2012-0195/2/2012 ORDINANCE NO. 2012 - 19 GRANTING A VARIATION OF THE BUFFALO GROVE DEVELOPMENT ORDINANCE 528 Buckthorn Terrace Driveway apron in the public parkway WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is occupied by a single- family home zoned in the R -9 Dwelling District; and, WHEREAS, Randy Poznansky is the owner ( "Owner ") of the Property; and WHEREAS, the driveway apron width and taper serving the Property do not comply with the standards of Section 16.50.080.A.2.b. of the Village Development Ordinance pertaining to the width of the apron at the street curb; and, WHEREAS, said driveway apron is 26 feet at the street curb rather than 21 feet as set forth in the Village Development Ordinance; and, WHEREAS, Owner has petitioned to the Village for a variation to allow the driveway apron to remain in place as currently constructed; and, WHEREAS, the Village Plan Commission held a public hearing, and based on the testimony and exhibits presented by the Owner, determined that the driveway apron as currently constructed is visually attractive and is not detrimental to the neighborhood or adjacent properties; and, and, WHEREAS, the Plan Commission voted 5 to 3 to recommend approval of the variation; WHEREAS, the Corporate Authorities of the Village of Buffalo Grove, hereby determine and find that the variation is reasonable and appropriate based on the Plan Commission public hearing record and recommendation. 1 • NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. A variation is hereby granted to Section 16.50.080.A.2.b.of the Village Development Ordinance (Title 16 of the Buffalo Grove Municipal Code) to allow the existing driveway apron in the public parkway to remain as constructed at 26 feet in width at the street curbline for the Property commonly known as 528 Buckthorn Terrace, Buffalo Grove, Illinois, and legally described as follows: Lot 10 in Ridgewood III, being a subdivision in the southeast quarter of Section 33, Township 43 North, Range 11 East of the Third Principal Meridian recorded November 29, 1977 as Document 1882925 in Book of Plats, Page 44, in Lake County, Illinois. Section 3. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified.
