Ordinance No. 2010 -07, AN ORDINANCE
GRANTING VARIATION FROM SECTION
14.20.010 OF THE BUFFALO GROVE SIGN
CODE provided by its terms that it should be
published in pamphlet form.
The pamphlet form of Ordinance No. 2010 -07,
including the Ordinance and a sheet thereof, was
prepared, and a copy of such Ordinance was posted
in and at the Village Hall, commencing on February
23, 2010 and continuing for at least ten days
thereafter. Copies of such Ordinance were also
available for public inspection upon request in the
Office of Village Clerk.

GRANTING VARIATION FROM SECTION 14.20.010
OF THE BUFFALO GROVE SIGN CODE
The Green at Chevy Chase, Southwest Corner of Johnson Drive and Milwaukee Avenue
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, request is being made by Penobscot Management, LLC as agent for the
owner, Chevy Chase Illinois, LLC, of the Green at Chevy Chase Apartments for the property
located at the southwest corner of Johnson Drive and Milwaukee Avenue, for variance of Sign
Code, Section 14.20.010, pertaining to Residential Districts for the purpose of installing a ground
sign that, with the increase of the grade by one (1) foot two (2) inches above the approved
established grade, would exceed the maximum height limitation of five (5) feet in vertical
distance as measured from the approved grade to the highest point of the sign; and
WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony,
prepared minutes, made certain findings, and has made an affirmative recommendation on the
said request for variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine
and find that said variation is in harmony with the general purpose and intent of the Sign Ordi-
nance, and that (1) the requirements of the Sign Code would cause undue and unnecessary
hardship to the sign user because of unique or unusual conditions pertaining to the property, (2)
the granting of the requested variance will not be materially detrimental to the property owners
in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally
to other properties in the Village, and (4) the granting of the variance will not be contrary to the
general objective of the Sign Code of moderating the size, number and obtrusive placement of
signs and the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:

Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. A variation is hereby granted to Sections 14.20.010 of the Buffalo Grove
Municipal Code to the Property legally described as follows:
Lot 3 in the Lincoln Club, being a Subdivision in part of the southwest '/a and the
southeast '/a of Section 34, and also part of the southwest LA of Section 35, all in
Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat
thereof recorded February 23, 1987 as Document 2538297, in Lake County, Illinois.
Commonly known as: Southwest Corner of Johnson Drive and Milwaukee Avenue
PIN: 15 -35- 300 -173 -0000
for the purpose of installing a ground sign on the Property that, with the increase of the grade by
one (1) foot two (2) inches above the approved established grade, would exceed the maximum
height limitation of five (5) feet in vertical distance as measured from the approved grade to the
highest point of the sign;
Section 3. The variation is subject to the following conditions:
A. The sign is to be installed per Village Zoning Board of Appeals Exhibits
"E1 ", "A2" and "A3 "submitted with the Petitioner's application;
B. Subject to the Village Engineer's Memorandum dated January 6, 2010 and
the Appearance Review Team (ART) minutes of January 6, 2010; and
C. That the Owner agrees that any additional costs incurred to access the
Village watermain adjacent to said sign would be paid by the Owner.
Section 4. This Ordinance shall be in full force and effect from and after its passage, and
approval, subject to execution by the Owner of the Property of the Acceptance and Agreement
attached hereto as Exhibit A, incorporated herein and made a part hereof and the filing of said
Acceptance and Consent Form with the Village. This Ordinance shall not be codified.
