2008-055• ORDINANCE NO. 2008- 55 GRANTING VARIATION FROM SECTION 14.20.010 OF THE BUFFALO GROVE SIGN CODE Buffalo Grove Park District, Emmerich Park East 151 Raupp Boulevard WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, request has been made by the Buffalo Grove Park District, 530 Bernard Drive, for variance of Sign Code, Section 14.20.010, pertaining to Residential Districts, for the purpose of allowing two (2) additional wall signs at Emmerich Park East, 151 Raupp Boulevard; one wall sign to be located on the north elevation of the building and one wall sign to be located on the east elevation of the building. The proposed wall signs would exceed the number of allowable signs and all signs would exceed the total allowable square footage by approximately 113 square feet; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on the said request for variation; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variation is in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variance will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variance will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: 1 • 0 Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variation id hereby granted to Section 14.20.010 of the Village Municipal Code to the Property legally described as follows: Lot G of Buffalo Grove Unit Two, being a Subdivision in the northeast quarter of the quarter of Section 5, Township 42 north, Range 11, east of the Third Principal Meridian (except the north 40 rods thereof) and the southeast quarter of the northeast quarter of said Section (except the south 1,074.82 feet thereof), all in Cook County, Illinois. for the purpose of allowing two (2) additional wall signs at Emmerich Park East, 151 Raupp Boulevard; one wall sign to be located on the north elevation of the building and one wall sign to be located on the east elevation of the building. The proposed wall signs would exceed the number of allowable signs and all signs would exceed the total allowable square footage by approximately 113 square feet. Section 3. The variation is subject to the following conditions: A. The signs are to be installed in accordance with the exhibits submitted with the application for variation to the Zoning Board of Appeals, and B. The signs are restricted to the size approved by this variation. Section 4. This Ordinance shall be in effect from and after its passage and approval.
