as maximum open space.
I. ZONING ORDINANCE
Based upon the elements of the Official Land Use Plan and the
analysis of the field studies and mapping of existing land use,
a comprehensive zoning ordinance text and district maps will
be prepared for implementation of the Official Plan. The pro -.
visions of the zoning ordinance will be properly related to
the subdivision control ordinance and other codes of the Vil-
lage to provide for efficient enforcement of zoning standards
essential for the general welfare.
J. ANNEXATION STUDY
Studies will be made as a part of the comprehensive planning
program to determine the extent and feasibility of annexation
of fringe areas of the municipality in relation to both the
tax base and the effect upon the cost of the municipal services
which will be required.
IV. PUBLIC RELATIONS. The Consultants, at the request of the Vil-
lage or its represen ative Plan Commission, will attend a total of
twelve (12) pre- arranged formal meetings during the period of the
Contract and a reasonable number of conferences necessary for com-
pletion of the comprehensive plan. Additional pre- arranged formal
meetings beyond the twelve (12) meetings authorized by this Con-
tract will be attended at a per diem of One Hundred Dollars
($100.00) plus reimbursement for all expenses pertaining to travel
and subsistence incurred in the attendance of such additional
meetings.
The Consultants will assist in the preparation of material for pub-
lic information, press releases, and public presentation of plan-
ning material.
V. PLAN COMMISSION SUPERVISION. The Village agrees to designate
the Plan Commission as its representative in administering the
preparation of the planning and zoning studies outlined herein and
in directing the work of the Consultants; provided, however, that the
consultant will at regular intervals check with the President and
Board of Trustees respecting directions given by the Plan Commission
to the end that the ultimate study and report as prepared herein will
reflect the wishes of the Presi -Lent and Board of Trustees.

VI. PERSONNEL. The Consultants will provide all personnel to
fully execute the program outlined herein and shall be responsible
for the quality of work produced and made a part of the final re -.
port.
VII. TIME OF PERFORMANCE. The Consultants agree to complete the
services incluaed under SECTION III, SCOPE OF SERVICES, within
fifteen (15) months after the execution of this agreement and ren-
der a final report to the Village within a period of eighteen (18)
months from the effective date of this agreement, provided there
are no delays occasioned by action of the Village or unforeseen
conditions over which the Consultants have no control. The final
report will be published in mimeographed form with seventy -five
(75) copies describing all of the comprehensive recommendations
scheduled under SECTION III and including planographed reproduc-
tions of the maps and plates made a part thereof. Twenty -five (25)
copies each of the subdivision regulations and the zoning ordinance
will also be submitted under the provisions of this Contract. Any
additional copies required by the Village will be provided by the
Consultants, who shall be reimbursed for such additional cost by
the Village.
VIII. COMPENSATION. The Consultants agree to fully complete all
services under the Scope of Services, and as agreed to herein, for
a total fee of Five Thousand, Seven Hundred Dollars ($5,700.00) to
be paid in accordance with the following schedule:
1. One Thousand, Eight Hundred Dollars ($1,800.00) to be paid as
a retainer fee with the signing of this Contract.
2. Three Thousand, Four Hundred Dollars ($3,400.00) to be paid in
seventeen (17) equal monthly installments of Two hundred Dollars
($200.00) each , the first payment to be made one (1) month
from the date of this Contract.
3. Five Hundred Dollars ($500.00) to be paid at the completion of
this Contract.
IX. MATERIALS AND REPRODUCTIONS. The Consultants agree to pay
or a1I prints, reproductions, rafting materials, and other ex-
penses connected with the preparation of maps, ordinances, and re-
ports, as outlined above. Any additional copies requested by the
Village shall be provided by the Consultants who shall be reim-
bursed by the Village for the cost of preparation of said copies.
All original maps, illustrations, and reports prepared by the Con-
sultants shall become the property of the Village and shall be
transmitted prior to or at the completion date of this Contract.
X. EXPERT TESTIMONY NOT INCLUDED. The scope of services under
this Contract shall not include expert testimony during litigation
in behalf of the Village of Buffalo Grove; however, the Consultants

agree to perform said services at the rate of One Hundred and
Twenty -Five Dollars ($125.00) per half day or portion thereof,
plus the cost of special preparation for attorneys or preparation
of special exhibits other than the maps and reports furnished under
the scope of this Contract.
XI. SUBDIVISION REVIEW. Review of subdivisions for the Village
shall not be included In the scope of services under this Contract.
However, the Consultants will review subdivision plans and make
recommendations to the officials of the Village regarding subdivi-
sion plans forwarded to the Consultants subject to the fees and
method of payment for said review to be determined and made a part
of the subdivision regulations of the Village.
XII. TERMINATION OF CONTRACT FOR CAUSE. This Contract is to con-
tinue in force and effect until a work as set forth herein has
been completed, unless by mutual agreement the Contract is termin-
ated. In such event, the Consultants shall be compensated in pro-
portion to the work completed.
XIII. EFFECTIVE DATE. This Contract shall be binding on any suc-
cessors of either party and shall take effect on the 1st day of
October 1959.
