2011-036E ORDINANCE NO. 2011- 36 • AN ORDINANCE APPROVING A LETTER OF AGREEMENT BETWEEN THE VILLAGE OF BUFFALO GROVE AND THE BUFFALO GROVE PROFFESSIONAL FIREFIGHTER/PARAMEDIC ASSOCIATION WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Provisions of the Constitution of the State of Illinois of 1970; and WHERAS, in accordance with the Illinois Public Labor Relations Act, the Village of Buffalo Grove entered into good faith collective bargaining and has thus reached an agreement with the Buffalo Grove Professional Firefighter/Paramedic Association, Local 3177, IAFF, AFL -CIO, CLC concerning wages, benefits and other terms and conditions of employment for the years so noted within the Side Letter of Agreement dated July 11, 2011. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS that: Sectionl. The President and the Board of Trustees hereby accept the terms of the attached Letter of Agreement. Section 2. The Village Manager is authorized to enter into the Letter of Agreement with the Buffalo Grove Professional Firefighter/Paramedic Association, Local 3177, IAFF, AFL -CIO, CLC. Section 3. This Ordinance shall be in full force and effect from and after its passage and approval. This Ordinance shall not be codified. ATTEST: Village Side Letter of Agreement Between The Village of Buffalo Grove And The Buffalo Grove Professional Firefighter/Paramedic Association, Local 3177, IAFF. July 11, 2011 Representatives from the Village of Buffalo Grove ( "Village ") and the Buffalo Grove Professional Firefighter/Paramedic Association ( "Union ") have met and reached agreement on this Side Letter of Agreement to the Collective Bargaining Agreement ( "Agreement ") between the parties dated May 1, 2008 through April 30, 2013 which modifies the following sections of the afore referenced Agreement, Supplemental Agreements and Departmental Standard Operating Procedures. Article VI, Section 6.1— Salaries For purposes of determining the salaries of job titles within bargaining unit, for the duration of this Agreement, longevity pay and stipends shall be added to the "base" salaries of all comparables, as well as those of the Village. Only the following stipends shall be applied in the formula: (1) Firefighter/Paramedic: Firefighter III, Fire Apparatus Engineer, Shift Reduction and Paramedic. (2) Lieutenant: Paramedic, Shift Reduction and Fire Officer I. For the purpose of determining the general wage increase of comparable communities who have not yet resolved their May 1, 2012 to April 30, 2013 wages, we shall calculate and apply the average of the actual general wage increase and above referenced stipends granted by the comparable communities from May 1, 2011 to April 30, 2012. Tier I Salary Schedule - 2010 Effective: December 31, 2010 (Salary Increase Deferred, without retroactive pay, from May 1, 2010 through December 30, 2010) — Only for Employees Hired On or Prior to the Date of Ratification of this Agreement (Tier I). A. Firefighter/Paramedic (3.00% Increase): 1. The minimum and entrance salary at Step 244 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $57,803.20; and, 2. The maximum salary, exclusive of overtime pay shall be at Step 322 or $85,290.40. B. Fire Lieutenant/Paramedic (2.00% Increase): 1. The minimum and entrance salary at Step 275 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $67,468.96; and, 2. The maximum salary exclusive of overtime pay shall be at Step 353 or $99,550.88. C. Fire Lieutenant/Non- Paramedic (2.00% Increase): 1. The minimum and entrance salary at Step 271 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $66,135.68; and, 2. Current Paramedic Lieutenants wishing to decertify shall decertify to a CPR/Basic First Aid status (Non - Paramedic). Tier I Salary Schedule - 2011 Effective: December 31, 2011 (Salary Increase Deferred, without retroactive pay, from May 1, 2011 through December 30, 2011) — Only for Employees Hired On or Prior to the Date of Ratification of this Agreement (Tier 1). A. Firefighter/Paramedic (3.50% Increase): 1. The minimum and entrance salary at Step 251 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $59,856.16; and, 2. The maximum salary, exclusive of overtime pay shall be at Step 329 or $88,318.88. B. Fire Lieutenant/Paramedic (2.50% Increase): The minimum and entrance salary at Step 280 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $69,170.40; and, 2. The maximum salary exclusive of overtime pay shall be at Step 358 or $102,063.52. C. Fire Lieutenant/Non- Paramedic (2.50% Increase): The minimum and entrance salary at Step 276 as delineated in the Village of Buffalo Grove's Municipal Classification and Pay Plan, or $69,805.92; and, The maximum salary exclusive of overtime pay shall be at Step 354 or $100,048.00. The minimum or starting Tier II salary structure will be 10% lower than the Tier I counterpart, as illustrated in Article VI, Section 6.1 — Salaries. The maximum or top Tier II salary structure will be equal to the Tier I equivalent. Only employees hired after the date of ratification of this contract reopener will be included in the Tier II program. Bargaining unit members who enter employment under the Tier II wage schedule shall reach top pay in 7 years, rather than in 5 years as is the case with their Tier I counterparts. Tier II Salary Schedule — 2010 -2011 Effective: Upon Ratification of this Contract Reopener — Only For Employees Hired After the Date of Ratification of this Agreement (Tier II). A. Section 6.2 — WaEe and Benefit Reopener This Agreement shall encompass the Wage and Benefit Reopeners for May 1, 2010 — April 30, 2011 and May 1, 2011 — April 30, 2012: No further Contract Reopener negotiations shall occur for these periods. May 1, 2012 — April 30, 2013 Contract Reopener: A Contract Reopener will be held on or about February 1, 2012, for