2011-08-08 - Ordinance 2011-038 - GRANTING A VARIANCE FROM SECTION 17.20.030 OF THE BG ZONING ORDINANCE - JEFF AND LAURIE PARKER - 1020 PLUM GROVE CIR7/30/2011 0 ORDINANCE NO. 2011 - 38 GRANTING A VARIANCE FROM SECTION 17.20.030 OF THE BUFFALO GROVE ZONING ORDINANCE Jeff and Laurie Parker at 1020 Plum Grove Circle WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, request is being made by Jeff and Laurie Parker, the owners of 1020 Plum Grove Circle, for variance of Zoning Ordinance, Section 17.20.030, pertaining to Building height, bulk and lot coverage, in the R5A Residential Zoning District for the purpose of allowing the existing air conditioner unit to be located in the corner side yard; and. WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommendation on said request for a variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Zoning Ordi- nance, and that (1) the plight of the owners is due to hardship and unique circumstances and (2) the proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 17.20.030 of the Zoning Ordinance of the Village of Buffalo Grove to the following legally described real property: 1 X H Lot 344 in Strathmore in Buffalo Grove Unit 3, Sections 5 and 6, Township 42 north, Range 11, east of the Third Principal Meridian, according to the Plat thereof recorded February 8, 1968 as Document 20400443, in Cook County, Illinois. Commonly known as: 1020 Plum Grove Circle, Buffalo Grove, Illinois 60089. The specific variation will allow the existing air conditioner unit to be located in the corner side yard. Section 3. The variation granted is subject to: (i) the Village Engineer's memorandum dated June 30, 2011, (ii) the revised landscaping plan submitted and marked as Zoning Board of Appeals Exhibit "F ", and (iii) compliance with the Appearance Review Team (ART) minutes dated July 6, 2011. Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified.
