GRANTING VARIATIONS FROM CERTAIN SECTIONS
OF THE BUFFALO GROVE SIGN CODE
Wendy's International at 245 McHenry Road
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, the real property ( "Property ") hereinafter legally described is zoned in the
B -2 Business District, is commonly known as 245 McHenry Road, and is occupied by a business
known as Wendy's International; and,
WHEREAS, request has been made by QT Signs, Inc., 1391 Wright Boulevard,
Schaumburg, Illinois 60193 on behalf of Wendy's International, 245 McHenry Road, for
variations of the Village's Sign Code, Section 14.20.030, pertaining to Business Districts;
Section 14.20.070, pertaining to Ground Signs; and Section 14.40.025, pertaining to Changeable
Copy Signs, for the purpose of replacing two (2) ground signs (menu boards) on the property; to
allow the menu board ground signs to be located within two hundred fifty (250) feet of existing
ground signs located on the same side of the street; and to allow the two (2) menu board ground
signs to be changeable copy; and
WHEREAS, the Zoning Board of Appeals held a public hearing, received testimony,
prepared minutes, made certain findings, and made an affirmative recommendation on the said
request for variations for the proposed Wendy's International signs; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove, hereby
determine and find that the variations requested for the ground signs are in harmony with the
general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) ,
and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to
the sign user because of unique or unusual conditions pertaining to the property, (2) the granting
of the requested variances will not be materially detrimental to the property owners in the
vicinity, (3) the unusual conditions applying to the specific property do not apply generally to
other properties in the Village, and (4) the granting of the variances will not be contrary to the

general objective of the Sign Code of moderating the size, number and obtrusive placement of
signs and the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. Variations are hereby granted to Sections 14.20.030, 14.20.070, and 14.40.025
of the Village Sign Code, Title 14 of the Buffalo Grove Municipal Code, for the purpose of
replacing two (2) ground signs (menu boards); to allow the menu board ground signs to be
located within two hundred fifty (250) feet of existing ground signs located on the same side of
the street; and to allow the two (2) menu board ground signs to be changeable copy for the
following legally described Property:
All of Lot 1 in Siegle's Resubdivision of parts of Lots 7, 8 and all of Lot 11 in Buffalo Grove
Manor, being a Subdivision of part of the Southwest quarter of Section 33, Township 43 north,
Range 11, east of the Third Principal Meridian, recorded as Document 2814414, in Lake County,
Illinois described as follows: Beginning at the southwest corner of said Lot 1, then north 89
degrees 58 minutes 01 seconds east along the south line of said Lot 1, a distance of 355.52 feet,
thence north 00 degrees 01 minutes 59 seconds wets along the east line of said Lot 1, a distance
of 194.00 feet, thence south 89 degrees 58 minutes 01 seconds west along the north line of said
Lot 1, a distance of 33.63 feet, thence south 00 degrees 01 minutes 07 seconds east along the
north line of said Lot 1, a distance of 47.75 feet, thence north 89 degrees 59 minutes 32 seconds
west along the north line of said Lot 1, a distance of 345.43 feet, thence south 09 degrees 09
minutes 53 seconds east along the west line of said Lot 1, a distance of 148.38 feet to the point of
beginning.
Commonly known as: 245 McHenry Road, Buffalo Grove, Illinois 60089
Section 3. The variations are subject to the following conditions:
A. The signs are to be installed in accordance with Zoning Board of Appeals
Exhibit "E" and Exhibit "I ".
B. The signs are subject to the Village Engineer's memorandum dated July 8,
2010.

C. The signs are subject to the Village's Appearance Review Team's (ART)
minutes of July 6, 2010 and August 2, 2010.
Section 4. This Ordinance shall be in full force and effect from and after its passage, and
approval. This Ordinance shall not be codified.

were also available for public inspection upon request
in the Office of Village Clerk.
