2011-0296/14/2011 E ORDINANCE NO. 2011 -29 n U GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE Wooil Restaurant — 185 Milwaukee Avenue WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the B -3 Planned Business Center District, which is commonly known as 185 Milwaukee Avenue, Buffalo Grove, Illinois and which has located thereon the Wooil Restaurant; and WHEREAS, request was made by Hanyoo Kim, 915 N. Moki Lane, Mt. Prospect, Illinois 60056 as the owner of the Property, for variances of the Village's Sign Code, Section 14.20.030, pertaining to Business Districts and Section 14.20.070, pertaining to Grounds Signs, for the purpose of allowing the refacing of the existing ground sign on the Property; and WHEREAS, the Zoning Board of Appeals held a public hearing at which it received testimony on the requested variations; and WHEREAS, the Zoning Board of Appeals made certain findings of fact, made a positive recommendation for the variations, and prepared minutes of the public hearing; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that the requested sign variations are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the proposed signage is of particularly good design and in particularly good taste and (2) the entire site has been or will be particularly well landscaped. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 1 C� Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Sections 14.20.030 and 14.20.070 of the Village's Sign Code (Title 14 of the Buffalo Grove Municipal Code) for the purpose of allowing the refacing of the existing ground sign on the Property which is legally described as follows: Parcel 1: Lots 1, 2, 3, 41 5, 6, the north 12.36 feet of Lot 7 and Lots 16 and 17 in Block 7 in unit No. 2 in Columbian Gardens, being a Subdivision of part of Section 35, Township 43 north, Range 11 east of the Third Principal Meridian, according to the Plat thereof, recorded July 10, 1926 as Document 282352 in book "P" of plats, page 92, (excepting therefrom that part taken in eminent domain cases 92ED75 and 92ED79) in Lake County, Illinois. Parcel 2: That part of the vacated alley lying east of the adjacent to Lots 1, 2, 3, 4, 5, 6 and the north 12.36 feet of Lot 7 and lying west of and adjacent to Lots 16 and 17, in Block 7 in Unit Number 2 in the Third Principal Meridian, according to the Plat thereof, recorded July10, 1926 as document 282352 in Book "P" of Plats, Page 92 in Lake County, Illinois, Described as follows: Beginning at the northeast corner of Lot 1" thence southeasterly along the east line of Lots 1, 2, 3, 4, 5, 6, and 7 to a point on a line 12.36 feet south of and parallel to the north line of Lot 7; thence northeasterly along a northeasterly prolongation of the last described line a distance of 20.00 feet to a point on the west line of Lot 16; thence northwesterly along the west line of Lots 16 and 17 to the northeast comer of Lotl7; thence southwesterly to the point of beginning. Commonly known as: 185 Milwaukee Avenue, Buffalo Grove, Illinois 60089 Section 3. The variations are subject to the following conditions: A. The sign shall comply with the Zoning Board of Appeals Exhibit "E" submitted with the application, B. To the Village Engineer's memorandum dated May 2, 2011, C. To the Village's Appearance Review Team (ART) minutes dated May 3, 2011, and D. The Petitioner shall paint the pole base of the sign and provide a landscaping plan for review and approval by the Village. Section 4.
