2012-0408/27/2012 ORDINANCE NO. 2012- 40 GRANTING A VARIATION FROM SECTION 17.44.060.E.6 OF THE BUFFALO GROVE MUNICIPAL CODE Knockout Buffalo Grove, LLC. at 190 McHenry Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the B -5 Town Center Planned District and is commonly known as 190 McHenry Road; and WHEREAS, Knockout Buffalo Grove, LLC., an Illinois limited liability company, lessee of 190 McHenry Road, with consent of the owner of the Property, has requested a variation from Section 17.44.060.E.6. of the Buffalo Grove Municipal, pertaining to signs, for the purpose of allowing two (2) embellishments; one located on each side of the wall sign; and to allow the wall sign to exceed the maximum permitted square footage of 75 square feet by 12.08 feet; and deviation to the Town Center Shopping Center Sign Criteria for the purpose of allowing two (2) embellishments: one located on each side of the wall sign that do not pertain to name and nature; and to allow the total length of the wall sign to exceed 30 feet by 4 feet 10 inches; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on the said request for a variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation and deviation are in harmony with the general purpose and intent of 1 the Sign Ordinance, and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property in that the boxing gloves are part of their national logo and the sign is difficult to see from McHenry Road because the building is setback from the road, (2) the granting of the requested variance and deviation will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variance and deviation will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. A variation is hereby granted to Section 17.44.060.E.6. of the Village of Buffalo Grove Municipal Code and a deviation is hereby granted to the Town Center Shopping Center Sign Criteria to the Property legally described as follows: That portion of the building known as 190 McHenry Road on Lot 1 of Buffalo Grove Town Center Unit 9, being a Resubdivision of Lots 1 and 2 in Buffalo Grove Unit 7, in Section 33, Township 43 North, Range 11 East of the Third Principal Meridian, In lake, County, Illinois. Commonly known as: 190 McHenry Road, Buffalo Grove, Illinois 60089. for the purpose of allowing two (2) embellishments; one located on each side of the wall sign; and to allow the wall sign to exceed the maximum permitted square footage of 75 square feet by 1:2.08 feet; and Deviation to the Town Center Shopping Center Sign Criteria for the purpose of allowing two (2) embellishments: one located on each side of the wall sign that do not pertain to 2 name and nature; and to allow the total length of the wall sign to exceed 30 feet by 4 feet 10 inches. Section 3. The variance and deviation are subject to the following conditions: A. The sign is to be installed per Zoning Board of Appeals Exhibit "E" which was submitted with the variation application. B. The Village Appearance Review Team's (ART) minutes dated August 9, 2012.
