GRANTING VARIATIONS FROM CERTAIN SECTIONS
OF THE BUFFALO GROVE SIGN CODE
Aetna Development Corporation at 1205 -1211 W. Dundee Road
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the
B -3 Planned Business Center District and is commonly known as 1205 -1211 W. Dundee Road,
Buffalo Grove, Illinois; and,
WHEREAS, request was made by Aetna Development Corporation, 200 West Madison
Street, Chicago, Illinois 60606 for variances of the Village's Sign Code, Section 14.20.030,
pertaining to Business Districts; Section 14.20.070, pertaining to Grounds Signs, for the purpose
of allowing two (2) additional ground signs on the property: one (1) ground sign to be located
along Dundee Road within two hundred fifty (250) feet of an existing ground sign located on the
same side of the street and the second ground sign to be located along Arlington Heights Road
that would be located within two hundred fifty (250) feet of the ground sign along Dundee Road
for 1205 -1211 W. Dundee Road; and
WHEREAS, during the public hearing on variation request at the Zoning Board of
Appeals, the Petitioner, by Mr. Mangurten, amended its request to allow additional ground signs
on the property: one (1) ground sign to be located along Dundee Road within two hundred fifty
(250) feet of an existing ground sign located on the same side of street; and to allow a menu
board ground sign and a pre -menu board ground sign that would be located within two hundred
fifty (250) feet of the ground sign along Dundee Road for the property located at 1205 -1211 W.
Dundee Road; and
WHEREAS, the Zoning Board of Appeals held a public hearing at which it received
testimony on the requested variations; and
WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive
recommendation for the variations, and prepared minutes of the public hearing; and

WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby
determine and find that the requested sign variations are in harmony with the general purpose
and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the
requirements of the Sign Code would cause undue and unnecessary hardship to the sign user due
to the following unique or unusual conditions pertaining to the property: (a) need to identify the
tenants in the building to attract customers and (b) to allow customers to place their order in the
drive through land, (2) the granting of the requested variances will not be materially detrimental
to the property owners in the vicinity, (3) the unusual conditions applying to the specific property
do not apply generally to other properties in the Village, and (4) the granting of the variances
will not be contrary to the general objectives of the Sign Code of moderating the size, number
and obtrusive placement of signs and the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. Variations are hereby granted to Sections 14.20.030 and 14.20.070, and
14.20.080 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the
purpose of allowing additional ground signs on the property: one (1) ground sign to be located
along Dundee Road within two hundred fifty (250) feet of an existing ground sign located on the
same side of street; and to allow a menu board ground sign and a pre -menu board ground sign
that would be located within two hundred fifty (250) feet of the ground sign along Dundee Road
for the Property located at 1205 -1211 W. Dundee Road which is legally defined as follows:
Lots 1 and 2 (except that part of Lot 2 dedicated for road purposes by dedication recorded
as Document 87300644) in Plaza Verde Unit One, being a Subdivision of part of the
northeast '/ of the northeast '/ of Section 7, Township 42 north, Range 11, east of the
Third Principal Meridian, according to the Plat thereof recorded September 29, 1975 as
Document 23237770, in Cook County, Illinois.
Section 3. The variations are subject to the following conditions:
A. Subject to the Village Engineer's memorandum dated October 4, 2011;

B. Subject to the Appearance Review Team (ART) minutes dated September 21,
2011, October 11, 2011 and February 8, 2012;
C. The signs are to be installed pursuant to KMA Drawing No. 2.1 dated
February 3, 2012, KMA Drawing No. 2.2 dated February 3, 2012, KMA
Drawing No. 2.3 dated February 3, 2012, KMA Drawing No. 2.4 dated
February 3, 2012, KMA Drawing No. 2.5 dated February 3, 2012 and
Landscaping Plan dated January 18, 2012; and
D. Safety signage /devices required to be installed at the pedestrian crosswalks in
the drive through lane subject to Village approval.
Section 4. This Ordinance shall be in full force and effect from and after its passage, and
approval. This Ordinance shall not be codified.
