2009-08211/19/2009 ORDINANCE NO. 2009- 82 AN ORDINANCE ADDING CHAPTER 15.32 TO TITLE 15 OF THE VILLAGE OF BUFFALO GROVE MUNICIPAL CODE AND AMENDING SECTION 15.04.020 WHEREAS, the Village of Buffalo Grove is a Home Rule Unit by virtue of the Constitution of the State of Illinois of 1970. WHEREAS, the purpose of this ordinance is to register contractors that work in Buffalo Grove to help ensure that qualified contractors perform code compliant work for the residents and business community. Any person, firm or corporation engaged in the business of constructing, enlarging, altering, removing or remodeling any structure or doing work on the exterior of a property shall be required to obtain a Contractor Registration in Buffalo Grove. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS AND PURSUANT TO ITS HOME RULE AUTHORITY: SECTION 1: Chapter 15.32 of the Village of Buffalo Grove Municipal Code is hereby added to read as follows: Chapter 15.32 CONTRACTOR REGISTRATION Sections: 15.32.0 10 — General Provisions 15.32.020 — Exceptions 15.32.030 — Fees 15.32.040 — Special Requirements 15.32.050 — Review Panel 15.32.060 - Appeal 15.32.010 — General Provisions No person, firm, partnership, corporation, or other entity shall engage as a general contractor, subcontractor, or construction manager for alarm, tarmac, carpenter, cement, demolition, electrical, excavator, fence, irrigation, low voltage electrical, mason, mechanical (heating & air conditioning), plumbing, sewer, fire suppression or any other type of work that requires a building permit in the Village of Buffalo Grove, unless they possess a current Contractor Registration in the Village of Buffalo Grove pursuant to the requirements of this Chapter ( "Contractor Registration ") and (except as set forth in sections 15.32.020 and 15.32.030) pay a $100.00 annual fee. 15.32.020 — Exceptions The following contractors will have to complete a Village of Buffalo Grove Contractor Registration but are exempt from the $100.00 annual fee since they are licensed by the State of Illinois: plumbing, irrigation, roofing, alarm and fire suppression/sprinkler. 15.32.030 — Fees All Contractor Registration fees are based on a calendar year. Any, contractor who is registering for more than one trade will pay $100 for the first trade and $50 for any subsequent trade. Any contractor registering on or after July 1" will pay one -half the required fee until the end of the year. 15.32.040 — Additional Requirements A. Electrical Contractors - Electrical contractors are required to provide a copy of their current electrical registration. The Village honors registrations of any Illinois municipalities that require a written exam prior to the issuance of the license /registration. 1. Electrical Contractors. It shall be unlawful for any person to engage in the business of electrical work, without being registered as an electrical contractor. If such person is registered for the current year in another city or village within the State of Illinois, in conformity with the State statutes, such electrical contractor shall be required to show proof of such registration. The term "electrical contractor" as used in this section shall be understood to mean any person installing or altering electrical equipment for the utilization of electricity supplied for light, heat or power, but not including radio apparatus or equipment for wireless reception of sounds and signals, conductors and other equipment installed under the jurisdiction of the Illinois Commerce Commission, for use in their operation as public utilities. The term "electrical contractor" does not include employees of an electrical contractor who perform or supervise work. 2. The Corporate Authorities, by virtue of the Illinois Compiled Statutes, requires candidates for electrical registration to successfully complete a written examination administered by the Village Electrical Commission or contractor registration from any Illinois municipality that administers written examinations. Those holding an electrical registration from the Village of Buffalo Grove shall pay an annual $50.00 registration fee. 3. Home Owners. The requirement for an electrical contractor may be waived with special permission from the Building Commissioner or Electrical Inspector if the homeowner provides acceptable evidence to the Village of their qualifications to perform electrical work. However, if upon inspection the Village determines that the work is not progressing satisfactorily in a workman -like manner with the applicable codes as determined solely by the Village, the Village may require that the homeowner immediately hire an electrical contractor to complete the work in conformance with.the applicable codes. 4. Where a registered electrician or electrical contractor is found doing electrical work without a permit on two separate occasions within any twelve month 2 i period, a hearing shall be held by the Electrical Commission, in the presence of the Electrical Inspector, at which time the permit privileges of said electrician or electrical contractor may be suspended for a period of time not to exceed one year. 5. In cases of emergency, the Electrical Inspector has the authority to disconnect current to any electrical equipment found to be unsafe. B. Irrigation. Irrigation contractors are required to provide a copy of their current State of Illinois Department of Public Health Certificate of Registration. C. Plumbing. Plumbing contractors are required to provide a copy of their State of Illinois or City of Chicago license, and provide a copy of their State of Illinois Plumbing Contractor Registration. The plumbing contractor shall provide a letter of intent for each project. The letter shall be on company letterhead, signed by the license holder and contain the corporate seal or be notarized. The requirement for a licensed plumbing contractor may be waived when a homeowner requests to perform the work with special permission from the Building Commissioner or Plumbing Inspector if the homeowner provides acceptable evidence to the Village of their qualifications to perform plumbing work. However, if upon inspection the Village determines that the work is not progressing satisfactorily in a workman -like manner with.the applicable codes as determined solely by the Village, the Village may require that the homeowner immediately hire a licensed contractor to complete the work in conformance with the applicable codes. D. Roofing. Roofing contractors are required to provide a copy of their current State of Illinois Roofing License. E. Sprinkler/Fire Suppression. Sprinkler/Fire Suppression contractors are required to provide a copy of their current Fire Sprinkler Contracting License. F. Alarm. Alarm contractors are required to provide a copy of their current State of Illinois Alarm Contractor license. 