2012-0183 -7 -2012 Ordinance No. 2012 - 18 An Ordinance Adopting A Revised Sign Code, Title 14 of the Buffalo Grove Municipal Code WHEREAS, the Village of Buffalo Grove is a Home Rule Unit of local government pursuant to the Illinois Constitution of 1970; and WHEREAS, the Village of Buffalo Grove Sign Code, Title 14 of the Buffalo Grove Municipal Code, was last updated by Ordinance No. 1999 -69 and approved on August 16, 1999; and WHEREAS, the Village of Buffalo Grove deems it in the best interests of the community to adopt a revised Sign Code; and WHEREAS, the purpose of the revised Sign Code is to create the legal framework for signage regulations; recognizing the need to protect the safety and welfare of the public, the need for well maintained and attractive appearance in a community, the need for adequate business identification, and advertising and communication, and the need for promotion of aesthetic values. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, PURSUANT TO ITS HOME RULE POWER: Section 1. The foregoing preamble is hereby incorporated herein. Section 2. The Sign Code of the Village of Buffalo Grove, attached hereto as Exhibit "A ", is hereby approved and adopted and replaces Title 14, Sign Code of the Village of Buffalo Grove Municipal Code. Section 3. Any person violating any portion of this Ordinance shall be subject to the provisions of Chapter 1.08 of the Buffalo Grove Municipal Code. Section 4. This Ordinance shall be in full force and effect from and after its passage, approval and publication. This Ordinance may be published in pamphlet form. The Title creates the legal framework for signage regulations. It recognizes the need to protect the safety and welfare of the public, the need for well maintained and attractive appearance in a community, the need for adequate business identification, and advertising and communication, and the need for promotion of aesthetic values. B. An attractive environment is maintained by quality control, through adequate maintenance and inspection, and by reasonable guidelines formulated to minimize clutter. C. This Title authorizes the use of signs visible from public rights -of -way, provided the signs are: Compatible with their surroundings, pursuant to the objectives of proper design and compatible with zoning regulation; 2. Allowing and promoting optimum conditions for meeting the sign user's needs while at the same time promoting the amenable environment desired by the general public; 3. Designed, constructed, installed and maintained in such a manner that they will not endanger public safety or traffic safety; 4. Legible, readable and visible in the circumstances in which they are used; and 5. Respectful of the reasonable rights of other businesses whose messages are displayed. D. The purpose of this Title is to create a system of sign controls that will: 1. Protect the health, safety, and general welfare; 2. Protect the constitutional right to free speech while not creating a nuisance to neighboring properties and upon the Village as a whole; 3. Support the visual character of the Village; and Village of Buffalo Grove Sign Code - 4 4. Prevent traffic hazards. 14.04.030 Scope This Title does not in any manner regulate the written or depicted content of any individual sign, but only the height, area, location and other similar aspects of signs and sign structures. The scope of this Title addresses and authorizes the use of signs intended to be viewed external to a building and to be viewed by the public provided the signs are: A. Designed, constructed, installed and maintained in such a manner that they do not endanger public safety or traffic safety. B. Legible, readable and visible in the circumstances in which they are used. C. Respectful of the reasonable rights of other businesses whose messages are displayed. 14.04.040 General Sign Design Intent The following are general sign design guidelines that supplement the purpose of this Title and provide direction on the general goals for the function and visual character of signage. A. Legibility of signs: 1. Signs should be adequately legible under the circumstances in which they are primarily seen. The legibility of signs is related to: a. The speed at which they are viewed; b. The context and surrounding in which they are seen; and c. The design, colors and contrast of the sign copy and sign face. 2. The design of the sign including copy, lettering size and style, and colors should logically relate to the predominant speed of traffic which will see it. Signs should legibly convey their messages without being distracting or unsafe to motorists reading them. 3. The number of different lettering styles on a sign or on a series of signs should relate to the overall architectural concept of the property. 4. Lettering and copy should not be crowded onto the surface of a sign or building surface and shall be composed to leave ample space around the copy to preserve legibility. B. Relationship of signs to their surroundings: 1. Signs should not detract from the general appearance and architectural character of their surroundings including streets, buildings and other signs in the area. 2. Signs should not be designed to compete with one another but shall contribute to the composite legibility and attractiveness of streets within the Village. C. Relationship of signs to the building and site locations: Village of Buffalo Grove Sign Code - 5 1. Signs should be an integral architectural element of the building and site locations upon which they are located and their design shall be consistent with, and not detract from, the overall architectural concept of their site. 2. The scale of signs should be compatible and harmonious with the building or site locations and the signs should not be of such a size that they visually overpower the buildings on the site. 3. The outlines shapes of wall signs should be compatible with the building fagade they are mounted on and should limit any disruptions in the architectural order of the building fagade. D. The quality and craftsmanship of signs: 1. Signs should be carefully crafted, durable and consistent with the quality and character of their building and site location. 2. All signs should be regularly maintained and repaired or replaced in response to the aging and weathering of their materials. See also "Logos," Section 14.08.450. 14.08.050 Animated sign "Animated sign" means any sign which includes action or motion. The movement or the optical illusion of movement of any part of the street sign, design, or pictorial segment, including the movement of any illumination or the flashing or varying of light intensity; the automatic changing of all or any part of the facing of a street sign. 14.08.060 Area of copy "Area of copy" means the entire area within a single, continuous perimeter composed of squares or rectangles, which enclose the extreme limits of the advertising message, announcement or decoration on a fascia or wall sign. 14.08.070 Area of sign "Area of sign" means the area of the largest single face of the sign within a perimeter which forms the outside shape including any frame, but excluding the necessary supports or uprights on which the sign may be placed. If the sign consists of more than one section or module, all areas will be totaled. 14.08.080 Awning "Awning" means a cloth, plastic, or other nonstructural covering that either is permanently attached to a building or can be raised or retracted to a position against the building when not in use. 14.08.090 Background area "Background area" means the entire area of a sign on which copy could be placed, as opposed to the copy area, when referred to in connection with wall signs. 14.08.100 Banner sign "Banner sign" means a temporary sign composed of lightweight material either enclosed or not enclosed in a rigid frame, secured or mounted which may allow movement of the sign. Village of Buffalo Grove Sign Code - 9 14.08.110 Banner, Boulevard "Boulevard Banner" means a lightweight sign intended to be hung either with or without a frame, featuring seasons, public events, characters, letters or illustrations applied to plastic or fabric of any kind excluding flags, emblems, and insignia of political, professional, religious, educational, or corporate organizations when such flags, emblems or insignia are displayed for noncommercial purposes. 14.08.120 Building face or wall 'Building face or wall' means all window and wall area of a building in one plane or elevation. 14.08.130 Building frontage "Building frontage" means the linear length of a building adjacent to and facing each public right -of -way or the linear length of each public right -of -way adjacent to and facing the building, whichever is smaller. 14.08.140 Building sign "Building sign" means a sign lettered to give the name of a building itself, as opposed to the name of occupants or services. 14.08.150 Canopy or marquee "Canopy" or "marquee" means a permanent hood, awning or roof -like construction which projects from a building wall for the purpose of providing shelter or protection from the weather. 14.08.160 Canopy sign or marquee sign "Canopy sign" or "marquee sign" means any sign that is fastened, affixed, or attached to and erected parallel to a canopy or marquee in such a manner that the canopy (marquee) becomes the supporting structure or forms the background surface of the sign. 14.08.170 Changeable copy sign, manual "Manual changeable copy sign" means a sign on which copy is changed manually in the field. 14.08.180 Collector streets "Collector streets" means roadways having continuity which carry traffic from local streets to major streets and are indicated on the official map as collector streets. 14.08.190 Construction sign "Construction signs" means temporary signs intended to identify activity on a construction site. 14.08.200 Copy "Copy" means advertising message or announcement. 14.08.210 Corporate Authorities "Corporate Authorities" mean the President and Board of Trustees of the Village of Buffalo Grove then holding office. 14.08.220 Developed Parcel "Developed parcel" means one or more properties or lots upon which significant site improvement, such as utility installations, paving and in many instances, the construction of one or more structures has occurred. Developed Parcel shall include, but is not limited to a shopping center. Included in this group of signs are those designated to guide or direct pedestrians or vehicular traffic to an area or place on the premises of a business building or development by means of a directory designating names and addresses only. 14.08.250 Electrical sign "Electrical sign" means any sign containing electrical wiring which is attached or intended to be attached to an electrical energy source including a solar or wind powered energy source. 14.08.260 Electrical standards Electrical standards shall conform to the electrical code adopted by the Village. 14.08.270 Electronic Message Sign "Electronic Message Sign" means a sign that can be electronically changed by remote or automatic means. The following terms for such electronic message signs shall be defined as follows: A. Dissolve: Signs where static messages are changed by means of varying light intensity or pattern, where the first message gradually appears to dissipate and lose legibility simultaneous to the gradual appearance and legibility of the subsequent message. B. Fade: Signs where static messages are changed by means of varying light intensity, where the first message gradually reduces intensity to the point of not being legible and the subsequent message gradually increases intensity to the point of legibility. C. Scrolling: Signs where the message is changed by the apparent vertical movement of the letters or graphic elements of the message. D. Static: Signs having no motion E. Text: Signs consisting of letters or words only that do not include any animation, effects simulating animation or video. F. Travel: Signs where the message is changed by the apparent horizontal movement of the letters or graphic elements of the message. 