2008-052OORDINANCE NO. 2008- 52 • GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN CODE El Polio Loco, 1200 W. Dundee Road WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, request has been made by ABE Holdings, LLC, 717 Walden, Winnetka, Illinois 60093, the owner of the hereinafter legally described real property commonly known as 1200 W. Dundee Road for variance of Sign Code, 14.20.030, pertaining to Business Districts, Section 14.20.070, pertaining to Ground Signs; Section 14.20.080, pertaining to Wall Signs; and Section 14.40.025, pertaining to Changeable Copy, for the purpose of installing a ground sign that would be located three (3) feet from the property line; to install a menu board ground sign with changeable copy; to allow a wall sign on the south elevation of the building that would exceed the size allowed; to allow two (2) wall signs on the north elevation of the building that does not face the public right -of -way; and to allow a wall sign on the east elevation of the building that exceeds the size allowed; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on the said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. 1 NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Sections 14.20.030, 14.20.070, 14.20.080, and 14.40.025 of the Village Municipal Code to the Property legally described as follows: Lot 1 in Mobil's Arlington Heights Road and Dundee Road Subdivision, being a Subdivision of part of the south half of the southeast quarter of Section 5, Township 42 north, Range 11, east of the Third Principal Meridian, according to the Plat thereof recorded October 26, 1989 as Document 89509357, in Cook County, Illinois. for the purpose of installing a ground sign that would be located three (3) feet from the property line; to install a menu board ground sign with changeable copy; to allow a wall sign on the south elevation of the building that would exceed the size allowed; to allow two (2) wall signs on the north elevation of the building that does not face the public right -of -way; and to allow a wall sign on the east elevation of the building that exceeds the size allowed. Section 3. The variations are subject to the following conditions: A. The signs to be installed shall be in accordance with the exhibits submitted with the application for variations to the Zoning Board of Appeals; B. Shall be subject to the Village Engineer's Memorandums dated June 3, 2 008 and July 15, 2008; C. The proposed ground sign shall not exceed six (6) feet in height; and D. The proposed channel letter wall signs on the north and east elevations of the building are not to exceed ten (10) feet in length. Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. I further certify that on, August 4, 2008 the Corporate Authorities of the Village passed and approved Ordinance No. 2008 -52, AN ORDINANCE GRANTING CERTAIN VARIATIONS TO THE VILLAGE OF BUFFALO GROVE SIGN CODE FOR EL POLLO LOCO 1200 W. DUNDEE RD.. provided by its terms that it should be published in pamphlet form. The pamphlet form of Ordinance No. 2008 -52, including the Ordinance and a sheet thereof, was Prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on August 5, 2008 and continuing for at least ten days thereafter.
