2011-05011/1/2011 0 ORDINANCE NO. 2011— 50 0 AN ORDINANCE APPROVING THE FIFTH AMENDMENT TO THE RIVERWALK PLANNED UNIT DEVELOPMENT (PUD) VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS PrimeSource Healthcare Systems, Inc. Exterior wall sign 2100 Lake Cook Road Riverwalk WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Illinois Constitution of 1970; and, WHEREAS, the Riverwalk development is comprised of two office buildings and two parking structures at 2100 and 2150 Lake Cook Road in Buffalo Grove, Illinois; and, WHEREAS, HP Riverwalk II, LLC is the owner of the property at 2100 Lake Road; and WHEREAS, the Planned Unit Development for the Riverwalk property was approved by Village Ordinance No. 85 -64, and said ordinance has been amended for site plan revisions by Ordinance No. 88 -120 and Ordinance No. 97 -28; and, WHEREAS, the Village approved Ordinance No. 2010 -62, the fourth amendment to the Riverwalk Planned Unit Development allowing a wall sign on the south elevation of the building at 2100 Lake Cook Road for Prime Source Healthcare Systems, Inc. ( "PrimeSource "), an Indiana corporation; and, WHEREAS, the modified sign, depicted in Exhibit C attached hereto, does not increase the overall size, nor change the basic appearance of the sign approved as Exhibit C to Ordinance No. 2010 -62; and, 2 WHEREAS, PrimeSource requests an amendment of Ordinance No. 2010 -62 to allow a modification of the sign approved as Exhibit C to said Ordinance, in accordance with the following exhibits, which are attached hereto and made a part hereof: EXHIBIT A Legal Description — 2100 Lake Cook Road EXHIBIT B Petitioner Acceptance and Agreement concerning zoning approval EXHIBIT C Proposed sign dimensions and colors, drawing dated as last revised October 3, 2011 by White Way Sign Company WHEREAS, the President and Board of Trustees of the Village of Buffalo Grove have determined that the modified wall sign requested by PrimeSource is appropriate in size and appearance for the proposed location and would be compatible with adjacent properties. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS: Section 1. This ordinance is made pursuant to and in accordance with the Village's Zoning Ordinance and the Village's Home Rule powers. The preceding whereas clauses are hereby incorporated herein. Section 2. The Corporate Authorities hereby adopt a proper, valid and binding ordinance amending Section 2. of Ordinance No. 2010 -62 to allow the wall sign on the building at 2100 Lake Cook Road as proposed by PrimeSource Healthcare in accordance with the exhibits hereto. Section 3. This amendment of Section 2. of Ordinance No. 2010 -62 pertains only to the wall sign proposed by PrimeSource Healthcare. Said sign shall not be modified or used by any other entity, business or tenant, except as approved by the Village in its sole discretion. In the event that the lease space occupied by PrimeSource Healthcare is reduced to less than the 54,237 square feet represented in the documents submitted in support of the request for the wall sign, said sign shall be removed at the direction of the Village. Section 4. The terms and conditions of Ordinances No. 85 -64, 88 -120, 97 -28 and 2010 -62 remain in full force and effect unless specifically modified by this Ordinance. Section 5. This Ordinance shall be in full force and effect upon the submittal of the executed Petitioner's Acceptance and Agreement, Exhibit B of this Ordinance. This Ordinance shall not be codified.