14.08.280 Embellishment "Embellishment ". See "Logos," Section 14.08.450. 14.08.290 Erected "Erected" means attached, altered, built, constructed, reconstructed, enlarged or moved, and includes the painting of wall signs, but does not include copy changes on any sign. 14.08.300 Event "Event" means a noteworthy happening, special occasion, public service announcement, or activity taking place at a particular date or time for business and community promotion purposes. A. Private Events shall include those events coordinated or administered by a private property owner including but not limited to a business owner, property manager or private property owner. B. Public Events shall include but are not limited to Buffalo Grove Days, the Buffalo Grove Invitational Fine Art Festival, Buffalo Grove Farmers Market and other events coordinated or sponsored by the Village of Buffalo Grove or other governmental entity. Village of Buffalo Grove Sign Code - 11 14.08.310 Exempt signs "Exempt signs" means signs exempt pursuant to Chapter 14.24. 14.08.320 Face of sign "Face of sign" means the entire area of sign on which copy could be placed 14.08.330 Fascia sign See "Wall sign," Section 14.08.880. 14.08.340 Feather flag "Feather flag" means advertising or promotional sign in the shape of a feather created of cloth, vinyl or other temporary material. Otherwise referred to as an advertising flag, blade flag, wind- featured or bow flag. Following is an example of a Feather flag. 14.08.350 Flashing sign "Flashing sign" means any sign which contains an intermittent or flashing light source, or which includes the illusion of intermittent or flashing light by means of animation, or an externally mounted intermittent light source. Automatic changing signs such as public service information signs or reader boards are classified as changing signs, not flashing signs. 14.08.360 Frontage "Frontage" means the length of the property line of any one premises parallel to and along each public right -of -way it borders. 14.08.370 Grand opening "Grand opening" means the commencement of operation of a new business. A Grand opening is considered to occur if there is a business name change, a change in the type of business, name of business, or activity. A Grand opening may include a re- opening of the business, renovation, business operating under new ownership or change in the type of business or activity. 14.08.380 Ground level "Ground level" means the approved established finished grade on the ground directly below the sign. 14.08.390 Ground sign "Ground sign" means a sign erected on a freestanding frame, mast or pole and not attached to any building. 14.08.400 Height of sign "Height of sign" means the vertical distance measured from the ground level to the highest point of the sign. 14.08.410 Identification sign Village of Buffalo Grove Sign Code - 12 "Identification sign" means a sign which is limited to the name, address and number of a building, institution, person or entity and to the activity carried on in the building or institution, or the occupation of the person. 14.08.420 Illuminated sign "Illuminated sign" means any sign which emanates light either by means of exposed tubing or lamps on its surface, or by means of illumination transmitted through the sign faces. A. Directly illuminated sign. "Directly illuminated sign" means any sign designed to provide artificial light either through exposed lighting on the sign face or through transparent or translucent material from a light source within the sign. B. Indirectly illuminated sign. "Indirectly illuminated sign" means any sign which reflects light from a source intentionally directed upon it. 14.08.430 Incidental sign "Incidental sign" means any sign which serves to identify the business name and a specific location or area to be communicated, including but not limited to, signs designating restrooms, address numbers, hours of operation, entrances to buildings, directions, help wanted, public telephone. 14.08.440 Lintel "Lintel" means the line above the display windows on a store or, if no display windows, a line nine feet from grade. 14.08.450 Logos "Logo" is defined as a symbol(s), picture(s), or other graphic elements arranged in a specific way to represent a certain business, corporation, trade, or profession. 14.08.460 Lot "Lot" when used alone means a zoning lot unless the context of this Title clearly indicates otherwise. 14.08.470 Maintain "Maintain" means to permit a sign, structure or any part of each to continue or to repair or refurbish a sign, structure or any part of either. 14.08.480 Marquee or Canopy "Marquee" or "Canopy" means a rooflike structure of a permanent nature which projects from the wall of a building. 14.08.490 Marquee sign or Canopy sign "Marquee sign" or "canopy sign" means any sign attached to or constructed in or on a canopy or marquee. 14.08.500 Menu Board "Menu Board" means a changeable point -of- purchase advertising display that allows the business to list products and prices. 14.08.510 Message "Message" means the wording or copy on a sign. 14.08.520 Nameplate "Nameplate" means a nonelectric sign identifying only the name and occupation or profession of the occupant or premises on which the sign is located. If any premises includes more than one occupant, Village of Buffalo Grove Sign Code - 13 nameplate refers to all names and occupations or professions as well as the name of the building and directional information. 14.08.530 Neon tubing "Neon tubing" means a tube shaped flexible cylinder containing neon at low pressure to provide luminescence. 14.08.540 Nonconforming sign "Nonconforming sign" means any advertising structure or sign which was lawfully erected and maintained and which fails to conform to all applicable requirements and restrictions of this Title. 14.08.550 Off - premises sign "Off- premises sign" is a sign that advertises goods, products, services or facilitates or directs persons to a different location from where the sign is installed. 14.08.560 Official map "Official map" means the map which is adopted by the Village showing the area included in the comprehensive plan. 14.08.570 On- premises sign "On- premises sign" means any sign identifying or advertising a business, person, activity, goods, products or services located on the premises where the sign is installed and maintained. 14.08.580 Owner "Owner" means the person having sufficient proprietary interest of record in the land sought to be developed to commence and maintain proceedings to plat the same under the statutes of the State of Illinois or under the ordinances of the Village. 14.08.590 Parapet or Parapet wall "Parapet" or "parapet wall' means that portion of a building wall that rises above the roof level. 14.08.600 Person "Person" means any individual, corporation, association, firm, partnership, entity and the like, singular or plural. 14.08.610 Portable sign "Portable sign" means a moveable sign not secured or attached to the ground or surface upon which it is located, but supported by its own frame. The sign shall not be moveable such as a swinging or spinning portable sign. Following is an example of a Portable sign. ?W t 4 f 14.08.620 Premises "Premises" means an area of land with its appurtenances and buildings which, because of its unity of use, may be regarded as the smallest conveyable unit of real estate. 14.08.630 Prohibited sign "Prohibited sign" means those signs which are prohibited in Chapter 14.32. Village of Buffalo Grove Sign Code - 14 14.08.640 Projecting sign "Projecting sign" means a sign, other than a wall sign, which is attached to and projects from a structure or building face. 14.08.650 Public right -of -way "Public right -of -way" is a general term denoting land, property, or interest therein, acquired for or used as a roadway, pedestrian way or bikepath, or other public use. 14.08.660 Public service information sign "Public service information sign" means any automatic changing sign intended primarily to promote noncommercial messages of general interest to the community. 14.08.670 Real estate or property for sale, rent or lease sign Real estate or property for sale, rent or lease sign" means any sign pertaining to the sale, lease or rental of land or buildings. 14.08.680 Residential renovation sign "Residential Renovation Sign" means a sign in a residential zoning district for the purpose of promoting the construction or renovation on site, including but not limited to building addition, roof, fence, landscaping, window, painting and siding. 14.08.690 Roof line "Roof line" means the top edge of the roof or the top of the parapet, whichever forms the top line of the building silhouette. 14.08.700 Roof sign "Roof sign" means any sign erected upon or directly above a roof or on top of or above the parapet of a building. 14.08.710 Rope lighting "Rope lighting" means flexible often transparent cable filled with bulbs which provide illumination. 14.08.720 Rotation sign "Rotation sign" means any sign or portion of a sign which moves in a revolving or similar manner, but not including multi -prism indexing signs. 14.08.730 Shopping Center "Shopping Center" means a group of architecturally unified commercial establishments built on a site which is planned, developed and managed as an operating unit related in its location, size and type of shops to the trade area that the unit serves. The unit provides on -site parking in definite relationship to the total size of the stores. 14.08.740 Sidewalk Sign — see Portable sign. 14.08.750 Sign "Sign" means any identification, description, illustration or illuminated device which is visible from any public place or is located on private property and exposed to the public and which directs attention to a product, service, place, activity, person, institution, business or solicitation, including any permanently installed or situated merchandise or any emblem, painting, banner, pennant, placard or temporary sign designed to advertise, identify or convey information, with the exception of national flags. For the purpose of removal, signs shall also include all sign structures. 14.08.760 Sign structure Village of Buffalo Grove Sign Code -- 15 "Sign structure" means any structure which supports, has supported or is capable of supporting a sign, including decorative cover. 14.08.770 Street "Street" means all property dedicated or intended for public highways, freeways, roadways or street purposes or subject to public easements therefor. 14.08.780 Swinging sign "Swinging sign" means a sign installed on an arm or spar that is not permanently fastened to an adjacent wall or upright pole. Swinging signs are prohibited. 14.08.790 Temporary identification sign "Temporary identification sign" means a sign that is for a limited period of time and which is not permanently affixed. All devices such as feather flags, banners, pennants, flags, (not intended to include flags of any nations, countries or cities) searchlights, and balloons or other air - filled or gas - filled figures, and all signs listed in Chapter 14.20 are examples of a temporary sign, with the exception of Section 14.20.070, Electronic Message Signs. 14.08.800 Temporary window or building sign "Temporary window or building sign" means a sign attached to a window or displayed on the exterior of a building wall in order to direct attention of persons outside the building to a sale of merchandise or a change in the status of the business. 14.08.810 Tenant panel "Tenant panel" is one of multiple signs on a ground sign providing for name recognition of the business or entity of the Developed Parcel. 