ORDINANCE NO-0-59-15
AN ORDINANCE REGULATING THE CUTTING OF WEEDS AND GRASS
AND PROHIBITING THE MAINTENANCE OF REFUSE AN-D JUNK
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF BUFFALO GROVE, ILLINOIS, THAT:
1. Weeds. It shall be the duty of every owner, and also every person,
firm or corporation in possession or control, of any land in the
Village other than land actually being used for and devoted to
agricultural purposes, to keep all the weeds thereon cut so that no
weeds are allowed to reach a height of more than / 2-- inches
and it shall be unlawful for any owner, and for any person, firm,
or corporation in possession or control of said land to fail to do
SO.
2. Grass. It shall be the duty of every owner, and also every person,
firm or corporation in possession or control, of any land in the Villag(
which is within ;T C yards of any occupied residence in the
Village other than land actually being used for and devoted to
agricultural and golf course purposes, to keep all the grass thereon
cut so that no grass is allowed to reach a height of more than
inches and it shall be unlawful for any owner and for any
person, firm or corporation in possession or control of said land
to fail to do so.
3. Refuse and Junk. It shall be unlawful for any owner, and also any
person, firm or corporation in possession or control, of any land
in the Village, other than land actually being used for and devoted
to agricultural purpose, to deposit or to permit or maintain the
existence thereon of any uncovered piles of refuse, or garbage, or
any junk, including but not limited to Q.I

or to permit said land to become or remain in such a condition
as to be dangerous to public health in any way.
4. Penalty. Any person, firm or corporation violating any provision of
this ordinance shall be fined not less than ,$ U L nor more,
than two - hundred dollars for each offense; and a separate offense
shall be deemed committed on each day during or on which a
violation occurs or continues.
5. Cost of Weed Cutting. The Board of Trustees by resolution may
provide for the cutting of weeds in the Village as required by this
ordinance, when the owners of the real estate on which the weeds
are located refuse or neglect to cut them and may collect from t be
owners the reasonable cost thereof. This cost is a lien upon the
real est`aieabLffzcted superior to all other liens and engumbrances,
except tax liens; provided that within 60 days after said cost and
expense is incurred the municipality, or person performing the
service by authority of the municipality, in his or its own name,
shall file notice of lien in the office of the Recorder of Deeds in the
county in which said real estat a is located or in the office of the
Registrar of Titles of such county if the real estate affected is
registered under the Torrens system. The notice shall consist of a
sworn statement setting out (1) a description of the real estate
suffigient for identification thereof, (2) the amount of money
representing the cost and expense incurred or payable for the service,
and (3) the date or dates when said cost and expense was incurred
by the municipality. However, the lien of such municipality shall
not be valid as to any purchaser whose rights in and to said real
estate have arisen subsequent to the weed — cutting and prior to the
filing of such notice and the lien of such municipality shall not be
valid as to any mortgagee, judgment creditor or other lienor whose
rights in and to said real estate have arisen prior to the filing of such
notice. Upon payment of the cost and expense by the owner of or
persons interested in said property after notice of lien has been
filed, the lien shall be released by the municipality or person in
who se name the lien has been filed and the release may be filed of-
record as in the case of filing notice of lien.

Published by posting copies and notice in three prominent places within the
Village on. � 1959, no newspaper being published in the
Village, and the Village having less than 500 population according to the
latest census taken by authority of the United States, or the State of Illinois,
or the Village of Buffalo Grove.

AFFIDAVIT OF POSTING
The undersigned, Arthur Dick, being first duly sworn,
deposes and says:
That at the instruction of Paula D. Clohesey, Village
Clerk, he posted a copy of the attached Ordinance No. 0 -59 -15
in three (3) prominent places in the Village of Buffalo Grove,
to -wit:
1. The office of Buffalo Grove Home Builders, Inc.
and U. S. Post Office Sub- Station.
2. On the telephone pole at the corner of St. Mary's
Parkway and Buffalo Grove Road.
3. On the telephone pole at the west end of Crestview
Terrace.
That said notices were posted on the 2nd day of
September, 1959.
