2012-0327/31/2012 U ORDINANCE NO. 2012- 32 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE Apartments at Windbrooke Crossing at 1160 Windbrooke Drive WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is zoned as a special use in the R -9 Multiple - Family Dwelling District and is referred to herein as 1160 Windbrooke Drive Buffalo Grove, Illinois; and WHEREAS, request is being made by The Apartments at Windbrooke Crossing, 1160 Windbrooke Drive, for variance of Sign Code, Section 14.20.010, pertaining to Residential Districts; and Section 14.20.070, pertaining to Ground Signs, for the purpose of allowing two (2) ground signs on the property; for the purpose of allowing the two (2) ground signs to exceed five (5) feet in height; for the purpose of allowing the two (2) ground signs each exceeding thirty two (32) square feet in area; for the purpose of allowing the two (2) ground signs to be located in the required building setback area; and to allow the ground sign on the northwest corner to be located closer to the property line than permitted; an WHEREAS, the Zoning Board of Appeals held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive recommendation for the variations and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations for the ground signs are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the proposed signage is of particularly good design and in particularly good taste and (2) the entire site has been or will be particularly well landscaped and that the requested sign variations are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code). NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 1 U J Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof Section 2. Variations are hereby granted to Sections 14.20.010 and 14.20.070 of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of refacing the two (2) existing ground signs on the property; for the purpose of allowing the two (2) ground signs to exceed five (5) feet in height; for the purpose of allowing the two (2) ground signs each exceeding thirty two (32) square feet in area; for the purpose of allowing the two (2) ground signs to be located in the required building setback area; and to allow the ground sign on the northwest corner to be located closer to the property line than permitted. The Property is legally defined as follows: Lot 1 in Windbrooke Subdivision, being a Subdivision of part of the southeast '/ of Section 28 and the southwest'/ of Section 27, Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat thereof recorded January 8, 1986 as Document 2411928, in Lake County, Illinois. Section 3. The variations are subject to the following conditions: A. The signs are to be installed pursuant to Zoning Board of Appeals Exhibit "E "; B. Subject to the Village Engineer's memorandum dated July 10, 2012; and, C. Subject to the Appearance Review Team (ART) minutes dated July 3, 2012. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified.
