2008-061-A i 1 0 07/29/2008 ORDINANCE NO. 2008 - 61 An Ordinance Amending Ordinance No. 2008 -36 Affinity Health Care, LLC (1450 Busch Parkway, LLC) 1450 Busch Parkway Corporate Grove Subdivision WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT and BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, LAKE and COOK COUNTIES, ILLINOIS, as follows. Section 1. On June 2, 2008 the Village enacted Ordinance No. 2008 -36, which Ordinance .approved a Preliminary Plan for Affinity Health Care, LLC at 1450 Busch Parkway. Section 21 of Village Ordinance No. 2008 -36 provided as follows: 2.J. Developer shall dedicate a public access easement and construct the shared access drive on the east side of the Property as depicted on Exhibits B and C hereto. Said public access easement shall be delineated on the plat of subdivision. Section 2. Section 2.J. of Village of Buffalo Grove Ordinance No. 2008 -36 is hereby amended to read as follows: Z.J. Developer shall grant a permanent non - exclusive access easement and construct the shared access drive on the east side of the Property as depicted on Exhibits B and C hereto. The access easement shall be for the use and benefit of the owners, occupants, tenants, guests, invitees and licensees of Lots 100, 101 and 102 in the Corporate Grove Subdivision. Said access easement shall be granted on the plat of subdivision. Section 3, if any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity thereof shall not affect any other provision of this ordinance. .,._ 0 1 ! Section 4. This ordinance shall be effective upon its passage and approval. This ordinance shall not be codified.
