I further certify that on, March 08, 2010 the Corporate Authorities of the Village passed and approved Ordinance No. 2010 -15, GRANTING A VARIANCE FROM SECTION 17.36.030 OF THE BUFFALO GROVE MUNICIPAL CODE FOR 1220 LOCKWOOD DRIVE provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No, 2010 -15, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on March 08, 2010 and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of Village Clerk. Dated at Buffalo Grove, Illinois, this 9TH day of March, 2010. ✓ ' /' Vil e Clerk By 3/9/2010 ORDINANCE NO. 2010 - 15 GRANTING A VARIANCE FROM SECTION 17.36.030 OF THE BUFFALO GROVE MUNICIPAL CODE FOR 1220 LOCKWOOD DRIVE WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, request is being made by Phillip A. Samuels and Judith A. Samuels, the owners of 1220 Lockwood Drive ( "Owners "), for variance of Section 17.36.030.F. of the Buffalo Grove Municipal Code, pertaining to Additional Regulations — Parking, for the purpose of allowing the existing driveway to exceed the forty (40) percent front yard coverage limitation by two (2) square feet and to allow the proposed driveway extension, in addition to the existing driveway, to exceed the forty (40) percent front yard coverage limitation by approximately eighty -eight (88) square feet; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimon} , prepared minutes, made certain findings, and has made; an affirmative recorr: aen- dation on said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Zoning Ordinance, and that (1) the plight of the Owners is due to unique circumstances in that their son, Avi, has cerebral palsy, a tracheotomy and is wheelchair bound and (2) the proposed variation will not alter the essential character of the neighborhood. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities. Section 2. A variation is hereby granted to Section 17.36.030 of the Village Zoning Ordinance to the following legally described real property ( "Property"): Lot 17 in Block 3 in Suffield Place, being a Subdivision in the east %2 of Section 29, Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat thereof recorded as Document Number 1976742, in Lake County, Illinois. Commonly known as: 1220 Lockwood Drive, Buffalo Grove, Illinois 60089. PIN: 15 -29 -212 -058 The specific variation will allow the existing driveway to exceed the forty (40) percent front yard coverage limitation by two (2) square feet and allow the proposed driveway extension in addition to the existing driveway to exceed the forty (40) percent front yard coverage limitation by approximately eighty -eight (88) square feet. Section 3. The variation is granted subject to the following conditions and restrictions: a. The driveway must comply with the taper requirements of the Buffalo Grove Municipal Code; b. The Owners and their agents, in the course of removing snow from the driveway on the Property shall not deposit, or cause to be deposited, any snow on the property of the neighbor to the north of the Property; c. The driveway shall be tapered so as to not exceed 24 feet in width where it joins the sidewalk. The driveway apron will be expanded as required by the Title 16, Development, of the Buffalo Grove Municipal Code; d. The Owners shall not allow any vehicles to be parked on any of the brick pavers that are located to the north of a line running immediately adjacent and parallel 2 to a line along the north edge of the existing concrete driveway running the entire length of the driveway as depicted in Exhibit B; e. The brick pavers will be maintained so that vegetation does not grow through or among the pavers; f. In the event that the purpose or unique circumstances of the variation no longer exist, or the Owners no longer reside on the Property, or the variance is no longer needed, the Owners shall immediately remove the brick pavers. Section 4. This Ordinance shall be in full force and effect from and after its passage, and approval, subject to execution by the Owners of the Property of the Acceptance and Agreement attached hereto as Exhibit A, incorporated herein and made a part hereof and the filing of said Acceptance and Agreement form with the Village. This Ordinance shall not be codified. The commitment herein made by the undersigned shall be enforceable by the Village of Buffalo Grove, Illinois, in a court of law or in equity in addition to any and all other remedies available to the Village to secure compliance with the provisions, requirement, and conditions agreed to herein.