14.08.820 Trademark or Servicemark A "Trademark" or "Servicemark" means a distinctive sign or indicator used by an individual, business organization, or other legal entity to identify that the products or services to consumers with which the mark appears originate from a unique source, and to distinguish its products or services from those of other entities. A Trademark or Servicemark is designated by the following symbols: • TM (for an unregistered trademark, that is, a mark used to promote or brand goods) • " (for an unregistered service mark, that is, a mark used to promote or brand services) • ® (for a registered trademark) 14.08.830 Under canopy or under marquee sign "Under canopy or under marquee sign" means a sign suspended below the ceiling or roof of a canopy or marquee. 14.08.840 Underwriters' Laboratories "Underwriters' Laboratories," in the United States, means a nonprofit organization which establishes standards for electrical and mechanical equipment and materials and is commonly referred to as "UL." 14.08.850 Uniform Sign Package "Uniform Sign Package means a proposal which must promote design compatibility and be harmonious with the architectural features of multi- tenant buildings or a development, or for a development where there is to be more than one building as part of a Developed Parcel including but not limited to a Shopping Center. 14.08.860 Unlawful sign "Unlawful sign" means a sign which contravenes this Title or which the Administrator may declare as unlawful if it becomes dangerous to public safety, or a nonconforming sign for which a permit required under a previous code was not obtained. Village of Buffalo Grove Sign Code - 16 14.08.870 Use "Use" means the purpose for which a building, lot, sign or other structure is arranged, is intended, designed, occupied or maintained. 14.08.880 Wall sign "Wall sign" means a sign attached to or erected against the wall of a building with the face parallel to the plane of the building wall. 14.08.890 Window sign Window sign means a sign installed on a window for the purposes of viewing from outside the premises. This term does not include merchandise located in a window. 14.08.900 Zoning lot "Zoning lot" means an area with fixed boundaries which is or may be occupied by a use, building or buildings, including the open spaces required by this Title. Village of Buffalo Grove Sign Code - 17 Chapter 14.12 PERMITS Sections: 14.12.010 Permit Required 14.12.020 Permit Application Procedure 14.12.030 Fees 14.12.040 Issuance 14.12.050 Appeals 14.12.060 Inspection 14.12.070 Effect of issuance 14.12.080 Sign Contractor Registration Required 14.12.090 Electrical Elements 14.12.010 Permit Required Except or as otherwise provided in this Title it is unlawful for any person to erect, construct, enlarge, move, convert or alter in any structural or visual way any sign in the Village, or cause the same to be done, without first obtaining a sign permit. These directives shall not be construed to require any permit for cleaning and other normal maintenance or repair of a sign structure for which a permit has previously been issued, so long as the sign or sign structure is not modified in any way. If the sign is not fully erected within 180 days, the permit is void. 14.12.020 Permit Application Procedure A. Permit Application. Application for a permit shall be accompanied by such information as may be required to assure compliance with all appropriate ordinances and regulations of the Village, including, but not by way of limitation: Name and address of the owner of the sign; cost of the sign, sign dimensions and names, address and telephone numbers of contractors. 2. Clear and legible drawings with description definitively showing location of the sign which is the subject of the permit and all other existing signs whose construction requires permits, when such signs are on the same premises or zoning lot; 3. Drawings showing the dimensions, colors, construction supports sizes, electrical wiring and components, materials of the sign and method of attachment and character of structural members to which the attachment is to be made. The design, quality, materials and loading shall conform to the requirements of the Village. If required, engineering data shall be supplied on plans submitted and certified by a duly licensed engineer; 4. Permit fees as specified in Section 14.12.030. B. Permit Approval Procedure. Approval of sign permits shall be governed by the following procedures and requirements: Following receipt of required permit application materials, a review shall be undertaken of the proposed signage for compliance with the Village's Appearance Plan, this Title and the ordinances of the Village. 2. Review shall be undertaken by the Administrator and Village Manager or designee in accordance with the Village's Appearance Plan and this Title. The Administrator shall Village of Buffalo Grove Sign Code - 18 approve all sign permits which meet the scope and intent of this Title and which require no variances from the provisions of this Title. If a sign permit is denied, appeal may be made as provided in Section 14.12.050. 3. The Administrator shall approve all sign permits for Special Signs which meet the scope and intent of this Title as provided in Chapter 14.20, and which require no variations from the provisions of this Title. If a sign permit is denied, appeal may be made as provided in Section 14.12.050. 4. Where sign permits require variance to the provisions of this Title, a complete review of the proposed signage shall be made and transmitted with recommendations thereon to the Appearance Review Team and the Zoning Board of Appeals. 5. The Appearance Review Team shall review all signs that are required for a variance for compliance with the Appearance Plan. After review, a written recommendation shall be forwarded to the Zoning Board of Appeals. 6. The Zoning Board of Appeals shall hear requests for variances in accordance with Chapter 14.40 of this Title and will forward a recommendation to the Village Board. If a sign permit requiring a variance is recommended by the Zoning Board of Appeals to the Village Board and subsequently approved by the Village Board, the Administrator shall issue a permit. If a sign permit requiring a variance is denied by the Zoning Board of Appeals, appeal may be made as provided in Chapter 14.40 of this Title. C. Permission to install required. No person shall erect, construct or maintain any sign upon any property or building without the written consent of the owner, or their authorized representatives. 14.12.030 Fees A. Fees shall be as specified in the following schedule: 1. Wall signs, non - illuminated, $50.00 plus $.25 cents per square foot of larger face, plus $50.00 plan review fee; 2. Wall signs, illuminated, $50.00 dollars plus $.25 cents per square foot of larger face $50.00 plan review fee, plus a $50.00 electrical fee shall apply; 3. Ground signs, $75.00 plus $.25 cents per square foot of larger face, plus $50.00 plan review fee. If internally illuminated, a $50.00 dollar electrical fee shall apply; 4. Banners, pennants, searchlights, balloons or gas - filled figures and Grand Opening signs, $50.00; 6. Temporary identification sign, $50.00; 7. Permit renewal for special signs, $50.00; 8. Tenant panel sign, $50.00; 9. For Rent, Sale, Lease signs, no fee for signs 6 square feet or less. Over 6 square feet, the price shall be $75.00 plus $.25 cents per square foot of larger face plus a $50.00 plan review fee. A $50.00 annual renewal fee will be charged for these signs. Village of Buffalo Grove Sign Code - 19 10. An awning sign shall be priced as a wall sign; 11. All other signs requiring a permit, that are not combined with additional sign fees, shall be required to pay a fee of $50.00. B. For two -sided signs, the fee shall relate to only one face of the sign but be calculated on whichever is the largest exposed face of the sign. C. When any sign is hereafter erected, placed, installed, or otherwise established on any property prior to obtaining permits as required by this Chapter, the fees specified hereunder shall be doubled, but the payment of such double fee shall not relieve any person from complying with the provisions or from penalties prescribed in this Title. 14.12.040 Issuance A. A permit shall be issued for the erection, alteration or relocation of a sign within the Village when an application therefore has been properly made and approved, and the sign complies with all appropriate ordinances of the Village. B. The Village may, in writing, suspend or revoke a permit issued under the provisions of this Chapter whenever the permit is issued on the basis of a misstatement of fact or fraud. When a sign permit is denied, the Village shall give written notice of the denial to the applicant, together with a brief written statement of the reasons for the denial. 14.12.050 Appeals A. Any person aggrieved by the decision of the Administrator in regard to the denial of a sign permit shall have the right to appeal to the Village Manager or designee. Such appeal shall be taken by filing with the Village, within 15 days after notice of denial, a written statement setting forth the grounds for appeal. The Village Manager or designee may approve, overrule or modify the decision. B. Any person aggrieved by the decision of the Village Manager or designee shall have the right to appeal to the Zoning Board of Appeals. Such appeal shall be taken by filing with the Village Manager or designee, within 15 days of notice of denial, a written statement setting forth the grounds for appeal. The Zoning Board of Appeals may approve, overrule or modify the decision of the Village Manager or designee. 14.12.060 Inspection A. Inspections. The owner or person erecting, altering or relocating a sign shall obtain the required inspections. Such inspection will verify proper location and compliance with all approved specifications and conditions of the permit. B. Maintenance. Every sign in the Village, including but not limited to those signs for which no permits or permit fees are required, shall be maintained in good condition at all times. The Village may require painting, repair, alteration or removal of signs which become dilapidated or are abandoned, or which constitute physical hazard to the public safety. C. Signs Declared Unlawful. A sign may be declared unlawful if it endangers public safety. Any such declaration shall state the reasons that the sign constitutes a safety hazard to the general public. 