2013-07-15 - Ordinance 2013-038 - GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE, SUNRISE SENIOR LIVING7/2/13 ORDINANCE NO. 2013- 38 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE Sunrise Senior Living, Signs at 180 Half Day Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the R9 SU District and is referred to herein as 180 Half Day Road, Buffalo Grove, Illinois; and WHEREAS, a request was made by SZR Buffalo Grove Assisted Living LLC for variance of Sign Code, Section 14.16.010, pertaining to Residential Districts and Section 14.16.070, pertaining to Ground Signs, for the purpose of re- facing the existing ground signs as previously approved under Ordinance 1998 -18 with the new company logo; and WHEREAS, the Zoning Board of Appeals held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive recommendation for the variations and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations for the wall signs are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code), and that (1) the proposed signage is of particularly good design and in particularly good taste; and (2) the entire site has been or will be particularly well landscaped. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 1 0 0 Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Sections 14.16.010, and 14.16.070 of the Buffalo Grove Municipal Code for the purpose of re- facing the existing ground signs as previously approved under Ordinance 1998 -18 with the new company logo. The Property is legally defined as follows: Lot 1 in the Plat of Resubivision of Lot 2 in Woodland Commons Shopping Center and Commerce Center, being part of the Subdivision in the northwest quarter of Section 21, Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat of said Resubdivision recorded June 21, 1991 as Document 3031596, in Lake County, Illinois. Section 3. The variations are subject to the following conditions: A. The signs are to be installed in accordance with the application exhibits submitted to the Zoning Board of Appeals; and B. Subject to the Appearance Review Team (ART) minutes dated June 5, 2013. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval.
