GRANTING VARIATIONS FROM CERTAIN SECTIONS
OF THE BUFFALO GROVE SIGN CODE
M & I Imports Incorporated d/b /a Lux Cars Chicago at 88 E. Dundee Road
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the
B -3 Planned Business Center District and is commonly known as 88 E. Dundee Road, Buffalo
Grove, Illinois; and,
WHEREAS, request was made by M & I Imports Incorporated d/b /a Lux Cars Chicago
as Lessee of the Property, and with the consent of Buffalo Grove Professional Building LLC, the
owner of the Property, for variances of the Village's Sign Code, Section 14.20.030, pertaining to
Business Districts; Section 14.20.070, pertaining to Grounds Signs; and Section 14.20.080,
pertaining to Wall Signs, for the purpose of replacing the existing wall sign on the east elevation
of the building with a new wall sign that exceeds the permitted size and does not face the public
right of way; and to reface the existing ground sign that is located within two hundred fifty (250)
feet of an existing ground sign located on the same side of the street; and,
WHEREAS, the Zoning Board of Appeals held a public hearing at which it received
testimony on the requested variations; and
WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive
recommendation for the variations, and prepared minutes of the public hearing; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby
determine and find that the requested sign variation for the ground sign is in harmony with the
general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) ,
and that (1) the proposed signage is of particularly good design and in particularly good taste and
(2) the entire site has been or will be particularly well landscaped and that the requested sign
variation for the wall sign is in harmony with the general purpose and intent of the Sign Code
(Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements of the Sign Code

D. The hours of illumination shall be from 10:00 a.m. to two (2) hours
after the close of business or 9:00 p.m., whichever is earlier.
E. M & I Imports shall provide a copy of the signed lease and the
landlord approval of the proposed signs.
Section 4. This Ordinance shall be in full force and effect from and after its passage, and
approval. This Ordinance shall not be codified.

(Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements of the Sign Code
would cause undue and unnecessary hardship to the sign user due to the following unique or
unusual conditions pertaining to the property: (a) need to identify the tenants in the building to
attract customers and (b) to allow customers to place their order in the drive through land, (2) the
granting of the requested variances will not be materially detrimental to the property owners in
the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to
other properties in the Village, and (4) the granting of the variances will not be contrary to the
general objectives of the Sign Code of moderating the size, number and obtrusive placement of
signs and the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. Variations are hereby granted to Sections 14.20.030, 14.20.070, and 14.20.080
of the Village Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of
replacing the existing wall sign on the east elevation of the building with a new wall sign that
exceeds the permitted size and does not face the public right of way; and to reface the existing
ground sign that is located within two hundred fifty (250) feet of an existing ground sign located
on the same side of the street. The Property is legally defined as follows:
The east 230 feet of the south 300 feet (except the south 50 feet thereof taken or used for
highway purposes) of the east half of the southwest quarter of Section 4, Township 42
north, Range 11, east of the Third Principal Meridian, in Cook County, Illinois.
Commonly known as: 88 E. Dundee Road, Buffalo Grove, Illinois 60089
Section 3. The variations are subject to the following conditions:
A. The signs are to be installed pursuant to Zoning Board of Appeals
Exhibit "E" with the exception that the wall sign will be limited to
eighteen (18) inches in height and thirteen (13) feet in length.
B. Subject to the Village Engineer's memorandum dated March 9, 2012.
C. Subject to the Appearance Review Team (ART) minutes dated March
7, 2012.

D. The hours of illumination shall be from 10:00 a.m. to two (2) hours

E. M & I Imports shall provide a copy of the signed lease and the
landlord approval of the proposed signs.