14.12.070 Effect of Issuance Village of Buffalo Grove Sign Code - 20 No permit for a sign issued hereunder shall be deemed to constitute permission or authorization to maintain an unlawful sign nor shall any permit issued hereunder constitute a defense in an action to abate an unlawful sign. 14.12.080 Sign Contractor Registration Required No person, firm, partnership, corporation, or other entity shall engage as a sign contractor or sign erector that requires a building permit in the Village of Buffalo Grove, unless they possess a current Contractor Registration in the Village of Buffalo Grove as set forth in Title 15 of the Buffalo Grove Municipal Code. 14.12.090 Electrical Elements All wiring, fittings, and materials used in the used in the construction, connection, and operation of electrically illuminated signs shall be in accordance with the provisions of the Village's Building Code and Electrical Code. An Underwriter's Laboratories label, or an equivalent certification, shall be affixed to every electrical component incorporated into a sign. Village of Buffalo Grove Sign Code - 21 Chapter 14.16 LOCATION AND PLACEMENT Sections: 14.16.010 Residential Districts 14.16.020 Office and Research District 14.16.030 Business Districts 14.16.040 Industrial District 14.16.050 Uniform sign package 14.16.060 Ground signs 14.16.070 Wall signs 14.16.080 Canopy or marquee signs 14.16.090 Awnings 14.16.100 Directional signs 14.16.110 Incidental signs 14.16.120 Embellishments 14.16.130 Seasonal banners 14.16.140 Temporary identification signs 14.16.150 Other Temporary signs 14.16.160 Interior management information signs 14.16.170 Portable signs 14.16.010 Residential Districts Within any residential district, signs or nameplates are permitted as follows: A. In Residential Zoning Districts R -E to R -7, for each single - family home or duplex house, one nameplate not exceeding a combined area of 2 square feet for each occupancy. Said nameplate shall not be subject to the permit requirements of this Title; B. In Multiple - Family Dwelling Districts R -8 and R -9, for multiple - family uses, one identification sign for each developed parcel, not exceeding 32 square feet in area and subject to normal permit requirements; C. For nonresidential uses, one identification sign for each developed parcel not exceeding a total of 16 square feet in area for all signs and subject to all permit requirements; D. Identification signs, bulletin boards and other similar structures for governmental agencies which may be regulated by the Village are subject to approval thereof by the Administrator and all permit requirements; E. All signs shall be placed flat against a building or designed as part of an architectural feature thereof except that signs may be detached if they do not exceed a height of 5 feet nor project into any required building setback area. 14.16.020 Office and Research District Within the Office and Research Zoning District, signs are subject to the following: A. One identification sign for each developed parcel not to exceed a total of 32 square feet in area for all displays; B. All signs shall be placed flat against a building or designed as part of an architectural feature thereof. Signs may also be detached if they do not exceed a height of 8 feet nor project into any required building setback area. Village of Buffalo Grove Sign Code - 22 C. Any occupancy within another occupancy shall not be allowed any ground or wall sign. 14.16.030 Business Districts Within the Business Districts B -1 to B -4, signs are permitted as follows: A. One ground sign for the uses of the developed parcel; provided, however, that all limitations of Chapter 14.16 are applicable; B. No ground sign shall be located nearer than 10 feet to the property line; C. One wall sign for each occupancy within the developed parcel. Such sign shall not exceed a total area of 3 square feet of copy for each lineal foot of occupant's store frontage or that area of copy permitted in Section 14.16.070, whichever is the lesser. If such occupancy is on a corner, one wall sign will be permitted for each face. If the building includes a canopy, each occupant will be permitted one canopy sign in conformity with Section 14.16.080. D. Any occupancy within another occupancy shall not be allowed any ground or wall sign. E. No ground sign shall exceed the height, area or setback established in Section 14.16.060. F. Each outlot in a Business zoned district may be permitted one Menu Board per drive thru for food establishments. The Menu Board may be changed at any time provided that the copy only features products sold at the place of business. The size of the Menu Board shall be limited to 50 square feet, including all attachments. Electronic screens to display point of sale information are exempt from Electronic Message Board requirements as set forth in 14.20.070. 14.16.040 Industrial District Within the Industrial District, signs are permitted as follows: A. One ground sign for each occupant within the developed parcel; provided, however, that all limitations of Chapter 14.16 are applicable; B. One wall sign indicating for each occupancy within the developed parcel. Such sign shall not exceed a total area of 3 square feet of copy for each linear foot of building occupancy or that area of copy permitted in Section 14.16.070, whichever is the lesser. If such occupancy is on a corner, one wall sign will be permitted for each face. If the building includes a canopy, each tenant will be permitted one under canopy sign in conformity with Section 14.16.080; C. No ground sign shall exceed the height or area established by Section 14.16.060; D. No ground sign shall be located nearer than 10 feet to the property line. E. Any occupancy within another occupancy shall not be allowed any ground or wall sign. 14.16.050 Uniform sign package A. The builder, developer, property owner or management company of all parcels involving multi - tenant or multiple buildings for development or redevelopment shall submit a Uniform Sign Package. All signs proposed must promote design compatibility and be harmonious with the architectural features of the building or development, or for a development where there is to be more than one building as part of a Developed Parcel. Village of Buffalo Grove Sign Code - 23 A Uniform Sign Package must be approved by the Village before any permits for individual signs conforming to such sign program shall be issued. B. Existing signs that were legally installed with an approved sign permit may remain until they are changed due to a tenant change, cabinet change or structural change to the sign. New signs installed as replacement must comply with the approved Uniform Sign Package. C. Proposals for Uniform Sign Packages shall be reviewed in accordance with the Village of Buffalo Grove Appearance Plan as part of a Minor Review which includes Village staff, including but not limited to representatives from the Plan Commission and Zoning Board of Appeals. A Village report and recommendation pertaining to the review shall be forwarded to the Plan Commission and subsequently the Village Board for final approval. A variation and appeal may be pursued in adherence to Chapter 14.40 herein. D. Any Deviations to the Uniform Sign Package shall be reviewed in accordance with the Village of Buffalo Grove Appearance Plan to include a review with representatives from the Zoning Board of Appeals. A variation or appeal may be pursued in adherence to Chapter 14.40 herein. 14.16.060 Ground signs A. Number of Ground Signs. One ground sign is permitted for each developed parcel unless provided otherwise in this Title; provided, that no such sign may be closer than 250 feet to any permanent ground sign within the Village on the same side of the street. One additional ground sign may be erected for each additional 500 feet of street frontage in excess of the first 300 feet of street frontage abutting the developed portion of said parcel. B. Area of Ground Signs. The maximum area of a ground sign shall not exceed 120 square feet for each face of a double -faced sign or for the sole face of a single -faced ground sign. The maximum permitted area of ground signage for a given parcel shall be determined as follows. For parcels with street frontage of less than 800 feet, one sign with a maximum area as set forth below for the first 300 feet of street frontage or actual street frontage if less than 300 feet. For parcels with street frontage of 800 or more, the maximum permitted area of ground signs shall be determined by dividing the total frontage abutting a developed parcel into a number of segments equal to the number of signs permitted under subsection A of this section. Where a developed parcel fronts on more than one street, excluding alleys and service ways, said parcel may accumulate frontage from the major streets and collector streets abutting the developed parcel to meet the requirements of subsection B of this section. D. No ground sign may exceed in height the distance measured from any portion of the sign to the nearest property line; provided, however, that the maximum height of any ground sign or sign structure shall be 15 feet from ground level or top of foundation whichever is less. Village of Buffalo Grove Sign Code -- 24 E. A ground sign must be set back from the public right -of -way from which it is intended to be viewed the same distance as any setback line required in any residentially zoned property facing the same public right -of -way within 100 feet from the sign. This provision affects only signs on commercial and industrial premises on the same block and on the same right -of -way as residential premises. F. Where a ground sign projects over a vehicular traffic area, such as driveway or parking lot aisle, the minimum clearance between the bottom of the sign and the ground shall be 14 feet. G. All ground signs are to be landscaped around the base in accordance with a landscape plan as approved by the Village 14.16.070 Wall signs The following provisions apply to all wall signs except those provided for in Section 14.16.060: A. Sign area refers to the area of the background of the sign with the exception of individual letters. The letters must fit into a rectangle with the length of the rectangle being not greater than one - third of the occupants store frontage, and the height of the rectangle being not greater than one - half of the portion of the building above the lintel. 1. CATEGORY 1: Where a business has no ground or roof sign on the same premises, 33% of the wall sign background may be used for copy of enclosed sign; 2. CATEGORY 2: Where a business has its own ground sign but no roof sign, 20% of the wall sign background area may be used for copy of enclosed sign. B. Where individual mounted letters are used without a sign background, the foregoing percentages will apply, but will be computed on the area of the total facade between the lintel and the floor level of the floor above a multi- storied building. C. The frontage factor is relative to each tenant's building frontage facing each public right -of -way, excluding alleys and service ways. D. Premises fronting on more than one public right -of -way may not combine permissible signs for one frontage with another frontage for the purpose of placing the combined area of signs on one frontage. E. Each business is permitted one wall sign over their primary entrance when a building does not face public right -of -way, and no other wall sign is permitted. Such signs shall be subject to the following requirements: A. Area of copy shall be no more than 3 square feet per linear foot of canopy front and sides. Copy area or any part of copy area allowed for one facing cannot be added to that allowed for other facings, subject to minimum height limit of 9 feet from the sidewalk. Copy may be installed above, on the face of, or below the canopy proper; provided, that where such sign is installed above or below, copy area will be computed on the total of the sign face and the canopy apron proper. B. On places of public entertainment including but not limited to theaters, arenas and meeting halls, where one or more changeable copy signs are allowed, the copy area allowance will be 5 square feet per linear foot of canopy with a maximum total height limit of no more than 5 feet at any point. C. In business and industrial districts the maximum copy area of canopy signs shall be no more than 2 square feet subject to the same requirements as subsection A of this section. D. Signs attached to the underside of the canopy shall have a copy area of no greater than 6 square feet, with a maximum letter height of 9 inches, subject to a minimum clearance of 8 feet from the sidewalk and shall be mounted as nearly as possible to right angles of the building face. 14.16.090 Awnings A sign, identification emblem, insignia, initial or other similar feature not exceeding an area of 8 square feet, may be painted, placed or installed on any awning; provided, that any sign, emblem, insignia or other such similar item shall comply with all other provisions of this Title. Village of Buffalo Grove Sign Code - 26 14.16.100 Directional sign A maximum of 2 Directional signs are permitted for each driveway. Area of each sign may not exceed 12 square feet with a maximum permitted height of 4 feet. Directional signs shall be created with colors compatible with the building or structure. Visitor Parking 14.16.110 Incidental sign ABC Business l� Incidental signs are allowed at approved locations by the Administrator. Incidental signs shall be created with colors compatible with the building or structure. Each Incidental sign shall be less than 2 square feet in surface area, and shall be of a noncommercial nature, intended primarily for the convenience of the public. ALL SHIPPING & RECEIVING IN REAR 14.16.120 Logos Logos shall be permitted. 