2008-0440 • ORDINANCE NO. 2008- 44 GRANTING VARIATIONS FROM CERTAIN SECTIONS OF THE BUFFALO GROVE SIGN ORDINANCE Highland Park Hospital Health and Fitness Center Sign at 1525 Busch Parkway WHEREAS, the Village of Buffalo Grove is a Home Rule Unit pursuant to the Illinois Constitution of 1970; and WHEREAS, BRE /ESA Properties, LLC., is the owner of the hereinafter legally described real property commonly known as 1525 Busch Parkway ( "Property "); and WHEREAS, Highland Park Hospital Health and Fitness Center Limited Partnership, located at 1501 Busch Parkway, has entered into a written Agreement dated February 15, 2008 entitled "Sign Placement at Extended Stay America, Buffalo Grove, Illinois" with the owner of the Property for placement of a sign thereon; and WHEREAS, Highland Park Hospital Health and Fitness Center has requested variations from the following sections of the Village's Sign Code: Section 14.20.050, pertaining to Industrial Districts, and Section 14.40.145 pertaining to off - premise signs, for the purpose of installing an additional sign onto the existing ground sign on the property commonly known as 1525 Busch Parkway; and WHEREAS, the Zoning Board of Appeals has held a public hearing, received testimony, prepared minutes, made certain findings, and has made an affirmative recommen- dation on the said request for variations; and WHEREAS, the Corporate Authorities of the Village of Buffalo Grove hereby determine and find that said variations are in harmony with the general purpose and intent of the Sign Ordinance, and that (1) the requirements of the Sign Code would cause undue and unnecessary hardship to the sign user because of unique or unusual conditions pertaining to the property, (2) the granting of the requested variances will not be materially detrimental to the 1 property owners in the vicinity, (3) the unusual conditions applying to the specific property do not apply generally to other properties in the Village, and (4) the granting of the variances will not be contrary to the general objective of the Sign Code of moderating the size, number and obtrusive placement of signs and the reduction of clutter. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF BUFFALO GROVE, COOK AND LAKE COUNTIES, ILLINOIS, as follows: Section 1. The preceding WHEREAS clauses are hereby adopted by the Corporate Authorities and made a part hereof. Section 2. Variations are hereby granted to Sections 14.20.050, and 14.40.145 of the Village Municipal Code to the Property legally described as follows: Lot 3 in the Corporate Grove First Resubdivision, being a Resubdivision of Lots 1 through 7 in the Corporate Grove, a Subdivision of portions of Sections 26 and 27, Township 43 north, Range 11, east of the Third Principal Meridian, according to the Plat of said Resubdivision recorded January 31, 1007 as Document Number 3928723 in the Village of Buffalo Grove, Lake County, Illinois. for the purpose of installing an additional sign onto the existing ground sign on the property commonly known as 1525 Busch Parkway; and Section 3. The variations are subject to the following conditions: A. The sign is to be installed in accordance with Exhibits "F1" and "F2" submitted with the application for variations to the Zoning Board of Appeals. Section 4. This Ordinance shall be in effect from and after its passage and approval. This Ordinance shall not be codified. The pamphlet form of Ordinance No. 2008 -44, including the Ordinance and a sheet thereof, was prepared, and a copy of such Ordinance was posted in and at the Village Hall, commencing on July 8, 2008 and continuing for at least ten days thereafter.
