2010-0458/3/2010 ORDINANCE NO. 2010- 45 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE American Mattress, 197 McHenry Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, the real property ( "Property") hereinafter legally described is zoned in the B -3 Planned Business Center District, commonly known as 197 McHenry Road, and is occupied by American Mattress and owned by Dref Grove, LLC; and, WHEREAS, American Mattress has requested variations of the Village Sign Code for the purpose of allowing an additional wall sign on the west elevation of the building located on the Property; and WHEREAS, the requested variations of the Village Sign Code are as follows: Section 14.20.030, pertaining to Business Districts and Section 14.20.080, pertaining to Wall Signs; and, WHEREAS, the Zoning Board of Appeals held a public hearing, received testimony, prepared minutes, made certain findings, and made an affirmative recommendation on the said request for variations for the American Mattress sign on the Property; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove, hereby determine and find that the variations requested are in harmony with the general purpose and intent of the Sign Code (Title 14 of the Buffalo Grove Municipal Code) , and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the 1 general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Sections 14.20.030, and 14.20.080 of the Village Sign Code, Title 14 of the Buffalo Grove Municipal Code, for the purpose of allowing an additional wall sign on the west elevation of the building on the Property legally described as follows: All of Lot 1 in Buffalo Grove Center Resubdivision of Lot 1, being a Resubdivision of Buffalo Grove Center Subdivision in the south half of Section 33, Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat of said Resubdivision recorded December 29, 1983 as Document 2258952, in Lake County, Illinois.. Commonly known as: 197 McHenry Road, Buffalo Grove, Illinois. Section 3. The variations are subject to the following conditions: A. The sign shall be installed pursuant to the Zoning Board of Appeals Exhibit "E" which was admitted into evidence, and B. The sign is subject to compliance with the Village of Buffalo Grove Appearance Review Team ( "ART ") minutes of its meeting on July 6, 2010. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval. This Ordinance shall not be codified. The pamphlet form of Ordinance No, 2010 -45, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on August 12, 2010 and continuing for at least ten days thereafter.