14.16.130 Seasonal Banners EMPLOYEE ENTRANCE Seasonal Banners, or Boulevard banners, are permitted and may be changed seasonally subject to the requirements noted herein and provided the size of the permitted Banners and the hardware are not changed. Seasonal Banners are signed use for a seasonal, holiday or civic event. A. Location and dimensions 1. Seasonal Banners are permitted only as a temporary sign for developments. 2. A Seasonal Banner shall only be displayed on a light pole and shall not extend higher than the light pole. The lower bracket used to display the banner must be installed at a height of at least 8 feet in an area accessible to pedestrians; or 12 feet in an area accessible to vehicles. 3. Seasonal Banners shall only be displayed on privately owned light poles located in the parking lots or along the driveways of the center. In no instance shall a Seasonal Banner be installed closer than 10 feet from the property line or extended between 2 light poles. 4. Display brackets must be removed when not in use, or folded against the light pole. Village of Buffalo Grove Sign Code - 27 B. Number 1. Each individual Seasonal Banner shall be considered a single Seasonal Banner for purposes of this section. Two Seasonal Banners displayed on a single light pole shall be considered 2 separate Seasonal Banners. No more than 2 Seasonal Banners shall be displayed on a single light pole and in no instance shall a Seasonal Banner be installed closer than 100 feet from any other light pole on which a Seasonal Banner(s) is installed. 2. Seasonal Banners may not exceed 32 square feet per face and shall have no more than 2 sign faces. Only the area of the actual Seasonal Banner itself shall be counted in determining the area of the sign face. C. Permits and Inspections 1. A permit shall be required for the installation of Seasonal Banners. 2. Seasonal Banners which display a seasonal /holiday message or event must be removed within 15 days after the passing of the event or season /holiday. 3. All Seasonal Banners must be maintained in a safe condition. Seasonal Banners which become illegible, damaged or otherwise in poor condition, must be removed. 14.16.140 Temporary identification signs A. A temporary identification sign for a new business shall be allowed subject to the following: No temporary business sign shall exceed the allowable copy area, size or setback requirements applicable to a permanent business sign. Every new temporary identification sign for a new business shall be removed within 60 days after installation or immediately after installation of the permanent business sign, whichever occurs first. An extension may be granted for one additional period up to an additional 60 days upon written request and approval from the Administrator. B. Temporary Replacement Identification Signs. When construction activities or exterior facade renovations to an existing building require the temporary removal of existing permanent signs, temporary identification signs shall be allowed as permitted in subsection A. In addition to the requirements in subsection A, the words "Open During Construction" shall be permitted on temporary replacement identification signs. Such temporary sign shall be removed immediately after installation of the permanent sign or within 14 days after completion of construction activities or exterior facade renovations, whichever first occurs. 14.16.150 Other Temporary signs Temporary signs including but not limited to Construction Signs, Event Signs, and For rent, sale or lease signs can be found in Chapter 14.20, Special Signs. 14.16.160 Interior management information sign In every building containing leasable office space, a sign shall be conspicuously placed in the lobby or entranceway of said building which shall indicate the name, address and telephone number of the leasing agent and the management company. Village of Buffalo Grove Sign Code - 28 14.16.170 Portable signs Portable signs are permitted subject to the following requirements: A. A permit is required for a Portable sign which permit shall be for a period not to exceed one year. The permit is renewable as approved by the Administrator. B. A Village permit is subject to approval from the property manager and /or property owner. C. A Portable sign shall be permitted only in the business zoned districts as set forth in the Village's Zoning Ordinance. D. Portable signs shall be placed on private property subject to the property owner's approval and shall be placed adjacent to the building. If placed on private sidewalk, the sign shall not reduce the open portion of any sidewalk to less than 36 inches and shall not interfere with any accessible route. E. One Portable sign shall be permitted per business establishment. An additional portable sign shall be permitted if the front elevation of the business exceeds 300 feet. A Portable sign shall only be displayed during business hours and must be removed at the close of each business day. F. A Portable sign shall not exceed 4 feet in height and the sign area shall not exceed 6 square feet per sign face with a maximum of 2 faces per sign. G. Portable signs shall be properly mounted for safety purposes. H. Portable signs shall be professionally created and weather resistant. Village of Buffalo Grove Sign Code - 29 Chapter 14.20 SPECIAL SIGNS Sections: 14.20.010 Subdivision development signs 14.20.020 Signs for events 14.20.030 Grand opening 14.20.040 Construction signs 14.20.050 Residential renovation sign 14.20.060 For rent, sale or lease signs 14.20.070 Electronic message signs 14.20.080 Manual changeable copy signs 14.20.090 Roof signs 14.20.010 Subdivision development signs The Village may issue a permit for a sign in any zoning district in connection with the marketing of lots or structures in a subdivision, subject to the following requirements: A. Time Limit. Such permits may be issued for a period not to exceed one year. A permit may be renewed for additional periods of up to one year for each permit upon written application at least 30 days prior to its expiration. Upon the sale (transfer of title) of the lot upon which the sign is located, the sign shall be removed. B. Type of Sign. Signs as used in this Chapter refer to all types of signs except signs exempted under Chapter 14.24 and those prohibited under Chapter 14.32. A. Legend. The sign may shall identify the site which has a construction project actively underway on the property where the sign is located. B. Location. No subdivision development sign shall exceed in height the distance measured from the property line or be less than 10 feet from the property line. C. Size. The area of the sign shall not exceed 8 feet in width, including supports; 12 feet in height, measured from established grade to the top of the sign; and 64 square feet in area of copy. 14.20.020 Signs for events Signs for events, which include but are not limited to banners, pennants, searchlights, balloons or other gas filled figures, are subject to the following requirements: A. B. C. D. E. A permit from the Village is required for Signs for events. Landlord approval is required for all Signs for event on leased properties. A maximum of 4 events per business are permitted for a maximum of 60 days total annually for each developed parcel. The size of a Sign for event sign shall be limited to no greater than 4 x 8 feet or 32 square feet in area. Signs in excess of 32 square feet in area may be erected in promotion of a public parade, public event or public celebration for a period not to exceed 15 days. Signs shall require a permit and Village of Buffalo Grove Sign Code - 30 shall be approved by the Administrator. Signs shall be removed no more than 2 days after the Event. F. Balloons may be utilized but not aggregated or grouped together in excess of 27 cubic feet and in no event shall have a cross - sectional dimension greater than 3 feet. G. Event banners shall be counted against any signs /banners allowed per the applicant's Amusement Activity application as set forth in Chapter 5.08 of the Buffalo Grove Municipal Code. 14.20.030 Grand opening Grand opening signs are allowed subject to requirements set forth within Section 14.20.020 of this Title. 14.20.040 Construction signs One construction sign per construction project not exceeding 16 square feet in existing residential developments or 64 square feet in sign area in new residential developments or 64 square feet in commercial or industrial districts is permitted. Signs shall be confined to the site of construction and shall be removed 5 days after substantial completion of construction as determined by the Village. A Construction Sign or resident developments shall be consistent in size with commercial or industrial districts size limitations. 14.20.050 Residential renovation sign One Residential Renovation Sign is permitted on private property in residential districts. Signs shall be a maximum of 16 square feet and shall be removed within 5 days of substantial completion of the construction, as determined by the Village. 14.20.060 For rent, sale or lease signs A. "For Rent, Sale or Lease" signs in any zoning district are exempt from Sections 14.12.010, 14.12.030, 12.12.060 (except subsection C), and 14.12.080 provided that they do not exceed 6 square feet, are located on private property, and are limited to one sign per parcel. B. The Administrator may issue a permit for a "For Rent, Sale or Lease" sign on commercial property in any zoning district provided that it does not exceed 24 square feet. The sign may be renewed by the Administrator on an annual basis for an annual fee of $50.00. C. A permit may be issued for all other "For Rent, Sale or Lease" sign in any zoning district, subject to the following requirements: 1. Time Limit. Such permits may be issued for a period not to exceed one year. A permit may be renewed for one additional period of up to 12 months for each permit upon written request from the landlord at least 30 days prior to the expiration of the current permit. 2. Location. A "For Rent, Sale or Lease" sign shall not exceed in height the distance measured from the property line, attached to or within 10 feet from an approved ground sign. 3. Height. A "For Rent, Sale or Lease" sign shall not exceed 10 feet in height. 4. Number and Size. Only one sign shall be allowed per frontage and limited in size as shown in the table below. The maximum permitted area of a "For Rent, Sale or Lease" sign for a given parcel shall be determined as follows: Village of Buffalo Grove Sign Code — 31 TABLE INSET: Property Frontage (Lineal Feet) Maximum Permitted Area of Sign (Square Feet) Less than 200 16 Less than 400 32 Less than 600 48 Less than 800 64 5. Materials. Signs shall be constructed with a minimum of one -half inch material suitable for outdoor use. Supports shall be a minimum of 4 inch by 4 inch painted wood posts or other type of support as approved by the Administrator. All exposed portions of the sign, not containing copy, shall be painted. 