2013-06-17 - Ordinance 2013-030 - GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BG SIGN CODE, DAVITA DIALYSIS6/11/2013 ORDINANCE NO. 2013- 30 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE DaVita Dialysis at 1291 W. Dundee Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the B -3 Business District and is commonly known as 1291 W. Dundee Road, Buffalo Grove, Illinois; and, WHEREAS, request was made by DaVita Dialysis, 1291 W. Dundee Road, for variance of Sign Code, Section 14.16.030, pertaining to Business Districts; and Section 14.16.070, pertaining to Wall Signs, for the purpose of allowing a second wall sign. Said wall sign to be installed on the north elevation of the building; and WHEREAS, the Zoning Board of Appeals held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive recommendation for the variations, and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property and granting the variations would allow the sign user to better serve its customers, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objectives of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. 1 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Section 14.16.030 and Section 14.16.070 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of allowing a second wall sign. Said wall sign to be installed on the north elevation of the building for the Property located at 1291 W. Dundee Road which is legally defined as follows: Parcel 1: Lot 1 in Plaza Verde Unit One, a Subdivision of part of the northeast 1/4 of the northeast `/4 of Section 7, Township 42 North, Range 11, east of the Third Principal Meridian, in Cook County, Illinois. Parcel 2: Lot 2 in Barbara Resubdivision of part of Lot 2 of Plaza Verde Unit One, a Subdivision of part of the northeast 1/4 of the northeast 1/4 of Section 7, Township 42 North, Range 11, east of the Third Principal Meridian, in Cook County, Illinois. Section 3. The variations are subject to the following conditions: 1. Sign to be installed pursuant to Exhibit E submitted with the application; and 2. Subject to the Appearance Review Team (ART) minutes dated May 9, 2013. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval.
