2010-006ORDINANCE 2010 -_6 AN ORDINANCE AMENDING ORDINANCE NO. 2009-89 CONCERNING MUNICIPAL GAS USE TAX WHEREAS, the Village of Buffalo Grove is a home rule unit under subsection (a) of Section 6 of Article VII of the Illinois Constitution of 1970; and WHEREAS, subject to said Section, a home rule unit may exercise any power and perform any function pertaining to its government and affairs for the protection of the public health, safety, morals and welfare; and WHEREAS, in furtherance of its home rule powers, the Village President and Board of Trustees enacted Village Ordinance No. 2009 -89 on December 21, 2009. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS AS FOLLOWS: Section 1. The foregoing recitals are hereby adopted and incorporated into and made a part of this Ordinance as if fully set forth herein. Section 2. Section 5 of Village of Buffalo Grove Ordinance No. 2009 -89 is hereby amended to read as follows: Section 5. No later than January 15, 2011 and by January 15`h of every subsequent year thereafter, this Ordinance shall be reviewed by the Village's Corporate Authorities to either amend or repeal for subsequent years; provided, however, that this tax shall remain in full force and effect until further action is taken by the Board of Trustees of the Village. Section 3. All ordinances or parts of ordinances thereof in conflict with this ordinance are hereby repealed to the extent of any such conflict. Section 4. Any Section or provision of this ordinance that is construed to be invalid or void shall not affect the remaining Sections or provisions which shall remain in full force and effect thereafter. Section 5. This ordinance shall be in full force and effect upon its passage and approval. I further certify that on, February 1, 2010 the Corporate Authorities of the Village passed and approved Ordinance No. 2010 -06, AN ORDINANCE AMENDING ORDINANCE NO. 2009 -89 CONCERNING MUNICIPAL GAS USE TAX provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. 2010 -06, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on February 2, 2010 and continuing for at least ten days thereafter. Copies of such Ordinance were also available for public inspection upon request in the Office of Village Clerk.