14.20.070 Electronic message signs A. Electronic menu boards used at drive - through lanes shall comply with the requirements set forth in Section 14.16.030. F. B. Electronic vehicle fuel station signs displaying fuel prices are permitted subject to the following requirements: 1. The sign shall not exceed 60 square feet. 2. The electronic message area shall not exceed 12 square feet in surface area. 3. Not more than 3 fuel products shall be displayed per sign face. Each sign face shall be limited to fuel product pricing only. 4. Digits shall not exceed 12 inches in height and are limited to 3 digit numerical displays, not including a 9/10" fractional digit or decimal point. An example is identified below. 7 2 3 nlr 9211 5. Colors shall be limited to a maximum of two colors on a black background. 6. Each electronic sign face shall include a circuit board equipped with light sensors per side to automatically adjust brightness based on ambient light level. 7. The sign shall be turned off at the close of daily business operating hours, unless such vehicle fueling station operates 24 hours per day. 8. All electronic images must remain static. No flashing, blinking, chasing, animations or other attention seeking effects shall be permitted. C. Electronic signs on windows are allowed only by variation. Village of Buffalo Grove Sign Code - 32 D. Electronic message signs for ground or wall signs are allowed only by variation. Ground and wall electronic message signs shall conform to the following requirements: 1. Messages and Text a. Shall be limited to a display of on- premise activity only, plus date, time, temperature, and community event information. b. Transition from one message to another shall be instantaneous, without movement or other transition effects between messages. c. Text shall be uniform in color, appearance, and a maximum of 9.25 inch character text any one time. d. Messages, including single and multiple lines of text, shall not change more frequently than once every 20 seconds. 2. Display and Brightness a. Signs shall not display any video, animation or moving pictures or simulate any movement or the optical illusion of movement of any part of the sign text, design or pictorial segment, including the movement of any illumination or the flashing or varying of light intensity. b. The digital display portion of a sign shall be a single color. The sign background shall be a single color of black. C. The Electronic message sign shall be equipped with both a programmed dimming sequence as well as an additional overriding mechanical photocell that adjusts the brightness of the display to the ambient light at all times of day. Such programming and mechanical equipment shall be set so that the Electronic message sign, at night or in overcast conditions, will be no more than 40% of the daytime brightness level. 3. Operation and Use a. Signs shall be extinguished at the close of business to which the Electronic message sign relates. Signs shall be extinguished from 11:00 pm to 6:00 a.m., except for businesses licensed to operate later than 11:00 p.m. b. Signs readily viewable to the general public shall be equipped to override commercial messages for emergency situations such as an "Amber Alert" or other such acute public emergencies, but such "override" authority for public emergencies shall not exceed 48 total hours within any 2 week period, unless approved by the property owner. The owner of the Electronic Message Sign shall cooperate with the Village of Buffalo Grove in order to allow the Village of Buffalo Grove to exercise its override authority. 4. Location and Design a. Electronic message sign shall not face a single family zoned district or use. Village of Buffalo Grove Sign Code - 33 b. The Electronic message sign shall be secondary to the principal ground sign and shall be located on the same premises as the principal building. c. No Electronic message sign shall be located within 500 feet of another Electronic message sign, nor shall it share the structure of any other reader board or changeable copy sign. d. Signs shall be located in a minimum 400 square foot landscape area integrated into the overall site design, including the appropriate use of berming, landscaping, and decorative hardscape. e. Signs shall be mounted in a monument -style base that is at least as wide as the sign face, a minimum of 2 feet in height, and composed of a natural masonry finish such as brick or stone matching the principal building. Alternative materials consistent with the principal building may be considered by the Village. f. Each sign face shall be antiglare and shall not exceed a total of 25 square feet. The square footage of each face shall be included in the calculation of the total area of all signage allowed for the property. 14.20.080 Manual Changeable copy signs All manual changeable copy signs are not allowed without a variance. 14.20.090 Roof signs Roof signs are not allowed without a variance. 14.20.100 Off - premise signs Off - premise signs are not allowed without a variance. Chapter 14.24 EXEMPTIONS Sections: 14.24.010 Designated 14.24.010 Designated The following signs are exempt from Sections 14.12.010, 14.12.030 and 14.12.060 (except subsection C): A. Directional or Incidental Signs. Signs which provide direction or instruction and are located entirely on the property to which they pertain, do not exceed 4 square feet in area, are not illuminated and do not have any electrical components,. Examples of such signs are parking lot entrance and exit signs, signs identifying rest rooms, public telephones and walkways. B. Flags. 1. A maximum of 3 flags are permitted for each building on a Developed Parcel. Village of Buffalo Grove Sign Code - 34 2. Each flag pole shall be a maximum of 50 feet in height. 3. Each flag shall be a maximum of 100 square feet. C. Governmental Signs. Governmental signs for control of traffic, regulatory purposes and to provide government public service announcements, including but not limited to, street signs, danger signs, railroad crossing signs, and signs of public service companies indicating danger and aids to service or safety which are erected by or on the order of a public officer in the performance of his or her public duty; D. House Numbers and Name Plates and Plaques. House numbers, name plates and plaques not exceeding 2 square feet in area for each residential building; E. Interior Signs. Signs located within the interior of any building or stadium, or within any enclosed lobby or court of any building, and signs located within the inner or outer lobby that are not visible from the public right -of -way or not intended to be visible from the exterior of the building. This does not however, exempt such signs from the structural, electrical or material specifications as set forth in this Title; F. Memorial Signs. Memorial signs or tablets, names of buildings and date of erection when cut into any masonry surface or inlaid so as to be part of the building or when constructed of bronze or other incombustible material; G. No- Trespassing or No- Dumping Signs. No- trespassing or no- dumping signs not to exceed 1 '/z square feet in area per sign, and not exceeding 4 in number per lot, except that special permission may be obtained from the Administrator for additional signs when necessary; H. Notice Bulletin Boards. Notice bulletin boards not over 24 square feet in area for medical, public, charitable or religious institutions where the same are located on the premises of said institution; I. Occupant Signs. One sign for each dwelling unit not to exceed 2 square feet in area indicating the name and /or address of the occupant; J. Political Signs. Political signs announcing political candidates seeking public office, political parties, and /or political and public issues contained on election ballots may be placed on private property, subject to the following: 1. Number. There shall be no limit on the number of political signs for each zoning lot. 2. Area. The total area of all political signs upon any zoning lot shall not exceed 32 square feet in area. 3. Location. No political sign shall be placed within the public right -of -way. No political sign shall be placed on public property except as permitted by the Illinois Election Code (10 ILCS 5/1 -1 et seq. ). 4. Height. Political signs shall not be of a height to block any line of sight of adjacent vehicular traffic. K. Public Notices. Official notices posted by public officers or employees in the performance of their duties; Village of Buffalo Grove Sign Code - 35 L. Public Signs. Signs required or specifically authorized for a public purpose by any law, statute or ordinance, which may be of any type, number, area, height above grade, location, illumination, or animation, required by the law, statute or ordinance under which the signs are erected; M. Real Estate Signs. 1. One real estate sign on any lot or parcel, provided such sign is located entirely within the property to which the sign applies, is not directly illuminated and does not exceed 8 square feet in area; 2. Real estate open house signs (in addition to real estate signs in subdivision 1 of this subsection and notwithstanding Section 14.16.150) on any lot or parcel; provided, that each sign is not directly illuminated and does not exceed 6 square feet in area. Such signs are only allowed on Saturdays and Sundays between the hours of 12:00 p.m. to 6:00 p.m. and on Wednesdays between the hours of 9:00 a.m. and 2:00 p.m.; N. Symbols or Insignia. Religious symbols, commemorative plaques or identification emblems of religious orders or recognized service organizations; provided that no such symbol, plaque or identification emblems shall exceed four square feet in area; O. Temporary Signs. Temporary signs not exceeding 32 square feet in area pertaining to drives or events of civic, philanthropic, educational or religious organizations; provided, that said signs are posted only during said drive or no more than fifteen days before said event and are removed no more than two days after an event; P. Warning Signs. Signs warning the public of the existence of danger, but containing no advertising material, of a size as may be necessary, to be removed upon subsidence of danger; Q. Residential Districts. Signs on propertie s noncommercial information that contains following: zoned within a Residential District which display constitutionally protected content are subject to the 1. The total area of all signs upon any residential zoned lot shall not exceed 32 square feet in area. 2. No sign shall be placed within the public right -of -way. No sign shall be placed on public property except as permitted by the Illinois Election Code (10 ILCS 5/1 -1 et seq.). 3. Signs shall not be of a height to block any line of sight of adjacent vehicular traffic. R. Window signs 1. In the Industrial District and Office and Research District window signs shall not cover the window surface area by more than 10% of each elevation. 2. In Business Districts, no window surface shall be covered by any type of window sign regardless of the material, in excess of 40% of the total window surface area of each elevation. Window signs which have an electric connection used to display static information are allowed subject to this Title. Chapter 14.28 NON - CONFORMING SIGNS Sections: 14.28.010 Determination and notification 14.28.020 Eligibility 14.28.030 Loss of status 14.28.040 Maintenance and repair 14.28.050 Replacement of nonconforming signs 14.28.010 Determination and notification Upon determination that a sign is nonconforming, the Administrator shall use reasonable efforts to notify either personally or in writing the user or owner of the property on which the sign is located of the following: A. The sign's nonconformity; and Village of Buffalo Grove Sign Code - 37 B. Whether the sign is eligible for characterization either as a nonconforming or unlawful sign. 14.28.020 Eligibility for legal nonconforming sign Any sign which does not conform with the provisions of this Title is eligible for characterization as a nonconforming sign and is allowed, provided it meets one of the following requirements: A. The sign was erected or installed pursuant to a sign permit or variance prior to May 7, 2012; B. The sign was in all respects in compliance with the applicable law in effect prior May 7, 2012; or C. If no sign permit was required under applicable law for the sign in question, the sign was in all respects in compliance with applicable law on the date of annexation of the property. 