an effective date of May 1, 2012.The sole issue to be discussed during the 2012 contract reopener, which encompasses the May 1, 2012 —April 30, 2013 year, shall be the determination of base wages based on the criteria set forth in Article VI, Section 6.1 — Salaries, of this Agreement. No other issue, item or topic may be discussed during the 2012 contract reopener unless both parties mutually agree to do so in writing. Article VI, Section 6.9 — Year 2008 through 2012 for Health and Dental Benefits In addition to the PPO -A and PPO -B, which are currently being offered to all eligible Village of Buffalo Grove employees, the Village anticipates offering an HMO product to all eligible employees no later than January 1, 2012. No other plan design changes will be made to PPO -A or PPO -B in calendar years 2011 or 2012. Nothing shall preclude the parties to this Agreement from negotiating plan design changes in subsequent calendar, collective bargaining agreement or health/dental insurance plan years. A new health insurance premium contribution schedule will be adopted for all Village employees, including those in the bargaining unit. The schedule is as follows: Effective: January 1, 2011 — 10% employee contribution to health insurance premium. Effective: January 1, 2012 —11% employee contribution to health insurance premium. Effective: January 1, 2013 —12% employee contribution to health insurance premium. Effective: January 1, 2014* —13% employee contribution to health insurance premium. Effective: January 1, 2015* — 14% employee contribution to health insurance premium. Effective: January 1, 2016* —.15% employee contribution to health insurance premium. * = To be included in any successor Agreement which includes years 2014, 2015 and 2016. The Village's Dental Premium shall remain 100% employer paid for the duration of this Agreement. Article VI, Section 7.11— Voluntary Separation Incentive Program The Voluntary Separation Incentive ( "VSI ") program, which was. offered to certain non - represented Village employees from January through June 2011, will be offered to members of the bargaining unit for a duration of 6 months commencing upon ratification of this Agreement. Additionally, if the Village offers subsequent VSI programs anytime between ratification of this Contract Reopener and April 30, 2013, so too will the same program be offered to bargaining unit members. Additionally, upon ratification of this Agreement, the Union shall withdraw the unfair labor practice (ULP) charge which it previously filed against the Village as it relates to the 2011 VSI program. Effective upon ratification of this Contract Reopener, any member of the bargaining unit that elects to participate in the 2011 VSI program, as described in the previous paragraph of this Agreement, shall receive their 2011/2012 base pay increase, as described previously in this Agreement, on May 1, 2011, rather than on December 31, 2011. The dollar amount of the 2011/2012 salary increase received by the employee prior to their separation under the VSI program shall be deducted from their VSI benefit at separation. Article XV, Section 15.1 - Duration of Agreement The duration of this Agreement, May 1, 2008 — April 30, 2013, shall remain unchanged. Article XII, Section 12.4 — Layoff No active /current member of the bargaining unit (firefighter /paramedic and lieutenant), who was hired on or prior to the date of ratification of this contract reopener, shall be involuntarily laid -off for the duration of this Agreement (April 30, 2013). However, the Village may at its sole discretion and without any prior or subsequent consultation with the bargaining unit choose to temporarily delay /suspend the refilling of bargaining unit positions or permanently elect not to refill bargaining unit positions should they become. vacant for any reason other than involuntary layoff. Standard Operating Procedure (S.O.P.) 1:51— Compensatory Time Effective January 1, 2012, all bargaining unit members may accrue 96 hours of Compensatory Time in lieu of overtime pay. It is agreed that both parties shall follow the terms and conditions set forth in the Standard Operating Procedure (S.O.P.), entitled "1:51: Compensatory Time ". (Note: Union to provide Management with an electronic version of March 18, 2011 draft S.O.P, authored by Joe Alexander to be attached to this Side Letter of Agreement). • 11 S.O.P. 1:1.53 - Selection of Kelly. Vacation & Floating Holidays and S.O.P. 1:1.66 - Acting Shift Commander Selection / Acting Lieutenant Selection / Duty Pay & Responsibilities It is agreed that both parties shall follow the terms and conditions set forth in S.O.P. 1:1.53 and S.O.P. 1:1.66 as it relates to the scheduling and use of scheduled days off (S.D.O.). (Note: Union to provide Management with an electronic version of June 10, 2011 draft S.O.P, authored by Joe Alexander and amended by Art Malinowski on June 14, 2011, to be attached to this Side Letter of Agreement). Supplemental Agreement - Use of Utility Vehicle Within 60 days of ratification of this Agreement, the "Utility" vehicle will be modified and equipped per labor - management discussion. To ensure uniform and consistent operation of the Utility, a written operator's procedure will be drafted and all shift personnel will be trained on the use of the vehicle within 60 days of ratification of this Agreement. Supplemental Agreement - Selective Station Tones Within 60 days of ratification of this Agreement, Selective Station Tones will be implemented on a department -wide basis. Supplemental Agreement - Lateral Entry Program The concept of a lateral entry program for the position of Firefighter/Paramedic will be explored as part of the Labor - Management meeting process by the Union, Department staff and the Board of Fire and Police Commissioners.
