ORDINANCE NO. 2010- 61
GRANTING VARIATIONS FROM CERTAIN SECTIONS
OF THE BUFFALO GROVE SIGN CODE AND ZONING CODE
Deerfields Bakery at 201 Buffalo Grove Road
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the
B -5 Town Center Planned Business District, is commonly known as 201 Buffalo Grove Road,
and is occupied by Deerfields Bakery; and,
WHEREAS, request is being made by Deerfields Bakery, for variance of the Village's
Zoning Code, Section 17.44.060.E.6., pertaining to signs in the B -5 District and Sign Code,
Section 14.40.025, pertaining to Changeable Copy Signs, for the purpose of allowing more than
one (1) ground sign on the parcel and to allow a changeable copy menu board ground sign on the
Property; and
WHEREAS, the Zoning Board of Appeals held a public hearing, received testimony,
prepared minutes, made certain findings, and made an affirmative recommendation on the said
request for variations; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove, hereby
determine and find that the variation requested for the ground sign is in harmony with the general
purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that
(1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign
user because of unique or unusual conditions pertaining to the property, (2) the granting of the
requested variance will not be materially detrimental to the property owners in the vicinity, (3)
the unusual conditions applying to the specific property do not apply generally to other
properties in the Village, and (4) the granting of the variance will not be contrary to the general
objective of the Sign Code of moderating the size, number and obtrusive placement of signs and
the reduction of clutter. The Corporate Authorities hereby further determine and find that the
criteria for a variation as set forth in Section 17.52.070 have been fulfilled.

NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. A variation is hereby granted to Section 17.44.060.E.6. of the Village
Zoning Code and Section 14.40.025 of the Village Sign Code (respectively Title 17 and Title 14
of the Buffalo Grove Municipal Code) for the purpose of allowing more than one (1) ground sign
on the parcel and to allow a changeable copy menu board ground sign on the Property legally
described as follows:
That part of the southwest quarter of Section 33, Township 43 north, Range 11, east of
the Third Principal Meridian, in Lake County, Illinois, described as follows: Beginning at
a point in the center line of McHenry Road (which point is located as follows:
Commencing at the intersection of the south line of Section 33, with the center line of
aforesaid road, said intersection being 920 feet east of the southwest corner of said
Section; thence north 33 degrees 40 minutes west along the center line of said road,
1025.0 feet; thence north 6 degrees 30 minutes west along the center line 247.5 feet to the
place of beginning); then east 664.27 feet; thence north 6 degrees 30 minutes west 132
feet; thence west 664.27 feet to the center of aforesaid McHenry Road; thence south 6
degrees 30 minutes east 132.0 feet to the point of beginning, (excepting therefrom that
part taken for Buffalo Grove Road as per Document No. 2262703), in Lake County,
Illinois. Commonly known as: 201 Buffalo Grove Road, Buffalo Grove, IL 60089.
Section 3. The variation is subject to the following conditions:
A. The sign is to be installed pursuant to Zoning Board of Appeals Exhibit
"E" which was submitted to the Zoning Board of Appeals with the
application for variation.
B. Village Engineer's memorandum dated October 7, 2010.
C. The Village's Appearance Review Team's (ART) minutes of October 6,
2010.
Section 4. This Ordinance shall be in full force and effect from and after its passage, and
approval. This Ordinance shall not be codified.