14.28.030 Loss of status A nonconforming sign shall immediately lose its nonconforming designation if: A. The sign is altered in any way in structure or copy, except for changeable copy signs and normal maintenance, which tends to or makes the sign less in compliance with the requirements of this Title than it was before the alteration; or B. The sign is relocated; or C. The sign is replaced. 14.28.040 Maintenance and repair Nothing in this Chapter shall relieve the owner or user of a nonconforming sign or owner of the property on which the nonconforming sign is located from the provisions of this Title, regarding safety, maintenance and repair of signs contained in this Title; provided, however, that any repainting, cleaning and other normal maintenance or repair of the sign or sign structure shall not modify the sign structure or copy in any way which makes it more nonconforming or the sign may lose its nonconforming status. 14.28.050 Replacement of nonconforming signs Any replacement or repair to a non - conforming sign shall require a permit. Any non - conforming sign that is replaced and/or damaged 50% or greater in terms of monetary replacement shall be replaced to be in compliance with this Title. Village of Buffalo Grove Sign Code -- 38 Chapter 14.32 PROHIBITED SIGNS Sections: 14.32.010 Generally 14.32.020 Animated and intensely lighted signs 14.32.030 Posters and bills 14.32.040 Moving sign 14.32.050 Parking of advertising vehicles 14.32.060 Public area 14.32.070 Window trimming 14.32.080 Swinging sign 14.32.090 Visible frames 14.32.100 Flashing lights 14.32.110 Unclassified signs 14.32.010 Generally The types of signs set forth in this Chapter are expressly prohibited in all districts, except as otherwise provided by this Title. 14.32.020 Animated and intensely lighted signs No sign shall be permitted which is animated by means of flashing, scintillating, blinking or traveling lights or any other means not providing constant illumination. 14.32.030 Posters and bills The tacking, posting or otherwise affixing of signs visible from a public way, located on the walls of buildings, barns, sheds, on trees, poles, posts, fences or other structures is prohibited unless otherwise permitted by this Title. 14.32.040 Moving signs A. A sign painted or placed on a vehicle or trailer for the primary purpose of displaying the sign is prohibited. B. Except as otherwise provided in this Title, no sign or any portion thereof shall be permitted which moves or assumes any motion consisting of a nonstationary or fixed condition except for the rotation of barber poles or permissible changing signs. C. This section is not meant to prohibit any form of vehicular signage such as a sign attached to a bus or lettered on a motor vehicle engaged in the delivery of good or services. 14.32.050 Parking of advertising vehicles A. No person shall park any vehicle or trailer, which has a sign placed thereon or affixed thereto, on a public right -of -way, public property, or on private property so as to be visible from a public right - of -way. B. This section is not intended to prohibit vehicles that are used on a day -to -day basis as part of the business or activity on the property. Village of Buffalo Grove Sign Code - 39 14.32.060 Public areas A. No sign shall be permitted which is placed on any crosswalk, curb, curbstone, sidewalk, post, pole, stake, electrolier, hydrant, bridge, tree or other surface located on public property or over or across any street or public thoroughfare except as authorized in subsection B of this section. B. Signs shall be allowed in the public areas designated in subsection A of this section so long as they meet the following requirements: 1. Nonilluminated, single- or double -faced ground sign; 2. Not exceeding the height of 36 inches above the top of the curb; 3. Not exceed 6 square feet in area; 4. Only allowed on Sundays between the hours of 12:00 p.m. to 6:00 p.m. and Wednesdays between the hours of 9:00 a.m. to 2:00 p.m.; 5. No Village sign permit will be required for a sign under this section. C. Any sign located on public property in violation of this section may be removed by the Village. The person responsible for any such illegal sign shall be liable for the costs incurred in the removal thereof and the Village is authorized to effect the collection of said cost. The remedy is not exclusive. The Village reserves the right to prosecute violators as set forth in Chapter 1.08 of this Code. D. Nothing in this section shall apply to the painting of house numbers upon curbs or curbstones. E. Subsections A and B of this section shall not be applicable to Sections 14.24.010(A), Directional or Incidental Signs, 14.24.010(C), Government Signs, 14.24.010(K), Public Notices, or 14.24.010(L), Public Signs. F. Notwithstanding the foregoing political signs may be placed on public property (excluding public right -of -way) as permitted by the Illinois Election Code (10 ILCS 5/1 -1 et seq.) 14.32.070 Window Trimming Rope lighting, flexible lighting, series lighting and other similar applications window trimming are prohibited if visible from a public way. This section is not intended to prohibit seasonal lights. 14.32.080 Swinging signs Swinging signs are prohibited. 14.32.090 Visible frames Visible angle iron frames or structures to support projecting signs are prohibited. 14.32.100 Flashing lights Flashing lights or flashing signs located inside a premises are expressly prohibited if visible from a public way. This section is not intended to prohibit holiday lights that flash on and off. Village of Buffalo Grove Sign Code — 40 14.32.110 Unclassified signs The following signs are also prohibited, which: A. Bear or contain statements, words or pictures of an obscene, pornographic, immoral character, or which contain advertising matter which is untruthful; B. Emit audible sound, odor or visible matter, including but not limited to fog; C. Signs for advertising which purport to be, or are an imitation of, or resemble an official traffic sign or signal, or which bear the words "Stop," "Go Slow," "Caution," "Danger," "Warning," or similar words; D. Signs which by reason of their size, location, movement, content, coloring or manner of illumination may be confused with or construed as a traffic control sign, signal or device, or a warning sign, or the light of an emergency or road equipment vehicle, or which hide from view any traffic or street sign or signal or device. Village of Buffalo Grove Sign Code - 41 14.36.010 Maintenance and repair required Every sign, including but not limited to those signs for which permits or for which no permit or permit fees are required, shall be maintained in a safe, presentable and good structural material condition at all times, including the replacement of defective parts, painting, repainting, cleaning and other acts required for the maintenance of the sign. If the sign is not made to comply with adequate safety standards, the Administrator shall require its removal in accordance with this Chapter. 14.36.020 Abandoned signs Except as otherwise provided in this Title, any sign which is located on property which becomes vacant and unoccupied for a period of 3 months or more, or any sign which pertains to a time, event or purpose which no longer applies, shall be deemed to have been abandoned. Permanent signs applicable to a business temporarily suspended because of a change of ownership or management of such business shall not be deemed abandoned unless the property remains vacant for a period of 6 months or more. An abandoned sign is prohibited and shall be removed by the owner of the sign or owner of the premises. 14.36.030 Advertising Non - Existent Business or Products A. Any signs or other advertising structure now or hereafter existing, which advertises a business no longer being conducted, or a product no longer being sold, shall be taken down and removed by the owner, agent, or person having the beneficial use of the building, structure or premises upon which it may be found, within 20 days after written notification from the Administrator. Upon failure to comply with such notice within the time specified, in such order, the Administrator is hereby authorized to cause removal of such sign and any expense incidental thereto shall be paid by the person to whom such notice was given. B. Signs which advertise the non - existent business or product as identified herein shall be replaced with a blank panel or other acceptable material as approved by the Administrator to cover the business name or product no longer being sold on the premises. Open panels are prohibited. Non - acceptable materials includes but is not limited to a tarp. 14.36.040 Dangerous or defective signs No person shall maintain or permit to be maintained on any premises owned or controlled by that person any sign which is in a dangerous or defective condition. Any dangerous or defective sign shall be removed or repaired by the owner of the premises. Village of Buffalo Grove Sign Code - 42 14.36.050 Street improvement projects Unless authorized by this Title, any sign projecting or encroaching into a public right -of -way shall be removed by the owner or altered at the owner's expense if, as the result of, or after completion of a street improvement project, the sign does not or would not comply with the provisions of this Title. 14.36.060 Removal by the Administrator A. The Administrator shall cause to be removed any sign that endangers the public safety such as, but not by way of limitation, an abandoned, dangerous, or materially, electrically or structurally defective sign or a sign for which no permit has been issued or a sign not allowed by this Title. The Administrator shall prepare a notice which shall describe the sign and specify the violation involved and which shall state that if the sign is not removed or the violation is not corrected within 15 days the sign shall be removed in accordance with the provisions of this Chapter. 1. For all purposes hereinafter the owner of the premises shall be presumed to be the owner of all signs thereon, unless the contrary appears from facts brought to the attention of the Administrator. 2. The notice given by the Administrator shall state the remedial action required to be taken, and if such action is not taken within the time limits set forth in this Title, the cost of correcting the unlawful feature of the sign may be assessed against the property on which the sign is located. 