GRANTING A VARIATION FROM SECTION 17.44.060.E.6.
OF THE BUFFALO GROVE MUNICIPAL CODE
Buffalo Wings & Rings, 100 McHenry Road
WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois
Constitution of 1970; and
WHEREAS, Cummings & Jacob Holdings, LLC., d/b /a Buffalo Wings '& Rings,
as lessee of the hereinafter legally described real property, commonly known as 100 McHenry
Road, Buffalo Grove, Illinois, ( "Property ") by and with the consent of the owner of the Property
has requested a variation from Section 17.44.060.E.6. of the Buffalo Grove Municipal,
pertaining to signs, for the purpose of allowing an additional wall sign on the east elevation of
the building on the Property and would allow each of the two (2) proposed wall signs to exceed
the maximum limitation of 75 square feet by approximately 8 square feet; and
WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony,
prepared minutes, made certain findings, and has made an affirmative recommendation on the
said request for a variation; and
WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine
and find that said variation is in harmony with the general purpose and intent of the Sign Ordi-
nance, and that (1) the requirements of the Sign Code would cause undue and unnecessary
hardship to the sign user because of unique or unusual conditions pertaining to the property, (2)
the granting of the requested variance will not be materially detrimental to the property owners
in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally
to other properties in the Village, and (4) the granting of the variance will not be contrary to the

general objective of the Sign Code of moderating the size, number and obtrusive placement of
signs and the reduction of clutter.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES,
ILLINOIS, as follows:
Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate
Authorities and made a part hereof.
Section 2. A variation is hereby granted to Section 17.44.060.E.6. of the Village of
Buffalo Grove Municipal Code to the Property legally described as follows:
The portion of the building known as 100 McHenry Road on Lot 1 of Buffalo Grove
Town Center Unit 9, being a resubdivision of Lots 1 and 2 in Buffalo Grove Unit 7, in
Section 33, Township 43 North, Range 11 East of the Third Principal Meridian in Lake
County, Illinois.
for the purpose of allowing an additional wall sign on the east elevation of the building on the
Property and would allow each of the two (2) proposed wall signs to exceed the maximum
limitation of 75 square feet by approximately 8 square feet.
Section 3. The variance shall be subject to the following conditions:
A. The signs are to be installed per Exhibits `B2" and `B3" as presented to the Zoning
Board of Appeals,
B. No sign shall be installed on south elevation of the building, and
C. The ampersand in the sign is to be red.
Section 4. This Ordinance shall be in effect from and after its passage and approval.
This Ordinance shall not be codified.

that it should be published in pamphlet form.
The pamphlet form of Ordinance No. 2008 -45,
including the Ordinance and a sheet thereof, was
prepared, and a copy of such Ordinance was posted
in and at the Village Hall, commencing on July 8,
2008 and continuing for at least ten days thereafter.
Copies of such Ordinance were also available for
public inspection upon request in the Office of
Village Clerk.