15.32.050 — Review Panel A. Any contractor working in the Village may have their contractor registration revoked by the Village Review Panel after notice and hearing as provided for in this Chapter for any of the following causes: (i) noted code violations are not corrected during the construction of a permitted improvement, (ii) there is a failure to obtain final inspections, (iii) permits are not obtained for work being done, (iv) consumer fraud, or (v) violation of applicable Village regulations. The Village Review Panel shall be comprised of the Deputy Building Commissioner /Operations, Deputy Building Commissioner /Administration and the Plan Reviewer. B. Notice of the hearing for revocation of a contractor's registration shall be given in writing, setting forth the grounds of the complaint and the time and place of the hearing. Such notice shall be (i) mailed at least five days prior to the date set for the hearing by certified mail to the contractor at the contractor's last known address; or by personal service. 3 9 15.32.060 — Appeal 0 Any person shall have the right of an appeal of the decision of the Review Panel in the revocation of a Contractor Registration to the Village Manager. Such appeal shall be taken by filing with the Village Clerk, within ten days after notice of revocation, a written statement under oath setting forth specifically the grounds for appeal. The Village Manager shall affirm, modify, or reverse the decision of the Review Panel. The decision of the Village Manager on such appeal shall be final. SECTION 2: Subsection 108.2, Schedule of permit fees, of Section 15.04.020, Amendments, of the Buffalo Grove Municipal Code is hereby amended to read as follows: Section 108.2 Schedule of permit fees. (Amend to read as follows.) On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the schedule as established by the Village of Buffalo Grove. A. A fee for each plan examination, building permit and inspection shall be paid prior to the issuance of permit(s) in accordance with the following; schedule: . 1. Building Permit. Fees. For construction costs up to one thousand dollars, the fee will be: fifty dollars. For construction costs over one thousand dollars; the fee will be fifty dollars for the first one thousand dollars, plus ten dollars for each additional one thousand dollars or fraction thereof. Decks, sheds and gazebos have a fifty -five dollar base fee plus fifteen cents per sq. ft. (not including any electrical fees). Whenever the cost of construction is a factor in determining a permit or plan review fee, the valuation of building projects shall be established based on the greater of: a. The cost of construction established by the International Code Council (ICC) and published on their website. Adjustments to these figures shall be made on March 1 of each year based upon ICC published data; or b. The cost of construction as stated by the applicant or agent on the application for the relevant permit. 2. Building Plan Review Fees. Building Sq. Ft. Electrical Permit Fees. (a) The fees for circuits shall be determined as follows: 15 AMPS - $7.00 each 20 AMPS - $12.00 each 30 AMPS - $20.00 each 40 AMPS - $25.00 each 50 AMPS - $30.00 each 60 AMPS - $40.00 each (b) For services, including service revisions, the fee shall be: 100 am $ 50.00 101 through 200 am $ 75.00 201 through 400 am $100.00 401 through 800 am $150.00 5 801 through 1199 am $200.00 1200 through 4000 $250.00 am $ 65.00 4001 through 8000 $300.00 amp $110.00 (c) For feeder circuits, the fees shall be: 60 through 100 amp $ 35.00 101 through 200 am $ 50.00 201 through 400 am $ 65.00 401 through 600 am $ 85.00 $110.00 Section 3. Any person violating any portion of this ordinance shall be punished according to the provisions of Chapter 1:08 of the Buffalo Grove Municipal Code. Section 4. This ordinance shall be in full force and effect from and after its passage, approval and publication. The installation permit fee shall be in addition to any electrical or plumbing fees that may be required. 9. Health Department Plan Review Fees. Plan review fees for the Health Department shall be fifty dollars or twenty -five percent of building plan review fee -- whichever is greater. 10. Reinspection Fees. The aforementioned permit fees include one reinspection. Any inspection or reinspection not covered by the fees designated in this section shall be charged at fifty dollars per inspection. E 11. Work Prior to Permit. Where work has been started prior to the issuance of a permit, the normal permit fee shall be doubled with a minimum of fifty dollars and a maximum of one thousand dollars. 12. Certificate of Occupancy. The fee for Certificate of Occupancy, including business license inspections, shall be as follows: Residential (per unit) $ 50.00 Non - residential (per unit) $150.00 13. Zoning /Code Compliance Letter -- non - residential only $150.00 SECTION 3 — If any section, paragraph, clause, sentence or provision of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder of this Ordinance, but the effect thereof shall be confined to the section, paragraph, clause, sentence or provision immediately involved in the controversy in which judgment or decree shall be rendered. SECTION 4 — Any person violating any portion of this ordinance shall be punished according to the provisions of Chapter 1.08 of the Buffalo Grove Municipal Code. SECTION 5 - This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law as of January 01, 2010. Electrical Permit Fees. The aforementioned permit fees include one reinspection. Any inspection or reinspection not covered by the fees designated in this section shall be charged at fifty dollars per inspection. -r 11. Work Prior to Permit. Where work has been started prior to the issuance of a permit, the normal permit fee shall be doubled with a minimum of fifty dollars and a maximum of one thousand dollars. 12. Zoning/Code Compliance Letter -- non - residential only $150.00 SECTION 3 — If any section, paragraph, clause, sentence or provision of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder of this Ordinance, but the effect thereof shall be confined to the section, paragraph, clause, sentence or provision immediately involved in the controversy in which judgment or decree shall be rendered. SECTION 4 — Any person violating any portion of this ordinance shall be punished according to the provisions of Chapter 1.08 of the Buffalo Grove Municipal Code. SECTION 5 - This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law as of January 01, 2010.