3. In the event that the owner of the premises, or person entitled to the possession, or the owner of the sign, fails, neglects or refuses to comply with the notice to repair, rehabilitate or demolish the sign declared to be unlawful the owner of the sign, the owner of the premises upon which the sign is located, and the person entitled to possession thereof (if other than the owner of the premises), or all or any of them, may be prosecuted for violation of this Title. The Administrator may remove the sign declared to be unlawful. B. All notices mailed by the Administrator shall be sent by certified mail, return receipt requested. Any time periods provided in this Chapter shall be deemed to commence on the date of the receipt of the certified mail or the constructive receipt of certified mail. C. The notice shall be mailed to the owner of the property on which the sign is located, the owner of the sign, or the occupant of the property. D. Any person having an interest in the sign or in the property may appeal the determination of the Administrator ordering removal or compliance by filing a written notice of appeal to the Village Manager. If the appeal is denied, an appeal may then be made to the Corporate Authorities. Both aforementioned appeals require notification within 15 days after the date of mailing the notice, or 15 days after receipt of the notice if the notice was not mailed. E. Notwithstanding the above, in cases of emergency, the Administrator may cause the immediate removal of a dangerous or defective sign without notice. F. When it is determined by the Administrator that said sign would cause an imminent danger to the public safety, and contact cannot be made with a sign owner or building owner, no written notice shall have to be served. In this emergency situation, the Administrator may correct the danger. Village of Buffalo Grove Sign Code - 43 14.36.070 Disposal - Assessment of costs Any sign removed pursuant to the provisions of this Chapter shall become the property of the Village and may be disposed of in any manner deemed appropriate by the Village. The cost of removal shall include any and all incidental expenses incurred by the Village in connection with the sign's removal, being assessed as follows: A. Upon removal of the sign, the Administrator shall provide a statement of all applicable costs, fees and penalties to be assessed against the property. B. Such statement shall be mailed to the owner of said premises, by certified mail, return receipt requested, postage prepaid, notifying such owner that the work has been performed pursuant to this Title. The statement shall include the date of performance of the work, the nature of the work, and demanding payments of the costs thereof and other incidental costs in connection therewith. Such notice shall state that if said amount is not paid within 30 days of mailing the notice, it shall become an assessment upon and a lien against the property of said owner. Village of Buffalo Grove Sign Code - 44 Chapter 14.40 VARIANCES AND APPEALS Sections: 14.40.010 Variance, Conditions for granting 14.40.020 Application Process 14.40.030 Notice of hearing 14.40.040 Hearings 14.40.050 Hearing minutes and decision 14.40.060 Appeals 14.40.070 Variances by Corporate Authorities 14.40.080 Variances by the Plan Commission 14.40.010 Variance, Conditions for granting A. Except for Prohibited signs (Chapter 14.32), the Village Zoning Board of Appeals may recommend approval or disapproval of a variance from the provisions or requirements of this Title subject to the following: The literal interpretation and strict application of the provisions and requirements of this Title would cause undue and unnecessary hardships to the sign user because of unique or unusual conditions pertaining to the specific building, parcel or property in question; and 2. The granting of the requested variance would not be materially detrimental to the property owners in the vicinity; and 3. The unusual conditions applying to the specific property do not apply generally to other properties in the Village; and 4. The granting of the variance will not be contrary to the purpose of this Title pursuant to Chapter 14.04.020 of this Title. B. Where there is insufficient evidence, in the opinion of the Zoning Board of Appeals, to support a finding under subsection A. of this section, but some hardship does exist, the Zoning Board of Appeals may consider the requirement fulfilled if: 1. The proposed signage is of particularly good design and in particularly good taste; and 2. The entire site has been or will be particularly well landscaped. C. In recommending approval of a sign permit requiring a variance, the Zoning Board of Appeals may attach thereto such requirements regarding the location, character and other features of the proposed sign as it may deem necessary to carry out the spirit and purpose of this Title in the public interest. D. No variance shall be valid for a period longer than 6 months unless a permit is obtained within such period and such erection or alteration is started and proceeds to completion in accordance with the terms of such permit. E. Where the business use associated with the variance thereafter terminates or changes, such termination or change of use shall operate as a termination of the variance and the sign thereafter shall conform to the provisions and requirements of this Title. Village of Buffalo Grove Sign Code - 45 14.40.020 Application process A. An application for variation of the requirements of this Title may be made by a property owner or his /her authorized agent. Such application shall be made in writing and shall include all of the following information: 1. A completed Application for Variation. 2. Proof of ownership of the property, such as Warranty Deed, Title Policy or Trust Deed. A copy is sufficient. 3. A complete legal description of the subject property. 4. A letter stating specifically the reason for the variation request; including size, location, materials, full graphics and other pertinent details relative to the request. 5. Color copies (no larger than 11 x 17) including size, color, dimensions, copy and total square footage. a. Ground signs: Include a copy of the Plat of Survey showing the location of the proposed sign with all dimensions to property lines. Include a list of all ground signs within 250 feet of the proposed sign. b. Wall signs: Show proposed sign superimposed on an elevation drawing of the particular building for which the sign is intended. Provide dimensions for the sign and the building elevation or lease space for which the sign is intended to be installed. 6. A list of addresses of all properties within 250 feet in all directions of the subject property. The names and addresses must be submitted on mailing labels. 7. A completed Certificate of Mailing Form. 8. If the application is being made by anyone other than the property owner, a letter of authorization must accompany the application. B. At the time of filing an application the $125.00 application fee must be submitted and a $2,000.00 Recovery of Village Costs Escrow shall be deposited with the completed Recovery of Village Costs Escrow Form. After the variation process is complete any funds remaining will be refunded back to the applicant. 14.40.030 Notice of hearing The Zoning Board of Appeals shall hear variances when a completed application, and all supporting documentation, is submitted by the third Tuesday of the month for the following month's meeting. Notice of the hearing on the requested variance shall be given by the Zoning Board of Appeals, not less that 15 days and no more than 30 days prior to the hearing, to: A. The applicant, in writing, at the address given on the request; B. The Administrator, in writing; C. The public by posting a copy of the notice of hearing in a conspicuous place within the Village Hall; Village of Buffalo Grove Sign Code - 46 D. The public by posting a sign in a conspicuous place on the property concerned; E. Property owners of record within 250 feet by mail; F. By legal notice published at least once in one or more approved publications. Such notices shall be in a form prescribed by the Zoning Board of Appeals and shall set forth the time, place and purpose of the hearing. 14.40.040 Hearings All hearings of the Zoning Board of Appeals shall be open to the public and those in attendance shall be afforded an opportunity, the length and requirements of which shall be prescribed by the Zoning Board of Appeals, to speak on the requested variance and to cross examine witnesses. The applicant and Administrator shall be afforded an opportunity to address the Board on the requested variance. Any party or interested person may be represented by another at the hearing. Any written statements submitted, either prior to or at the meeting, shall be made part of the record. 14.40.050 Hearing minutes and decision The Zoning Board of Appeals shall keep minutes of its proceedings and shall cause to be kept a record of the hearing together with its findings of fact in support of that decision, all of which shall be open to public inspection. Copies of decisions on applications for variances shall be mailed or delivered to the applicant and to persons filing objections. 14.40.060 Appeals An appeal of any Zoning Board of Appeals decision may be taken by any person in attendance at the meeting or any person who has submitted a written objection to the Corporate Authorities. A written request for appeal must be served on the Administrator within 15 days of the decision. 14.40.070 Variances by Corporate Authorities Except for Prohibited signs (Chapter 14.32), the Corporate Authorities may hold any public hearing required by this Title and may determine and vary the application of any of the requirements of this Title in harmony with its general purpose and intent in cases where there are practical difficulties or particular hardships in the way of carrying out the strict letter of its requirements. 14.40.080 Variances by the Plan Commission Except for Prohibited signs (Chapter 14.32), the Plan Commission may recommend approval or disapproval of a variance when a zoning action is being considered by the Plan Commission, including but not limited to the creation of a Uniform Sign Package pursuant to Section 14.16.050 or a Planned Unit Development pursuant to the Village Zoning Ordinance, Title 17. The Plan Commission shall comply with the requirements of this Chapter including but not limited to Section 14.40.010. Members of the Zoning Board of Appeals shall be invited to attend and participate in the review of Variances by the Plan Commission as set forth herein. Village of Buffalo Grove Sign Code - 47 Chapter 14.44 ADMINISTRATION AND ENFORCEMENT Sections: 14.44.010 Administrative authority 14.44.020 Conflict of provisions 14.44.030 Violation - Penalty 14.44.010 Administrative authority The Administrator is authorized and directed to enforce and carry out all provisions of this Title. The Administrator shall establish rules and procedures to be consistent with the purpose of this Title. The Administrator is further empowered to delegate the duties and powers granted to and imposed upon him or her under this Title. 14.44.020 Conflict of provisions If any portion of this Title is found to be in conflict with any other provision of any other ordinance of the Village, the provision which establishes the higher standard shall prevail. 14.44.030 Violation - Penalty Any violation of the provisions of this Title shall be punished according to the provisions of Chapter 1.08 of the Buffalo Grove Municipal Code. Dated at Buffalo Grove, Illinois, this 8th day of May, 2012 11 Ordinance No. 2012 - 18 An Ordinance Adopting A Revised Sign Code, Title 14 of the Buffalo Grove Municipal Code 3 -7 -2012 WHEREAS, the Village of Buffalo Grove is a Home Rule Unit of local government pursuant to the Illinois Constitution of 1970; and WHEREAS, the Village of Buffalo Grove Sign Code, Title 14 of the Buffalo Grove Municipal Code, was last updated,by Ordinance No. 1999 -69 and approved on August 16, 1999; and WHEREAS, the Village of Buffalo Grove deems it in the best interests of the community to adopt a revised Sign Code; and WHEREAS, the purpose of the revised Sign Code is to create the legal framework for signage regulations; recognizing the need to protect the safety and welfare of the public, the need for well maintained and attractive appearance in a community, the need for adequate business identification, and advertising and communication, and the need for promotion of aesthetic values. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, PURSUANT TO ITS HOME RULE POWER: Section 1.
