2013-03-04 - Ordinance 2013-013 - AMENDING THE SPECIAL USE FOR XTREME TRAMPOLINES, 950 BUSCH PKWY2/22/2013 • • ORDINANCE NO.2013 —13 AN ORDINANCE AMENDING THE SPECIAL USE FOR XTREME TRAMPOLINES, A RECREATION FACILITY IN THE INDUSTRIAL DISTRICT, VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS Concerning the addition of coin - operated amusement devices Xtreme Trampolines 950 Busch Pkwy The Corporate Grove Business Park WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Village approved Ordinance No. 2011 -37 granting a special'Use for the Xtreme Trampolines recreation facility at 950 Busch Parkway, zoned in the Industrial District; and, WHEREAS, said facility is located on the real property legally described in Exhibit A (the "Property ") attached hereto, and 900 Busch Parkway Venture LLC is the owner ( "Owner "), of the Property; and, WHEREAS, Eric Beck, operator of Xtreme Trampolines, ( "Petitioner ") has petitioned the Village on behalf of ITP #2, LLC, a Wyoming limited liability company, for an amendment of the special use approved by Ordinance No. 2011 -37; and, WHEREAS, Petitioner requests approval to install a maximum of thirty -six (36) coin operated amusement devices pursuant to the provisions of Chapter 5.12, including Section 5.12.070, of the Buffalo Grove Municipal Code; and, WHEREAS, the proposed facility would be developed and operated in accordance with and pursuant to the following exhibits: EXHIBIT A I Legal Description E 2 EXHIBIT B Acceptance and Agreement concerning amendment of special use EXHIBIT C Conceptual layout of coin - operated amusement devices dated 1/2/2013 EXHIBIT D Floor plan (Emergency Exit Plan) for Xtreme Trampolines facility dated 9/22/2011 WHEREAS, notice of the public hearing concerning the petition for amendment of the special use was given, and the public hearing was held by the Buffalo Grove Plan Commission on February 6, 2013; and, WHEREAS, the Plan Commission determined that the proposed amendment of the special use is appropriate for the recreation facility and would not have detrimental impacts on adjacent properties; and, WHEREAS, the Plan Commission voted 6 to 1 to recommend approval of the amendment to the special use to allow a maximum of thirty -six (36) coin - operated amusement devices, subject to compliance with Chapter 5.12 of the Buffalo Grove Municipal Code and approval of Village permits for installation of said amusement devices; and, WHEREAS, the President and Board of Trustees after due and careful consideration have concluded that the amendment of the special use on the terms and conditions herein set forth would allow an appropriate enhancement to the facility and not have detrimental impacts on adjacent properties. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding Whereas clauses are hereby made a part of this Ordinance. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance approving an amendment to the special use granted by Ordinance No. 2011 -37 to allow a maximum of thirty -six (36) coin - operated amusement devices at the Xtreme Trampolines facility subject to the following conditions: A. The installation and operation of the coin - operated amusement devices shall comply with Chapter 5.12 of the Buffalo Grove Municipal Code as determined by the Village. 0 C • B. The coin - operated amusement devices are an accessory use to the principal use, namely the Xtreme Trampolines recreation facility. In the event that the trampoline facility is modified or terminated, the Village may revoke the approval herein concerning said coin - operated amusement devices. C. Installation of the coin - operated amusement devices and all related improvements shall comply with applicable Village codes and regulations as determined by the Village. Petitioner shall make application to the Village Building and Zoning Department for permit(s) prior to installation of said amusement devices. Said permit application shall include a dimensioned plan depicting the layout of all amusement devices with pertinent information concerning electrical requirements. D. The amended special use is granted to Eric Beck as operator of Xtreme Trampolines, and said special use does not run with the land and is not assignable. E. The terms and conditions of Ordinance No. 2011 -37 remain in full force and effect. Section 3. This Ordinance shall be in full force and effect upon the submittal to and approval by the Village of the executed Acceptance and Agreement (Exhibit B hereto). This Ordinance shall not be codified.
